का.आ. 563(अ) केन्द्रीय सरकार , यह अभिनिश्चित करने की दृष्टि से यह आवश्यक समझती है कि उद्योग ( विकास और विनियमन ) अधिनियम, 1951 ( 1951 का 65 ) ( जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है ) के अधीन आनुषंगिक और लघु औद्योगिक उपक्रमों को देश की औद्योगिक अर्थव्यवस्था का सामंजस्य रीति से संवर्धन करने और बेरोजगारी की समस्या को कम करने में उनकी जीवन क्षमता और सामर्थ्य बनाए रखने में समर्थ करने के लिए अनुपोषक उपायों, छूट या अन्य अनुकूल व्यवहार की आवश्यकता है ;
और केन्द्रीय सरकार , उपर्युक्त उक्त प्रयोजन के लिए भारत सरकार के तत्कालीन उद्योग मंत्रालय , औद्योगिक नीति और संवर्धन विभाग के आदेश को, जो का.आ. 857 ( अ ) , तारीख 10 दिसम्बर, 1997 द्वारा प्रकाशित किया गया था , विखंडित करना आवश्यक समझती है ;
और उक्त विखंडित प्रारूप अधिसूचना की प्रति, उक्त अधिनियम की धारा 11 ख की उप - धारा ( 3 ) की अपेक्षानुसार संसद के प्रत्येक सदन के समक्ष तीस दिन की अवधि के लिए रखी गई थी ;
और संसद के दोनों सदनों ने प्रस्तावित अधिसूचना में कोई उपांतरण करने का प्रस्ताव नहीं किया है ;
अतः अब केन्द्रीय सरकार , उद्योग ( विकास और विनियमन) अधिनियम , 1951 (1951 का 65 ) की धारा 11 ख की उप - धारा (1 ) और धारा 29ख की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए अपना यह समाधान हो जाने पर लोकहित में ऐसा करना आवश्यक है भारत सरकार के तत्कालीन उद्योग मंत्रालय , औद्योगिक नीति और संवर्धन विभाग की अधिसूचना को जो का.आ. 857(अ ) , तारीख 10 दिसम्बर , 1997 द्वारा प्रकाशित की गई थी , उन बातों के सिवाय विखंडित करती है जो ऐसे विखंडन से पूर्व की गई थीं या करने का लोप किया गया था ।

टिप्पण. मूल अधिसूचना भारत के राजपत्र असाधारण में अधिसूचना सं. का.आ. 857 ( अ ) , तारीख 10 दिसम्बर , 1997 द्वारा प्रकाशित की गई थी और निम्नलिखित अधि सूचनाओं द्वारा प्रकाशित पश्चात्वर्ती संशोधन किए गए :-
1. का.आ. 1288 ( अ ) , तारीख 24 दिसम्बर , 1999;
2. का.आ. 1013 ( अ ) , तारीख 9 अक्तूबर , 2001;
3. का.आ. 655 ( अ ) , तारीख 5 जून , 2003;
4. का.आ. 1109( अ ) , तारीख 13 अक्तूबर, 2004; और
5. का.आ. 229 ( अ ) , तारीख 21 फरवरी , 2006 ।

S.O. 563 (E). Whereas , the Central Government considers it necessary with a view to ascertain which

ancillary and small scale industrial undertakings need supportive measures , exemption or other favourable treatment under the Industries (Development and Regulation) Act, 1951 (65 of 1951) (hereinafter referred to as the said Act ) to enable them to maintain their viability and strength so as to be effective in promoting in a harmonious manner the industrial economy ofthe country and easing the problem of unemployment;
And whereas, the Central Government considers it necessary to rescind the Order of the Government of India in the erstwhile Ministry of Industry , Department of Industrial Policy and Promotion, published vide number S.O. 857(E) , dated the 10th December , 1997 for the above- said purpose;
And whereas, a copy of the said rescinding draft notification was laid before each House of Parliament for a period ofthirty days as required under sub - section (3 ) of Section 11B of the said Act ;
And whereas, no modification in the proposed notification has been suggested by both the Houses of Parliament;
Now, therefore, in exercise of the powers conferred by sub-section ( 1 ) of Section 11B and sub - section ( 1 ) of Section 29B of the Industries ( Development and Regulation) Act, 1951 ( 65 of 1951 ), the Central Government,

on being satisfied- that it is necessary in the public interest so to do , hereby rescinds the notification of the Government of India in the erstwhile Ministry of Industry, Department of Industrial Policy and Promotion , published vide number S.O. 857 (E), dated the 10th December, 1997 , except as respects things done or omitted to be done before such rescission .
2. This notification shall come into force on the date ofits publication in the Official Gazette .
