2. केओपीटी ने अपने पत्र दिनांक 23 जनवरी , 2009 द्वारा इस प्राधिकरण से अनुरोध किया है कि हल्दिया और कोलकाता में भूमि और भवनों के लिए किराया अनुसूची के संशोधन के लिए प्रस्ताव प्रस्तुत करने की तारीख मार्च 2009 तक बढ़ाई जाए और हल्दिया में केओपीटी के भूमि और भवनों की मौजूदा किराया अनुसूची की वैधता जून 2009 तक की अवधि के लिए बढ़ाई जाए ।
सं.टीएएमपी/56 / 2005-केओपीटी. महापत्तन न्यास अधिनियम, 1963 ( 1963 का 38 ) की धारा 49 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए महापत्तन प्रशुल्क प्राधिकरण एतद्वारा संलग्न आदेशानुसार , हल्दिया और कोलकाता में केओपीटी के भूमि और भवनों की दर अनुसूची के लिए कोलकाता पत्तन न्यास ( केओपीटी ) द्वारा प्रस्ताव प्रस्तुत किए जाने की तारीख बढ़ाता है और हल्दिया में केओपीटी के भूमि और भवनों की मौजूदा दर अनुसूची की वैधता बढ़ाता है ।
3. केओपीटी ने बताया है कि उन्हें दी गई फीडबैक के अनुसार मूल्यांकन रिपोर्ट में संशोधन करने पर उनका विचार-विमर्श जारी है । इस प्रकार , केओपीटी को कोलकाता और हल्दिया में भूमि और भवनों की किराया अनुसूची के संशोधन के लिए अपना प्रस्ताव प्रस्तुत करने के लिए कुछ और समय की जरूरत होगी ।

4. अतः हल्दिया में केओपीटी के भूमि और भवनों की मौजूदा किराया अनुसूची की वैधता 31 जनवरी , 2009 से बढ़ाई जाती है और वैधता 30 जून, 2009 तक अथवा हल्दिया में अपने भूमि और भवनों की किराया अनुसूची के संशोधन के लिए केओपीटी द्वारा दाखिल किए जाने वाले प्रस्ताव पर इस प्राधिकरण द्वारा पारित किए जाने वाले आदेश की अधिसूचना की प्रभावी तारीख तक जो भी पहले हो , बनी रहेगी । केओपीटी को हल्दिया में केओपीटी के भूमि और भवनों की किराया अनुसूची के संशोधन के लिए अपना संशोधित प्रस्ताव दाखिल करने और कोलकाता में केओपीटी के भूमि और भवनों के लिए किराया अनुसूची के प्रस्ताव के लिए 31 मार्च , 2009 तक समय विस्तार प्रदान किया जाता है ।
ब्रह्म दत्त , अध्यक्ष इस प्राधिकरण ने हल्दिया में केओपीटी के भूमि और भवनों की मौजूदा किराया अनुसूची की वैधता को 31 जनवरी , 2009 तक अथवा हल्दिया और कोलकाता में केओपीटी के भूमि और भवनों के लिए किराया अनुसूची के संशोधन के लिए कोलकाता पत्तन न्यास (केओपीटी ) द्वारा दाखिल किए जाने वाले प्रस्ताव पर इस प्राधिकरण द्वारा पारित किए जाने वाले आदेश की अधिसूचना की तारीख तक जो भी पहले हो , बढ़ाते हुए एक ओदश दिनांक 30 सितम्बर, 2008 पारित किया था और केओपीटी को निदेश दिया था कि 30 नवम्बर , 2008.

NOTIFICATION
Mumbai , the 18th February, 2009
No. TAMP/ 56/2005 - KOPT. In exercise of the powers conferred by Section 49 of the Major Port Trusts Act, 1963 (38 of 1963) , the Traiff Authority for Major Ports hereby extneds the date for submission of the proposal by the Kolkata Port Trust (KOPT) for Schedule of Rent for Land and Buildings of KOPT at Haldia and at Kolkata and extends the validity of the existing Schedule of Rates for Land and Buildings of KOPT at Haldia as in the Order appended hereto .

This Authority had passed an Order dated 30th September, 2008 , extending the validity of the existing Rent Schedule of Land and Buildings of KOPT at Haldia till 31st January, 2009 or till the effective date of Notification ofOrder to be passed by this Authority on the proposal to be filed by the Kolkata Port Trust ( KOPT ) for revision of Schedule ofRent for Land and Buildings of KOPT at Haldia and at Kolkata, whichever is earlier and directed the KOPT to file its revised proposal by 30th November , 2008. This Order was notified in the Gazette of India on 30thOctober, 2008 .

2. The KOPT vide its letter dated 23rd January , 2009 has requested this Authority to extend the date of submission of proposal for revision of the Schedule of Rent for Land and Buildings at Haldia and at Kolkata till March 2009 and extend the validity of the existing Rent Schedule of Land and Buildings of KOPT at Haldia for a period upto June 2009 .
3. The KOPT has reported that their Consultants are in the process of revising the Valuation Report as per the feedback given to them . As such , KOPT will need some more time to submit its proposal for revision of Rent Schedule of Land and Buildings at Kolkata and Haldia .
4.The validity ofthe existing Rent Schedule for Land and Buildings of KOPT at Haldia is , therefore , extended from 31st January, 2009 and shall remain valid till 30th June , 2009 or till the effective date of notification of Order to be passed by this Authority on the proposal to be filed byKOPT for revision of the Rent Schedule for its Land and Building at Haldia , whichever is earlier . The KOPT is granted an extension of time upto 31st March , 2009 to file its revised proposal for revision of the Schedule of Rent for Land and Buildings of KOPT at Haldia and a proposal for Schedule ofRent for Land and Buildings of KOPT at Kolkata .
