सा.का.नि. 790(अ). औषधि और प्रसाधन सामग्री नियम , 1945 का और संशोधन करने के लिए कतिपय नियमों का प्रारूप केंद्रीय सरकार ने औषधि तकनीकी सलाहकार बोर्ड के परामर्श के पश्चात्, औषधि और प्रसाधन सामग्री अधिनियम , 1940 ( 1940 का 23 ) की धारा 12 और धारा 33 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , प्रकाशित करती है और उक्त धारा की अपेक्षानुसार उन सभी व्यक्तियों की जानकारी के लिए जिनके उससे प्रभावित होने की संभावना है ; प्रकाशित किया जाता है और यह सूचना दी जाती है कि उक्त प्रारूप नियमों पर उस तारीख से जिसको भारत के उस राजपत्र की प्रतियां , जिसमें यह सूचना प्रकाशित की जाती है , जनता को उपलब्ध करा दी जाती हैं , पैंतालीस दिन की अवधि की समाप्ति के पश्चात् विचार किया जाएगा ;
आक्षेप और सुझाव , यदि कोई हो , सचिव , भारत सरकार , स्वास्थ्य और परिवार कल्याण मंत्रालय , भारत सरकार, निर्माण भवन , नई दिल्ली-110011 को भेजे जा सकेंगे ;
ऐसे किन्हीं आक्षेपों और सुझावों पर विनिर्दिष्ट अवधि के समाप्त होने से पूर्व उक्त प्रारूप नियमों की बाबत किसी व्यक्ति से प्राप्त होंगे , केंद्रीय सरकार द्वारा विचार किया जाएगा ।
प्रारूप नियम
1. ( 1 ) इन नियमों का संक्षिप्त नाम औषधि और प्रसाधन सामग्री ( पांचवां संशोधन ) नियम , 2009 है ।
(2) ये राजपत्र में अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. औषधि और प्रसाधन सामग्री नियम , 1945 की अनुसूची ज में, -
(क ) मद संख्यांक " 107 क्लोरोफिनिरामाइन मालेएट " का लोप किया जाएगा ;
(ख ) मद संख्यांक " 145 डेक्सट्रामेथोफेन हाइड्रोमाइड " का लोप किया जाएगा ।

NOTIFICATION
New Delhi, the 29th October, 2009
G.S.R. 790 (E ) . The following draft of certain rules further to amend the Drugs and Cosmetics Rules, 1945, which . the Central Government proposes to make , after consultation with the Drugs Technical Advisory Board, in exercise ofthe powers conferred by Section 12 and Section 33 ofthe Drugs and Cosmetics Act, 1940 (23 of 1940 ), is hereby published as required by the said Sections for the information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of a period offorty- five days from the date on which the copies ofthe Official Gazette in which this notification is published, are made available to the public ;
Objections or suggestions , if any, may be forwarded to the Secretary (Health), Ministry of Health and Family Welfare, Government of India, Nirman Bhavan, New Delhi - 110011 ;
Anyobjection or suggestion which may be received from any person with respect to the said draft rules before the expiry of the period as specified above shall be taken into consideration by the Central Government.
DRAFT RULES
1. (1) These rules may be called the Drugs and Cosmetics (5th Amendment) Rules, 2009.
(2) They shall come into force on the date of their final publication in the Official Gazette.
2. In the Drugs and Cosmetics Rules, 1945 , in Schedule H,-
(a) The entry " 107. Chlorpheniramine Maleate " shall be omitted ;
(b) the entry " 145. Dextromethorphan Hydrobromide " shall be omitted.
