का.आ. 2686( अ.). मैसर्स हिन्दुस्तान एरोनॉटिक्स लिमिटेड, भारत सरकार का एक उपक्रम है , विसका पंजीकृत कार्यालय 15/1 , क्यूबन रोड, पी.बी.नं. 5150 , बंगलौर-560001 में स्थित है , जो अनुसंधान और विकास उपकर अधिनियम , 1986 ( 1986 का 32 ) ( जिसे इसके बाद उक्त अधिनियम कहा गया है ) की धारा 2 के खंड ( ङ) के अधीन एक औद्योगिक समुत्थान है ( जिसे इसके बाद औद्योगिक समुत्थान कहा गया है) ;
और , केन्द्रीय सरकार का यह समाधान हो गया है कि लोकहित में ऐसा करना आवश्यक और समीचीन है कि उक्त औद्योगिक समुत्थान को एयरफ्रेम, एवियोनिक्स तथा इसके सहायक उपकरणों की मरम्मत हेतु सुविधाओं की स्थापना के लिए प्रौद्योगिकी के आयात हेतु उक्त अधिनियम की धारा 3 के अधीन संदेय उपकर के संदाय से छूट दी जाए;
अतः , अब , केन्द्रीय सरकार, अनुसंधान और विकास उपकर अधिनियम, 1986 ( 1986 का 32 ) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , उक्त औद्योगिक समुत्थान की, सामान्य संविदा सं. पीबी/135611240204 दिनांक 28 सितम्बर, 2005 में निर्दिष्ट प्रौद्योगिकी के आयात के लिए उक्त अधिनियम की धारा 3 के अधीन , उक्त औद्योगिक समुत्थान को सम्पूर्ण संदेय उपकर के संदाय से , इस अधिसूचना के प्रकाशन की तारीख से पांच वर्ष की अवधि के लिए निम्नलिखित शर्तों के अधीन रहते हुए छूट देती है , नामतः
( i) ऐसी प्रौद्योगिकी का उपयोग उसी प्रयोजन के लिए किया जाएगा जिसके लिए इसका आयात किया जाता है ;
(ii ) ऐसी प्रौद्योगिकी का , विज्ञान और प्रौद्योगिकी मंत्रालय , विज्ञान और प्रौद्योगिकी विभाग , नई दिल्ली में भारत सरकार की पूर्व अनुज्ञा के बिना विक्रय , व्ययन , दान , उधार , आदान- प्रदान अथवा विभक्त नहीं किया जाएगा;
( iii ) खंड ( i ) और ( ii ) में उल्लिखित शर्तों के पूरा न होने की दशा में , उक्त औद्योगिक समुत्थान सम्पूर्ण उपकर का संदाय करने के लिए उत्तरदायी होगा; और
(iv ) इस अधिसूचना के अधीन प्रदान की गई छूट , तत्समय प्रवृत्त किसी अन्य कानून के अधीन किसी कर या शुल्क के संदाय की किसी अन्य दायिता पर कोई प्रतिकूल प्रभाव नहीं डालेगी ।

NOTIFICATION
New Delhi , the 26th October , 2009
S.O. 2686 (E) .- Whereas , M/ s Hindustan Aerofautics Limited a Government of India Undertaking , having its registered office at 15/1 , Cubbon Road, P.B No. 5150, Bangalore - 560001 , is an industrial concern ( hereinafter referred to as the said industrial concern ) in terms of clause ( e) of Section 2 of the Research and Development Cess Act , 1986 (32 of 1986 ) (hereinafter referred to as the said Act) ;
Andwhereas , the Central Government is satisfied that it is necessary and expedient so to do in the public interest . to exempt the said industrial concern from the payment of cess made towards the import of technology for setting up of facilities for overhaul of airframe , avionics and its accessories , payable under Section 3 of the said Act ;
Now, therefore , in exercise of the powers conferred by Section 7 ofthe Research and Development Cess Act , 1986 (32 of 1986) the Central Government, hereby exempts the said industrial concern from the payment of whole of the cess payable under Section 3 of the said Act, in relation to the import of technology referred to in general contract number PB/ 135611240204 dated 28th September , 2005 , which is meant for the said industrial concern , for a period of five years with effect from the date of publication of this notification , and subject to the following conditions , namely :-
(i) that such technology shall be used for the purpose for which it is imported;
(ii ) that such technology shall not be sold, disposed of, gifted, loaned , exchanged or parted away, without the prior permission of the Government of India in the Department of Science and Technology, Ministry of Science and Technology, New Delhi ;
(iii) that the said industrial concern shall be liable to pay entire cess in case of non- fulfilment of conditions mentioned in clauses (i ) and ( ii ) ; and
(iv) that the exemption granted under this notification shall be without prejudice to any other liability to pay any tax or duty under any other law for the time being in force .
