का.आ. 2687(अ). केन्द्रीय सरकार ने , भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 ( 1988 का 68 ) की धारा 11 के अधीन जारी की गई भारत सरकार के तत्कालीन भूतल परिवहन मंत्रालय ( सड़क खंड ) की अधिसूचना संख्या का.आ. 78 (अ) , तारीख 2 फरवरी , 1999 , द्वारा तमिलनाडु राज्य में राष्ट्रीय राजमार्ग सं. 45 के 122.000 कि.मी. से 417.000 कि.मी. , (चैन्नई - डिनडिगुल खंड ) तक के भू- खंड को भारतीय राष्ट्रीय राजमार्ग प्राधिकरण ( जिसे इसमें इसके पश्चात् प्राधिकरण कहा गया है ) को सौंपा था;
और , प्राधिकरण ने उक्त अधिनियम की धारा 14 द्वारा प्रदत्त शक्तियों के अनुसरण में राष्ट्रीय राजमार्ग संख्या 45 पर 285.000 कि.मी. से 325.000 कि.मी. ( पेडालुर- त्रिच्ची खंड) तक के तमिलनाडु राज्य में ( जिसे इसमें इसके पश्चात् उक्त खण्ड कहा गया है ) दो लेन वाले भाग को चार लेन बनाने , इंजीनियरिंग , संरचना , निर्माण , विकास , वित्त , प्रचालन और अनुरक्षण के लिए मैसर्स इन्दु नवयुग इनफरा प्रोजेक्टस प्राइवेट लिमिटेड, जिसका रजिस्ट्रीकृत कार्यालय 1539 एवेन्यु । , स्ट्रीट नम्बर 17 , बनजारा हिल्स, हैदराबाद ( जिसे इसमें इसके पश्चात् " रियायतग्राही " कहा गया है ) के साथ करार किया है;
अतः , अब, केन्द्रीय सरकार, राष्ट्रीय राजमार्ग ( राष्ट्रीय राजमार्ग सेक्शन/राष्ट्रीय राजमार्गों पर स्थायी पुल/अस्थायी पुल के उपयोग के लिए किसी व्यक्ति द्वारा फीस का संग्रहण ) नियम, 1997 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम , 1956 ( 1956 का 48 ) की धारा ४ क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , उक्त खंड के निर्माण , अनुरक्षण , प्रबंध और प्रचालन में अंतर्ग्रस्त व्यय , विनिघात पूंजी पर ब्याज , युक्तियुक्त प्रत्यागम , यातायात परिमाण और प्राधिकरण और रियायतग्राही के बीच हुए करार की अवधि को ध्यान में रखते हुए , यह अधिसूचित करती है कि उक्त खंड के उपयोग के लिए सारणी के स्तंभ (2 ) मेंविनिर्दिष्ट निम्नलिखित यानों के प्रकार पर उसके स्तंभ ( 3 ) में विनिर्दिष्ट दरों पर उग्रहीत और संग्रहीत की जाएंगी और उक्तरियायतग्राही को वाणिज्यिक प्रचालन या इस अधिसूचना के राजपत्र में प्रकाशन की तारीख से ही इनमें से जो भी पश्चात् हो, उक्त करार में यथा विनिर्दिष्ट समाप्ति की तारीख तक फीस संग्रहीत करने और प्रतिधारित करने के लिए प्राधिकृत करती है ।

रियायतग्राही उक्त खंड के उपयोग के लिए नीचे की सारणी के स्तंभ (2) में विनिर्दिष्ट यानों के प्रवर्ग पर फीस उक्त सारणी के स्तंभ ( 3) में विनिर्दिष्ट आधार फीस की दर पर संग्रहीत और प्रतिधारित करेगा ।
फीस पथकर 304.510 कि.मी. प्लाजा पर संग्रहीत की जाएगी ।

(i) " वास्तविक फीस " से निम्नलिखित आधार पर उक्त खंड के सड़क प्रयोक्ताओं से वास्तविक फीस अभिप्रेत है ।
(क) परियोजना राजमार्ग की लम्बाई, (ख) उक्त सारणी में सम्यक रूप से अनुक्रमणिका में दी गई आधार फीस, और जो पांच रूपये के निकटतम पूर्णांक में होगी ।
(ii) "वाणिज्यिक प्रचालन की तारीख " से वह तारिख अभिप्रेत है जिसको उक्त खंड पर प्राधिकरण और रियायतग्राही के बीच हुए करार के उपबन्धों के अनुसार उक्त खंड के पूरा होने पर स्वतंत्र परामर्शी द्वारा , यथास्थित, पूर्णता प्रमाणपत्र अथवा अनंतिम पूर्णता प्रमाणपत्र, जारी किए जाने के पश्चात्, वाणिज्यिक प्रचालन प्रारंभ होता है ।
(iii) 'स्थानीय यातायात से कार/ जीप/ वैन के लिए संदेय फीस के सम्बन्ध में निम्नलिखित प्रकार का यातायात अभिप्रेत है ।
(क) " स्थानीय यातायात प्रवर्ग I " से निम्नलिखित प्रवर्गों में से किसी के अंतर्गत आने वाले प्रयोक्ता अभिप्रेत हैं और इसमें सम्मिलित हैः भारत का राजपत्र असाधारण

(1) ऐसे ग्रामों/कस्बों/ शहरों के निवासी जिसकी सीमा पथकर प्लाजा से दस किलोमीटर के घेरे के भीतर आती है ।
पथकर प्लाजा के दस किलोमीटर के घेरे के भीतर अवस्थित स्थापनों/ औधोगिक ईकाई है ।
(2)
(3) ऐसे स्थापनों/ औधोगिक ईकाईयों के कर्मचारी , जो पथकर प्लाजा के दस किलोमीटर के घेरे के भीतर अवस्थित हैं या उनका कार्यालय स्थित है; और
(4) स्वनियोजित व्यक्ति/ कारोबारी जिनका काम करने का स्थान पथकर प्लाजा के दस किलोमीटर के घेरे के भीतर अवस्थित है।
(ख) " स्थानीय यातायात प्रवर्ग II " में निम्न लिखित प्रवर्ग में से किसी के अंतगर्त आने वाले स्थानीय प्रयोक्ता अभिप्रेत है और इसमें सम्मिलित है ।
(1) ग्रामों/ कस्बों/ शहर के निवासी जिसकी सीमा पथकर प्लाजा के दस किलोमीटर से अधिक किन्तु बीस किलोमीटर तक के घेरे के भीतर आती है ।
(2) पथकर प्लाजा के दस किलोमीटर से अधिक किन्तु बीस किलोमीटर तक के घेरे के भीतर अवस्थितस्थापन/औधोगिक ईकाईया है ।
(3) ऐसे स्थापनों/औधोगिक ईकाइयों के कर्मचारी जो पथकर प्लाजा के दस किलोमीटर से अधिक किन्तु से बीस किलोमीटर तक के घेरे के भीतर अवस्थित है या जिनका कार्यालय स्थित है।
(4) स्वनियोजित व्यक्ति/ कारोबारी जिनका काम करने का स्थान पथकर प्लाजा के दस किलोमीटर से अधिक किन्तु बीस किलोमीटर तक के घेरे के भीतर अवस्थित है ।
(iv) " समाप्ति की तारीख " से वह तारीख अभिप्रेत है जिसको प्राधिकरण और रियायतग्राही के बीच किया गया करार, उक्त करार के उपबंधों के अनुसरण में समाप्त होता है या समाप्ति सूचना द्वारा समाप्त किया जाता है ।
(v) उन शब्द और पदों के, जो इस अधिसूचना में प्रयुक्त है और परिभाषित नहीं हैं किन्तु उक्त धारा के सम्बन्ध में प्राधिकरण और रियायतग्राही के बीच किए गए करार में परिभाषित है वही अर्थ होंगे जो उक्त करार, में क्रमशः उनके हैं ।
2. फीस की दर प्रत्येक वर्ष 1 सितम्बर से पुनरीक्षित की जाएगी और उनकी संगणना निम्नलिखित प्रकार से की जाएगी: -

* डब्लयू पी आई से कार्यालय आर्थिक सलाहाकार, वाणिजय और उद्योग मंत्रालय, भारत सरकार के द्वारा जारी किया गया थोक कीमत सूचकांक या उसकों प्रतिस्थापित करने वाला कोई अन्य सूचकांक अभिप्रेत है ।
3. जब एक ही यान को उक्त खण्ड को एक दिन में एक से अधिक बार पार करना हो, तो उपयोक्ता के पास यह विकल्प होगा कि वह पहले ही चक्कर में पथकर प्लाजा को पार करते समय अनुसूची में दिए गए उक्त दरों पर अनेक चक्करों के लिए फीस का एक ही बार संदाय कर दे या यदि उसी यान को उक्त खंड का पूरे मास में लगातार और बार- बार उपयोग करना हो तो यान का स्वामी पूर्वोक्त अनुसूची में यथाविनिर्दिष्ट एक बार के लिए उसको लागू तीस एकल दरों के समतुल्य प्रभारों को संदाय करके मासिक पास प्राप्त कर सकता है ।
स्पष्टीकरणः- इस अधिसूचना के प्रयोजन के लिए 'दिन से 24 घंटे की निरंतर अवधि समझा जाएगा ।
4. निम्नलिखित प्रकार के यानों के संबंध में कोई फीस प्रभारित या संग्रहीत नही की जाएगी, अर्थात्ः-
(i) ऐसे यान -
(अ) जो " अति महत्वपूर्ण व्यक्ति " प्रतीक वाले हैं या शासकीय रूप से निम्नलिखित के हैं: - भारत के राष्ट्रपतिः
(क)
(ख) भारत के उपराष्ट्रपतिः
(ग) राज्य के राज्यपाल या संघ राज्य क्षेत्र के उप- राज्यपाल;
भारत के राजकीय दौरे पर उच्च पदस्थ विदेशी व्यक्ति;
(घ)
(ড) " सी डी" । " सी सी" नंबर प्लेटों वाली कारों का उपयोग करने वाले भारत में रह रहे विदेशी राजनयिक;
( च) राज्य सभा के सभापति या लोक सभा के अध्यक्ष या राज्य विधान परिषद का सभापति या राज्य विधान सभा के अध्यक्ष या संघ अथवा राज्य के मंत्री अथवा लोक सभा या राज्य सभा या राज्य विधान मंडलों के विपक्ष के नेता जिनकी हैसियत कैबिनेट मंत्री की है, यदि वे स्वयं यान में बैठें हों ; या
(छ) सम्पूर्ण देश के संसद सदस्य , या किसी राज्य की विधान सभा का सदस्य या राज्य की विधान परिषद का सदस्य, यदि वह, यथास्थिति, संसद अथवा राज्य के संबंधित विधान मंडल द्वारा जारी किया गया पहचान पत्र प्रस्तुत करता है ;
(आ) शौर्य पुरस्कारों अर्थात् परमवीर चक्र, अशोक चक्र, महावीर चक्र, कीर्ति चक्र, वीर चक्र और शौर्य चक्र के विजेता यदि ऐसा पुरस्कार प्राप्तकर्ता ऐसे पुरस्कार के लिए सक्षम प्राधिकारी द्वारा सम्यक् रूप से अधिप्रमाणित किया गया अपना फोटो पहचान पत्र प्रस्तुत करता है ;
(ii) रक्षा यान, जिनके अतंर्गत वे यान भी है जो भारतीय पथकर (सेना और वायुसेना) अधिनियम 1901 और उसके अधीन बनाए गए नियमों (नौसेना को यथा विस्तारित ) के उपबन्धों के अनुसार छूट के पात्र हैं ;
(iii) पुलिस यान, अग्नि शमन यान , एम्बुलेंस, अन्त्येष्टि यान, डाक और तार विभाग के यान, केंद्रीय सरकार और राज्य सरकार के कर्त्तव्यारूढ़ यान ।

5. करेगा; रियायतग्राही स्थानीय यातायात से निम्निलिखित छूट प्राप्त दरों से अधिक कोई फीस वसूल नहीं
(क)कार/जीप/वैन के लिए
(i) स्थानीय यातायात प्रवर्ग I : 150.00 रूपये का मासिक पास
(ii) स्थानीय यातायात प्रवर्ग II : 300.00 रूपये का मासिक पास
स्कूल बस: (ख) स्कूली छात्रों को ले जाने वाली स्कूल बसों के लिए पथकर प्लाजा पार करने के लिये स्कूल के प्राचार्य के लिखित अनुरोध के साथ स्कूल की मान्यता तथा बस का रजिस्ट्रीकरण दर्शाने वाले दस्तावेजों की प्राप्ति पर 1,000/- रू० (एक हजार रूपये) की मासिक दर से मासिक पास जारी किये जायें ।
(14) हल्के वाणिज्यिक यान या ट्रक (स्थानीय परिवहन प्रचालक)ः स्थानीय परिवहन प्रचालकों को 20 कि.मी. के भीतर उन्हें चलानें का सबूत जैसे कि स्पष्ट रूप से वाहन की वापसी के ब्योरे विनिर्दिष्ट करते हुये प्रारम्भिक और गन्तव्य स्थान के लिए माल का चालान , प्रस्तुत करने पर ट्रकों के लिये प्रत्येक प्रवेश पर 25 रू० ( पच्चीस रूपये) और हल्के वाणज्यिक वाहनों के लिये 15 रू० (पन्द्रह रूपये) , की दर से रियायती फीस ली जाएगी :
परन्तु, जहां स्थानीय यातायात द्वारा स्वतंत्र उपयोग के लिए पृथक सेवा लेन खुली हुई है वहाँ रियायतग्राही ऐसे स्थानीय यातायात से यदि वे चार लेन वाले राजमार्ग का उपयोग करना है तो फीस संग्रहीत करेगा ।
6. जब कभी किसी सेवा लेन का निर्माण हो जाता है तब रियायतग्राही ऐसी लेन के प्रयोक्ताओं से कोई फीस संग्रहीत नही करेगा ।
7. किसी ऐसे यांत्रिक यान से कोई फीस संग्रहीत नहीं की जाएगी जो उक्त सारणी में नहीं आते हैं।
8. रियायतग्राही, वाणिज्यिक प्रचालन की तारीख से कम से कम दस दिन पहले इस अधिसूचना का सार कम से कम दो स्थानीय समाचार पत्रों में (जिनमें से एक स्थानीय भाषा में होगा) प्रकाशित करेगा, जिसमें इस अधिसूचना के उपबन्धों के अनुसार वाणिज्यिक प्रचालन की तारीख का भी उल्लेख होगा और ऐसा सार, इस अधिसूचना के अनुसार पुनरीक्षित फीस को प्रभावी करने के लिए 10 दिन पहले भी पुनः प्रकाशित भी किया जाएगा ।
9. रियायतग्राही किसी अधिकारी को नामनिर्दिष्ट करेगा जो फीस संग्रहण का भार साधक होगा तथा रियायतग्राही और उक्त अधिकारी यह सुनिश्चित करने के लिए कि फीस का संग्रहण सहज रूप में करार की गई दरों से ऊंची दर पर सड़क उपयोक्ताओं को किया जाता है और उससे सम्बर्धित सभी विषयों के लिए भी, उत्तरदायी होंगे ।

10. फीस की दर, फीस के संदाय से छूट प्राप्त यानों के प्रवर्ग और रियायतग्राही का नाम, पता और टेलीफोन संख्या, जिसे शिकायत, यदि कोई हो, संबोधित की जानी चाहिए , पथकर बूथों से 500 मी. आगे , पथकर बूथों से 100 मी. आगे और पथकर बूथों पर भी सहजदृश्य रूप से और प्रमुख रूप से संप्रदर्शित की जाएगी और संप्रदर्शन बोर्ड की ऊंचाई और अक्षरों का आकार इस प्रकार का होगा कि चालकों के लिए संप्रदर्शन बोर्ड का पढ़ना आसान हो सकें ।
11. उपयोक्ताओं से प्रभारित की जाने वाली वास्तविक फीस की संगणना रियायतग्राही द्वारा की जाएगी और प्रतिवर्ष 31 मार्च के बाद किंतु पुनरीक्षित दर प्रभावी होने से कम से कम 45 दिन पहले, यथासम्भव शीघ्र विधिमान्यता के लिए प्राधिकरण को भेजी जाएगी । जिससे कि प्राधिकरण , उक्त प्रस्ताव की प्रप्ति की तारीख से 15 दिन की अवधि के भीतर कोई टीका टिप्पणियां कर सके या स्पष्टीकरण , यदि कोई हो , मांग सके और यदि प्राधिकरण इस अवधि के दौरान कोई टीका टिप्पणी नहीं करता है या स्प्ष्टीकरण नहीं मांगता है तो रियायतग्राही द्वारा यथा प्रस्तावित पुनरीक्षित फीस की प्राधिकरण द्वारा पुष्टि की गई मानी जाएगी ।

NOTIFICATION
New Delhi , the 26th October , 2009
S.O. 2687 ( E ) .- Whereas , vide notification of the Government of India in the erstwhile Ministry of Surface Transport ( Roads Wing) number S.O. 78 (E) , dated the 2nd February , 1999 , issued under section 11 of the National Highways Authority of India Act , 1988 (68 of 1988) , the Central Government entrusted the stretch from Km 122.000 to Km 417.000 ( Chennai- Dindigul section) of National Highway No. 45 in the State of Tamil Nadu to the National Highways Authority of India ( hereinafter referred to as the Authority) ;
And Whereas , pursuant to the powers conferred by section 14 of the said Act, the Authority has entered into an agreement with M / s Indu Navayuga Infra Projects Private Limited having its registered office at 1539 Avenue 1 , Street number 17, Banjara Hills , Hyderabad ( hereinafter referred to as the Concessionaire ) for design , engineering , construction , development , finance , operation and maintenance of the two lane section from Km 285.000 Km 325.000 to four lane ( Padalur - Trichy section ) of national highway number 45 in the State of Tamil Nadu ( hereinafter referred to as the said section) ;
Now, therefore , in exercise of the powers conferred by section 8A of the National Highways Act , 1956 (48 of 1956) , read with the National Highways (Collection of Fees by any Person for the Use of Section of National Highways / Permanent Bridge / Temporary Bridge on National Highways ) Rules , 1997, the Central Government , having regard to the expenditure involved in building , maintenance , management and operation of the said section , interest on the capital invested , reasonable return , the volume of traffic and the period of the agreement entered into between the Authority and the Concessionaire , hereby levies fee at the base rate specified in column (3) of the following Table , on the category of vehicles specified in column (2) thereof, for the use of the said section and authorises the Concessionaire to collect and retain the said fee on and from the date of commercial operation or publication of this notification in the Official Gazette , whichever is later , till the termination date , namely: - 7

SCHEDULE
The Concessionaire shall collect and retain the fee on the category of vehicles specified in column (2) of the Table below , for the use of the said section at the rate of base fee specified in column (3 ) of the said Table .
The fee shall be collected at the Toll Plaza at Km 304.510

1. For the purposes of this notification , -
(i) " actual fee" means the fee actually charged from the road users of the said section on the basis of-
(a) length of the project highway , (b) base fee given in the above Table duly indexed , and shall be rounded off to nearest five rupees ;
(ii) "date of commercial operation" means the date on which commercial operation of the said section begins after issue of the completion certificate or the provisional completion certification as the case may be , by the Independent Consultant , upon completion of the said section in accordance with the provisions of the agreement entered. into between the Authority and the Concessionaire ;
(iii) "local traffic" means the following type of traffic in relation to the fee payable for car/jeep/ van: -
(a) " Local Traffic" category I " means and includes users falling into any of the following categories : - 8

( 1) Residents of villages/ towns / cities whose boundary falls within a radius of ten kilometers of the fee collection booth (toll plaza) ;
(2) Establishments / Industrial units located within a radius of ten kilometers of the fee collection booth ( toll plaza) ;
(3) Employees of Establishments / Industrial units located or having their office , within a radius of ten kilometers of the fee collection booth ( toll plaza) ; and
(4) Self employed persons/ businessmen having their place of work within a radius of ten kilometers of the fee collection booth ( toll plaza) .
(b) " Local Traffic category II " means and includes local users falling into any of the following categories: -
( 1) Residents of villages/towns / cities whose boundary fall within a radius of more than ten kilometers but upto twenty kilometers of the fee collection booth ( toll plaza) ;
(2) Establishments/ Industrial units located within a radius of more than ten kilometers but upto twenty kilometers of the fee collection booth ( toll plaza) ;
(3) Employees of Establishments / Industrial units located or having their office , within a radius of more than ten kilometers but upto twenty kilometers of the fee collection booth (toll plaza) ; and
(4) Self employed persons/ businessmen having their place of work within a radius of more than ten kilometers but upto twenty kilometers of the fee collection booth (toll plaza) .
(iv) "termination date" means the date on which the agreement entered into between the Authority and the Concessionaire expires pursuant to the provisions of the said agreement or is terminated by termination notice;
(v) words and expressions used in this notification and not defined but defined in the agreement entered into between the Authority and the Concessionaire in respect of the said section shall have the same meaning as assigned to them respectively in the said agreement .
2. Actual amount of fee to be charged for a particular year and the revision thereof every year effective from 1st September shall be computed as follows : -

WPI -B = is the Wholesale Price Index available for the end of the preceding financial year .
WPI means the Whole Sale Price Index as released by the Office of the Economic Advisor , Ministry of Commerce and Industry , Government of India or any other index replacing the same.
3. - When the same vehicle has to cross the said section more than once in a day, the user shall have the option to pay the fee for multiple trips at one and half times the rate as given in the Schedule above while crossing the toll plaza in the first trip itself or if the vehicle has to use the said section continuously and frequently for the entire month or more , the vehicle owner may have a monthly pass on payment of charges equal to thirty times the rate applicable for a single trip as specified in the aforesaid Schedule .
Explanation: - For the purpose of this notification " day" shall be counted as continuous period of twenty- four hours .
4. No fee shall be charged or collected in respect of the following vehicles , namely: -
(1) Vehicles-
(A) having VIP symbols or officially belonging to-
(a) the President of India;
(b). the Vice- President of India;
(c) the Governor of a State and Lieutenant Governor of a Union territory;
(d) a Foreign dignitary on State visit to India;
(e) a Foreign Diplomat stationed in India using cars with " CD" / " CC" number plates;
(1) the Chairman of Rajya Sabha or Speaker of Lok Sabha or Chairman of a State Legislative Council or Speaker of a State Legislature Assembly or a Minister for the Union or State or Leader of Opposition in Lok Sabha or Rajya Sabha or State Legislatures having the Status of Cabinet Minister if he is sitting in the vehicle; or
(g) a Member of Parliament in the entire country or a Member of Legislative Assembly of a State or a Member of Legislative Council of a State , in the respective State if he produces his identity card issued by the Parliament or concerned Legislature of a State, as the case may be ;
(B) belonging to winner of gallantry awards such as Param Vir Chakra , Ashok Chakra, Maha Vir Chakra , Kirti Chakra, Vir Chakra and Shaurya Chakra, if such awardee produces his photo identity card duly authenticated by the competent authority for such award; 3851 9709-3 THE GAZETTE OF INDIA : EXTRAORDINARY

( ii) Defence vehicles , including those eligible for exemption in accordance with the provisions of the Indian Toll (Army and Air Force) Act, 1901 and the rules made there under ( as extended to Navy) ;
(iii) Police vehicles , Fire fighting vehicles , Ambulances , Funeral vans , Post and Telegraph Department's vehicles , Central and State Government vehicles on duty.
5. Concessionaire shall not collect fees from local traffic in the excess of the following discounted rate : -
(a) Car/ Jeep / Van:
Monthly pass of Rs 150.00
i) Local Traffic Category I :
Monthly pass of Rs 300.00 ;
ii) Local Traffic Category II :
(b) School Buses: Monthly passes for school buses , crossing the toll plaza may be given at a monthly rate of Rs 1000 / - (rupees one thousand) after obtaining written request of the school principal along with documents 'showing the recognition of the school and the registration of the bus.
(c) Light Commercial Vehicle or Trucks ( Local Transport Operators) : Concessional Fee may be given to the Local Transport Operators on production of proof for plying within twenty kilometers i.e. goods challan showing origin and destination clearly specifying the return details of the vehicle and the fee for such transport shall be Rs 25/ - (rupees twenty five) for trucks for each entry and Rs 15/ - ( rupees fifteen ) for Light Commercial Vehicle for each entry:
Provided, that if a separate service lane is opened for free use by local traffic , the Concessionaire shall collect the fee from such local traffic , if they use the four lane highway.
6. As and when a service lane is constructed , the Concessionaire shall not collect any fee from the users of such lane .
7. No fee shall be collected from a mechanical vehicle , which is not covered under the above Table .
8. The Concessionaire shall publish the substance of this notification in two local newspapers (one of which shall be in vernacular language) , which shall also state the date of commercial operation as per the provisions of this notification , at least ten days prior to the date of commercial operation and such substance shall also be repeated , ten days prior to giving effect to revised fees as per this notification.

9. The Concessionaire shall nominate an officer as in-charge of fee collection and the Concessionaire and the said officer shall be responsible to ensure that fees are collected at not more than the agreed rates and the fee collection is smooth without causing undue hardship to the road users and for all matters connected therewith .
10. The rate of fee , the categories of vehicles exempted from payment of fee and the name, address and telephone number of Concessionaire to whom complaints , if any , should be addressed , shall be conspicuously and prominently displayed 500 meters ahead of the toll booths , 100 meters ahead of the toll booths and at the toll booths also and the height of the display boards and size of letters being such that the driver can easily read the display boards.
11. The actual fee to be charged from users shall be computed by the Concessionaire and sent to the Authority for validation as soon as possible after 31st March , in every year , but at least forty- five days before the revised rate is to be effected so as to enable the Authority to provide any comments or seek clarifications , if any , within a period of fifteen days from the date of receipt of the said proposal and if the Authority does not offer comments or seek clarifications during this period, the revised fee , as proposed by the Concessionaire , shall be deemed to have been confirmed by the Authority.
