सा.का.नि. 786(अ).-राष्ट्रपति द्वारा राज्य पुनर्गठन अधिनियम, 1956 ( 1956 का 37 ) की धारा 51 की उप - धारा ( 2 ) के तहत किए गए निम्नलिखित आदेश को जैसा कि उस धारा के अधीन अपेक्षित है , एतद्वारा प्रकाशित किया जाता है , अर्थात्:-
मद्रास उच्च न्यायालय ( मदुरै में एक स्थायी पीठ की स्थापना ) संशोधन आदेश , 2009
राष्ट्रपति, साधारण खण्ड अधिनियम , 1897 ( 1897 का 10 ) की धारा 21 के साथ पठित राज्य पुनर्गठन अधिनियम , 1956 ( 1956 का 37) की धारा 51 की उप - धारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और तमिलनाडु के राज्यपाल तथा मद्रास उच्च न्यायालय के मुख्य न्यायाधीश से परामर्श करके , मद्रास उच्च न्यायालय ( मदुरै में स्थायी पीठ की स्थापना ) आदेश , 2004 में निम्नलिखित संशोधन करने का आदेश करते हैं, अर्थात्:-
( 1) ( 1 ) इस आदेश को मद्रास उच्च न्यायालय ( मदुरै में एक स्थायी पीठ की स्थापना ) संशोधन आदेश , 2009 कहा जाएगा ।
(2) यह सरकारी राजपत्र में इसके प्रकाशन की तारीख से प्रवृत होगा ।
2. मद्रास. उच्च न्यायालय ( मदुरै में स्थायी पीठ की स्थापना ) आदेश , 2004 के पैराग्राफ 2 में " नागपट्टिनम " और " पैराम्बलूर " शब्दों को हटाया जाएगा ।
3. इस आदेश के प्रवृत्त होने से पूर्व मद्रास उच्च न्यायालय की मदुरै पीठ में नागपट्टिनम और पैराम्बलूर जिले से संबंधित निस्तारण के लिए लम्बित पड़ी कोई अपील , उच्चतम न्यायालय में अपील करने की अनुमति के लिए आवेदन , पुनरीक्षा एवं अन्य कार्यवाही के लिए आवेदन को मद्रास उच्च न्यायालय की प्रधान सीट में अन्तरित माना जाएगा ।

New Delhi , the 26th October , 2009
G.S.R. 786 (E ) . The following Order made by the President under sub - section (2) of Section 51 of the States Reorganisation Act , 1956 (37 of 1956) is hereby published as required by that sub-section:-
The Madras High Court (Establishment of A Permanent Bench at Madurai) Amendment Order , 2009
Inexercise of the powers conferred by sub - section (2) of Section 51 ofthe States Reorganisation Act, 1956 (37 of 1956), read with Section 21 ofthe General Clauses Act, 1897 ( 10 of 1897), the President, after consultation with the Governor ofTamil Nadu and the Chief Justice ofthe Madras High Court, is pleased to make the following order to amend the Madras High Court (Establishment of a Permanent Bench at Madurai ) Order, 2004, namely:-
1. (1) This Order may be called the Madras High Court (Establishment of a Permanent Bench at Madurai ) Amendment Order, 2009 .
(2) It shall come into force on the date of its publication in the Official Gazette .
2. In the Madras High Court ( Establishment of a Permanent Bench at Madurai ) Order , 2004 , in paragraph 2 , the words "Nagapattinam " and " Perambalur " shall be omitted.
3.Any appeal , application for leave to appeal to the Supreme Court, application for review and other proceedings pertaining to the Districts of Nagapattinam and Perambalur pending for disposal in the Madurai Bench of the Madras High Court priorto commencement of this Order shall stand transferred to the principal seat of the Madras High Court .
