सं. टीएएमपी/45/2005-केओपीटी. महापत्तन न्यास अधिनियम, 1963 ( 1963 का 38वां ) की धारा 48 , 49 और 50 के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, महापत्तन प्रशुल्क प्राधिकरण एतद्वारा , कोलकत्ता पत्तन न्यास के प्रचालित दरमान की वैद्यता को संलग्न आदेशानुसार , 30 सितम्बर , 2009 के परे विस्तारित करता है ।

इस प्राधिकरण ने अपने दरमान के सामान्य संशोधन के लिए कोलकाता पत्तन न्यास ( केओपीटी ) से प्राप्त प्रस्ताव को निपटाते हुए, 29 दिसम्बर , 2006 को एक आदेश पारित किया था । इस आदेश को 6 फरवरी , 2007 को भारत का राजपत्र , असाधारण ( भाग- III , खण्ड-4 ) में राजपत्र संख्या 34 के द्वारा अधिसूचित किया गया था । 31 मार्च , 2009 तक की वैद्यता अवधि वाले आदेश की अधिसूचना के 30 दिन बीत जाने के बाद , संशोधित दरमान 8 मार्च , 2007 को प्रभाव में आया है ।
2. केओपीटी के अनुरोध पर , इस प्राधिकरण ने दिनांक 27 मार्च , 2009 के आदेश द्वारा , प्रचलित दरंमान की वैद्यता को, 1 अप्रैल , 2009 के बाद वाली अवधि में स्वीकार लागत और अनुमय

प्रतिलाभ से अधिक प्रोद्भूत अधिशेष को अगले चक्र ( दौर ) के लिए तय किए जाने वाले प्रशुल्क में समायोजित किए जाने की शर्त पर विस्तार प्रदान किया था । पंसन को सामान्य संशोधन के लिए अपना प्रस्ताव 30 जून , 2009 तक प्रस्तुत करने का निदेश दिया गया था ।
3. दिनांक 2 सितम्बर , 2009 के अपने पत्र के द्वारा पत्तन ने इस प्राधिकरण से प्रस्ताव प्रस्तुत करने के लिए 31 दिसम्बर, 2009 तक का समय प्रदान करने और इसके प्रचलित दरमान की वैद्यता को, अध्यक्ष के पद के नियमित पदधारी की अनुपस्थिति और केओपीटी के कोलकाता और हल्दिया स्थित भूमि और भवनों के किराये की अनुसूची के संशोधन हेतु प्रस्ताओं से , जो प्रस्तुत किए जाने की अंतिम अवस्था मेंहै , राजस्व प्रभाव को हासिल करने की आवश्यकता के आधार पर, यथोचित रूप से विस्तारित करने का अनुरोध किया है।
4. पत्तन की प्रस्तुतियों पर विचार करते हुए , यह प्राधिकरण केओपीटी के अनुरोध को स्वीकार करता है और उसके दरमान के सामान्य संशोधन के लिए प्रस्ताव दाखिल करने हेतु 31 दिसम्बर , 2009 तक का समय प्रदान करता है । परिणामस्वरूप , केओपीटी के प्रचलित दरमान की वैद्यता 31 मार्च, 2010 तक विस्तारित की जाती है । यह शर्त है कि 1 अप्रैल , 2009 के बाद की अवधि स्वीकार्य ( ग्राह्य ) लागत तथा अनुमय प्रतिलाभ से अधिक, केओपीटी को प्रोद्भूत अधिशेष अगले चक्रं ( दौर ) के लिए तय किये जाने वाले प्रशुल्क में समायोजित किया जाएगा , अपरिवर्तित रहेगी ।.

NOTIFICATION
Mumbai , the 30th October , 2009
No. TAMP/45/ 2005 - ΚΟΡT.-In exercise of the powers conferred by Sections 48 , 49 and 50 of the Major Port Trusts Act, 1963.(38 of 1963), the Tariff Authority for Major Ports hereby extends the validity of the existing Scale of Rates at Kolkata Port Trust beyond 30th September , 2009, as in the Order appended hereto.

This Authority had passed an Order on 29thDecember , 2006 disposing of the proposal from the Kolkata Port Trust ( KOPT) for general revision of its Scale ofRates (SOR). This Order was notified in the Gazette of India on 6th February, 2007 vide Gazette No. 34. The revised Scale of Rates has come into effect from 8th March , 2007 after expiry of 30 days from the notification of the Orderwith a validity period upto 31st March, 2009.
2. At the request of the KOPT, this Authority vide Orderdated 27th March , 2009 has extended the validity of its existing Scale ofRates (SOR) till 30th September, 2009

subject to the setting off the surplus over and above the admissible cost and permissible return accruing for the period after Ist April , 2009 in the tariff to be fixed for the next cycle . The port was directed to submit its proposal for general revision by 30th June , 2009. Subsequently , at the request of the port time for submission of its proposal was extended till 31 August, 2009.
3. The port vide its letter dated 2nd September , 2009 , has requested this Authority to grant time till 31stDecember , 2009 for submission of the proposal and to extend the validity of its existing SOR suitably on the grounds of absence of regular incumbent to the post of its Chairman and the need to capture revenue impact from the proposals for revision of the rent schedule of land & building of KOPT at Kolkata and Haldia which are under final stage for submission .
4. Considering the submissions of the port , this Authority is inclined to accede to the request of the KOPT and grant time till 31st December , 2009 to file its proposal for general revision of its Scale of Rates . Consequently, the validity of the existing Scale of Rates of the KOPT is extended till 31st March , 2010. The condition that the sur- plus over and above the admissible cost and permissible return accruingto the KOPT after 1st April , 2009 willbe fully adjusted in the tariff to be fixed for the next cycle stipulated in the Order dated 27th March , 2009 remains unaltered.
