सा.का.नि. 796(अ). साधारण श्रेणीकरण और चिन्हांकन ( संशोधन ) नियम , 2009 का प्रारूप नियम , कृषि उपज ( श्रेणीकरण और चिन्हांकन ) अधिनियम , 1937 (-1937 का 1 ) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भारत सरकार , भारत के राजपत्र, भाग II , खंड 3 , उप- खंड ( i ) में अधिसूचना सं. सा.का.नि. 400 ( अ ) , तारीख 3 जून , 2009 द्वारा प्रकाशित किया गया था , उन सभी व्यक्तियों से, जिनके उनसे प्रभावित होने की संभावना थी उस तारीख से , जिसको उक्त अधिसूचना की प्रतियां जनता को उपलब्ध करा दी गयी थीं, पैंतालीस दिन के भीतर आक्षेप और सुझाव आमंत्रित किए गए थे ;
और उक्त अधिसूचना की प्रतियां 12 जून , 2009 को जनता को उपलब्ध करा दी गई थी और उक्त प्रारूप नियमों की बाबत जनता से प्राप्त आक्षेपों और सुझावों पर सम्यक् रूप से विचार कर लिया गया है ।
अतः , अब , केन्द्रीय सरकार कृषि उत्पाद ( श्रेणीकरण और चिह्नांकन ) अधिनियम , 1937 की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए निम्नलिखित नियम बनाती है , अर्थात्:-
नियम
( 1 ) इन नियमों का संक्षिप्त नाम साधारण श्रेणीकरण और चिह्नांकन (संशोधन ) नियम , 2009 है ।
(2) साधारण श्रेणीकरण और चिह्नांकन नियम, 1988 के नियम 2 के खंड ( ध ) का लोप किया जाएगा ।.

टिप्पण : मूल नियम भारत के राजपत्र , भाग II , खंड 3 , उप- खंड ( i ) तारीख 17 जून , 1989 में प्रकाशित किए गए थे और तत्पश्चात्, उनमें संख्यांक सा.का.नि. 621 , तारीख 11 अक्तूबर , 1991 और संख्यांक सा.का. नि. 598 ( अ ) तारीख 11 अगस्त, 2008 द्वारा संशोधन किए गए ।

NOTIFICATION
New Delhi , the 30th October, 2009
G.S.R. 796(E ) . Whereas the draft of General Grading and Marking (Amendment) Rules , 2009 , in exercise of the powers conferred by Section 3 of the Agriculture Produce (Grading and Marking) Act, 1937 ( 1 of 1937) was published vide notification vide G.S.R. 400 (E) dated 3rd June, 2009 in the Gazette of India , Part II, Section 3 , Sub- section ( i) inviting objections and suggestions from all persons likely to be affected thereby within forty five days from the date on which copies ofthe said notification published in the Gazette of India were made available to the public .
Andwhereas copies of the said notification were made available to the public on 12th June , 2009. And whereas the objections and suggestions received from the public in respect of the said draft rules have been duly considered.
Now, therefore, in exercise of the powers conferred by Section 3 of the Agricultural Produce (Grading and Marking) Act, 1937, the Central Government hereby makes the following rules , namely
RULES
(1) These rules may be called the General Grading and Marking (Amendment) Rules , 2009 .
(2) In rule 2 of the General Grading and Marking Rules , 1988 clause( s) shall be omitted .
