का.आ. 2786 (अ).-जबकि केन्द्र सरकार ने इराक में बिगड़ती सुरक्षा परिस्थिति और नागरिक उत्तेजना और राजनैतिक अशान्ति को देखते हुए , भारत सरकार के प्रवासी भारतीय कार्य मंत्रालय की दिनांक 1 मई , 2007 की अधिसूचना सं. का.आ. 690 ( अ ) के प्रकाशन की तारीख से छः माह की अवधि के लिए भारतीय नागरिकों को इराक जाने के लिए प्रतिबंध लगाया हुआ है;
और जबकि उक्त प्रतिबंध को दिनांक 1 नवम्बर , 2007 की अधिसूचना संख्या का.आ. 1858 ( अ ) , 1 मई, 2008 की अधिसूचना सं. का.आ. 1058(अ ) , 3 नवम्बर , 2008 की अधिसूचना सं. का. आ. 2591 ( अ) और 1 मई , 2009 की अधिसूचना सं. का. आ. 1076 (अ ) द्वारा छः-छः महीने की अवधि के लिए तीन बार बढ़ाया गया था;
और जबकि, केन्द्र सरकार मानती है कि अभी भी ऐसी स्थिति है , जिसमें भारतीय नागरिकों को इराक जाने के लिए उत्प्रवास पर छः माह की और अवधि के लिए रोक को जारी रखने की आवश्यकता है;
अब इसलिए, उत्प्रवांस अधिनियम , 1983 ( 1983 का 31 ) की धारा 31 की उप - धारा ( 1 ) के साथ पठित उप - धारा (2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्र सरकार, एतद्वारा भारतीय नागरिकों को इराक जाने के लिए उत्प्रवास पर इस अधिसूचना के प्रकाशन की तारीख से छः माह की और अवधि के लिए रोक लगाती है ।

टिप्पणी : - इराक जाने वाले भारतीय नागरिकों पर रोक लगाने वाली मूल अधिसूचना संख्या का.आ. 690 ( अ ) , दिनांक 1 मई , 2007 के भारत के राजपत्र , असाधारण में प्रकाशित हुई थी जिसे समय - समय पर दिनांक 1 नवम्बर , 2007 की अधिसूचना संख्या का.आ. 1858 ( अ ) ; 1 मई , 2008 की अधिसूचना संख्या का.आ. 1068( अ) और 3 नवम्बर , 2008 की अधिसूचना संख्या का. आ. 2591 ( अ) और 1 मई , 2009 की अधिसूचना संख्या का.आ. 1076 (अ ) द्वारा बढ़ाया गया था ।

NOTIFICATION
NewDelhi , the 1st November , 2009
S.O. 2786 ( E). Whereas the Central Government, in view of the deteriorating security situation and prevailing civil commotion and political disturbances in Iraq has prohibited emigration of Indian Citizens going to Iraq for a period of six months with effect from the 1st day of May, 2007, vide notification of the Government of India in the Ministry of Overseas Indian Affairs , number S.O. 690 (E) of the same date;
Andwhereas, the said prohibition was further extended four times for a period of six months each vide notifications number S.O. 1858 ( E), dated the 1st November, 2007 , S.O. 1068 ( E), dated the 1st May, 2008 and S.O. 2591 (E), dated the 3rd November, 2008 and S.O. 1076 (E) , dated 1st May , 2009;
And whereas , the Central Government considers that the situation still exist which necessitate the continuance of the prohibition of emigration of Indian Citizens going to Iraq for further period of six months ;
Now, therefore , in exercise of the powers conferred by sub - section ( 1 ) read with the proviso to sub- section (2) of section 31 of the Emigration Act , 1983 ( 31 of 1983 ) , the Central Government hereby extends the said prohibition ofemigration of Indian Citizens going to Iraq for a further period of six months with effect from the date ofpublication of this notification.

Note: The principal notification prohibiting emigration of Indian Citizens going to Iraq was published in the Gazette of India, Extraordinary vide number S.O. 690 (E) , dated the 1st May, 2007 which was extended from time to time vide notifications number S.O. 1858 (F) , dated the 1st November , 2007, S.O. 1068 (E) , dated the 1st May, 2008 and S.O. 2591 (E), dated the 3rd November , 2008 and S.O. 1076(E), dated 1st May, 2009.
