फा. सं. एम.डी./गुणवत्ता/लॉगो/01 /09.-मसाला बोर्ड अधिनियम , 1986 ( 1986 का 10 ) की धारा 39 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए स्पाइसेस बोर्ड, केन्द्रीय सरकार के पूर्वानुमोदन से स्पाइसेस बोर्ड ( गुणवत्तों चिह्नाँकन ) विनियम , 1992 , में एतद्वारा निम्नानुसार संशोधन बनाता है , अर्थात्:-
1. ( ⅰ ) ये विनियम स्पाइसेस बोर्ड ( गुणवत्ता चिह्नाँकन ) ( संशोधन) विनियम, 2009 कहे जाएंगे ।
( ii ) ये सरकारी राजपत्र में इनके प्रकाशित होने की तारीख से प्रवृत्त होंगे ।
2. स्पाइसेस बोर्ड ( गुणवत्ता चिह्नाँकन ) विनियम , 1992 में-
(अ) विनियम 2 के उप - विनियम ( ञ ) में, निम्नलिखित प्रतिस्थापित किए जाएंगे अर्थात्,
2 (ञ ) " पैक " से अभिप्राय अनुमोदन प्रमाणपत्र में दिए गए और इन विनियमों में संलग्न परिशिष्ट में विहित मानक विनिर्देशों के अनुरूप मसालों व मसाले उत्पादों के किसी भी वजन के सभी पैकों से है ।
विनियम 6 के उप - विनियम ( XI ) के उप- खण्ड ( क) और ( ग ) में, निम्नलिखित प्रतिस्थापित किए जाएंगे , अर्थात्,
(xi ) (क ) पैकर इस विनियम के अनुसार मसालों तथा मसाले उत्पादों के निर्यात के लिए किसी भी वजन का परेषण तैयार करेगा और ऐसे तैयार किए गए परेषण इन विनियमों के परिशिष्ट में प्रत्येक मसाले के लिए निर्धारित विनिर्देशों में बताई गई इन श्रेणियों के संबंध में निर्धारित गुणबत्ता की परिभाषा के अनुरूप होंगे ।
(xi ) ( ग ) किसी भी वजन के मसालों व मसाले उत्पादों का अनुमोदन किया जाएगा और स्पाइसेस बोर्ड के साथ रजिस्ट्रीकरण किया जाएगा ।
3. विनियम 7 के उप- विनियम ( 2 ) में, निम्नलिखित प्रतिस्थापित किए जाएंगे , अर्थात्:-

7 ( 2 ) प्रतिनिधी नमूने लेने के लिए , बोर्ड के अधिकारी लॉट के एक प्रतिशत के रूप में , बशर्ते कि अधिकतम 600 ग्राम हो, नमूनों का चयन करेगा ।
4. विनियम 5 के उप- विनियम 9 ( ii ) में , निम्नलिखित प्रतिस्थापित किए जाएंगे , अर्थात् ,
5.9 ( ii ) नामशैली ( लॉगो ) मुद्रित किए हुए किसी भी वजन के मसालों व मसाले उत्पादों की मात्रा का लेखा -जोखा निर्यात परेषणों में उनके उपयोग के लिए दिया जाएगा और अभिलेखों को प्राधिकृत अधिकारी द्वारा पुनरीक्षण/निरीक्षण किए जाने के दौरान उपलब्ध कराया जाना चाहिए ।

पाद टिप्पणी :-मूल विनियम दिनांक 13-1-1992 की अधिसूचना द्वारा 1992 के सा.का.नि. 73 ( अ ) द्वारा जारी किया गया है जिसका आगे संशोधन 1993 के सं. का.आ. 210 , 1996 के सा.का.नि. 113 , दिनांक 15-2-1996 और 1996 के सा.का.नि. 480 (अ ) दिनांक4-10-1996 और सा.का.नि. 1 (अ) , दिनांक 31-12-1997 द्वारा किया गया है ।

F. No. MD/QLTY /LOGO /01 / 09.- In exercise of the powers conferred by section 39 of Spices Board Act, 1986 (10 of 1986) the Spices Board , with the previous approval of the Central Government , hereby makes the following amendments to the Spices Board (Quality Marking) Regulations , 1992, namely :-
1. ( i) These regulations may be called the Spices Board ( Quality Marking ) (Amendment ) Regulations , 2009 .
(ii) They shall come into force from the date of their publication in the Official Gazette.
2. In the Spices Board (Quality Marking ) Regulations , 1992.
(a) In Sub -regulation (j ) of regulation 2, the following shall be substituted , namely,
2 (j ) "Packs " means all packs of spices and spice products of any weight , listed out in the certificate of approval and conforming to the standard specification as laid down in the Appendix annexed to those regulation.
Insub - clause (a) and (c) of sub - regulation (xi ) of Regulation 6 , the following shall be substituted , namely , (xi) ( a) A packer shall prepare the consignment for export of spices and spice products of any weight as per this regulation and the consignment so prepared shall confirm to the grades and definition of quality prescribed in respect of these grades as set out in the specifications prescribed for each spices as given inAppendix to these regulations .
(xi) (c) Spices and spice products of any weight shall be approved and registered with the Spices Board.
3. In Sub - Regulation (2 ) of Regulation 7 the following shall be substituted , namely,
7 (2 ) For the purpose of drawing representative samples , the Board's officer shall select the samples as one per cent ofthe lot subject to a maximum of 600 grams.
4. In Sub - Regulation (9 ) ( ii ) of Regulation 5 the following shall be substituted , namely,
5.9 (ii ) The quantity of Spices and spice products of any weight printed with logo shall be accounted for their use in export consignments and records should be made available to the authorized officer during his review/ inspection.
