का.आ. 2846(अ).-भारत सरकार ने पेट्रोलियम और खनिज पाइपलाइन ( भूमि में उपयोग के अधिकार का अर्जन ) अधिनियम , 1962 ( 1962 का 50 ) ( जिसे इसके पश्चात् उक्त अधिनियम कहा गया है ) की धारा 3 की उप - धारा ( 1 ) के अधीन जारी भारत सरकार के पेट्रोलियम और प्राकृतिक गैस मंत्रालय की अधिसूचना संख्या का.आ. 2749( अ ) , तारीख 26 नवम्बर , 2008 द्वारा , उस अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट भूमि में मैसर्स रिलायंस इंडस्ट्रीज लिमिटेड की आन्ध्र प्रदेश में संरचनाओं से देश केविभिन्ना हिस्सों में स्थित उपभोक्ताओं तक प्राकृतिक गैस के परिवहन के लिए मैसर्स रिलाएंस गैस ट्रांसपोर्टेशन इन्फ्रास्ट्रक्चर लिमिटेड द्वारा एक पाइपलाइन बिछाने के प्रयोजन के लिए उपयोग के अधिकार का अर्जन करने के अपने आशय की घोषणा की थी;
और, उक्त राजपत्र की प्रतियाँ जनता को तारीख 15 दिसम्बर, 2008 को अथवा उससे पूर्व उपलब्ध करा दी गई थीं ;
और, पाइपलाइन बिछाने के सम्बन्ध में जनता की ओर से कोई आक्षेप प्राप्त नहीं हुआ है ;
और, सक्षम प्राधिकारी ने, उक्त अधिनियम की धारा 6 की उप - धारा ( 1 ) के अधीन भारत सरकार को अपनी रिपोर्ट दे दी है ;
और, भारत सरकार ने , उक्त रिपोर्ट पर विचार करने के पश्चात् और यह संतुष्ट हो जाने पर कि उक्त भूमि पाइपलाइनें बिछाने के लिए अपेक्षित है, उसमें उपयोग के अधिकार का अर्जन करने का विनिश्चय किया है;
अतः , अब , भारत सरकार, उक्त अधिनियम की धारा 6 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , यह घोषणा करती है कि इस अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट भूमि में पाइपलाइनें बिछाने के लिए उपयोग के अधिकार का अर्जन किया जाताहै;
और , भारत सरकार, उक्त अधिनियम की धारा 6 की उप - धारा ( 4 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निर्देश देती है कि उक्त भूमि में उपयोग का अधिकार इस घेषणा के प्रकाशन की तारीख से भारत सरकार में निहित होने के बजाए, सभी विल्लंगमों से मुक्त, मैसर्स रिलायंस गैस ट्रान्सपोर्टेशन इन्फ्रास्ट्रक्चर लिमिटेड में निहित होगा ।

NOTIFICATION
New Delhi , the 4th November , 2009
S.O. 2846 (E) . Whereas by notification of Government of India in Ministry of Petroleum and Natural Gas , number S.O. 2749 (E ) dated the 26th November 2008 , issued under sub - section (1) of Section 3 of the Petroleum & Minerals Pipelines ( Acquisition of Right of User in Land) Act, 1962 (50 of 1962 ) ( hereinafter referred to as the said Act) , Government of India declared its intention to acquire the Right of User in the land, specified in the Schedule appended to that notification for the purpose of laying pipeline for transportation of natural gas from the structures in Andhra Pradesh of M/ s Reliance Industries Limited by M/ s Reliance Gas Transportation Infrastructure Limited to the consumers in various parts of the country ;
And whereas, the copies of the said Gazette notification were made available to the public on or before 15th December, 2008:
And whereas , no objections were received from the public to the laying of the pipeline ;
And whereas , the Competent Authority has under sub - section ( 1 ) of Section 6 ofthe said Act, submitted report to the Government of India ;
And whereas , Government of India after considering the said report and on being satisfied that the said land is required for laying the pipeline , has decided to acquire the Right of User therein;

Section 6 of the Now, therefore, in exercise of the powers conferred by sub-section (1 ) of said Act, Government of India hereby declares that the Right of User in the land, specified in the Schedule , appended to this notification, is hereby acquired, for laying the pipeline;
And further, in exercise of the powers conferred by sub- section (4) of Section 6 of the said Act, Government of India hereby directs that the Right of User in the said land for laying the pipeline shall, instead of vesting in Government of India vest, on this date of publication of the declaration, in M/ s Reliance Gas Transportation Infrastructure Limited, free from all encumbrances .

का.आ. 2847(अ).-भारत सरकार ने पेट्रोलियम और खनिज पाइपलाइन (भूमि में उपयोग के अधिकार का अर्जन ) , अधिनियम 1962 (1962 का 50 ) (जिसे इसके पश्चात् उक्त अधिनियम कहा गया है) की धारा 3 की उपधारा (1 ) के अधीन जारी की गई भारत सरकार के पेट्रोलियम और प्राकृतिक गैस मंत्रालय की अधिसूचना संख्या का.आ. 2181 (अ) तारीख 21 अगस्त, 2009 द्वारा उस अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट भूमि में , मैसर्स रिलायंस इंडस्ट्रीज लिमिटेड की आन्ध्रप्रदेश में संरचनाओं से देश के विभिन्न हिस्सों में स्थित उपभोक्ताओं तक प्राकृतिक गैस के परिवहन के लिए मैसर्स रिलायंस गैस ट्रान्सपोर्टेशन इन्फ्रास्ट्रक्चर लिमिटेड द्वारा एक पाइपलाइन बिछाने के प्रयोजन के लिए उपयोग के अधिकार का अर्जन के लिए अपने आशय की घोषणा की थी;
और , उक्त राजपत्र की प्रतियाँ जनता को तारीख 7 सितम्बर , 2009 को अथवा उससे पूर्व उपलब्ध करा दी गई थीं;
और, पाइपलाइन बिछाने के सम्बन्ध में जनता की ओर से कोई आक्षेप प्राप्त नहीं हुआ है;
और, सक्षम प्राधिकारी ने उक्त अधिनियम की धारा 6 की उपधारा ( 1 ) के अधीन भारत सरकार को अपनी रिपोर्ट दे दी है;
और, भारत सरकार ने , उक्त रिपोर्ट पर विचार करने के पश्चात्, और यह समाधान हो जाने पर कि उक्त भूमि पाइपलाइन विछाने के लिए अपेक्षित है , उसमें उपयोग के अधिकार का अर्जन का विनिश्चय किया है;
अतः अव, भारत सरकार , उक्त अधिनियम की धारा 6 की उपधारा (1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए यह घोषणा करती है कि इस अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट भूमि में पाइपलाइन बिछाने के लिए उपयोग के अधिकार का अर्जन किया जाता है;
और, भारत सरकार उक्त अधिनियम की धारा 6 की उपधारा (4 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए यह निर्देश देती है कि उक्त भूमि में उपयोग का अधिकार इस घोषणा के प्रकाशन की तारीख से भारत सरकार में निहित होने के वजाए , सभी विल्लंगमों से मुक्त, मैसर्स ग्लिायंस गैस ट्रान्सपोर्टेशन इन्फ्रास्ट्रक्चर लिमिटेड , में निहित होगा ।

NOTIFICATION
New Delhi , the 4th November, 2009
S.O. 2847 (E ) . Whereas by notification of Government of India in Ministry of Petroleum and Natural Gas, number S.O. 2181 ( E) dated the 21st August, 2009 , issued under sub - section ( 1 ) of Section 3 of the Petroleum & Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962) (hereinafter referred to as the said Act) , Government of India declared its intention to acquire the Right of User in the land, specified in the Schedule appended to that notification for the purpose of laying pipeline for transportation of natural gas from the structures in Andhra Pradesh of M/s Reliance Industries Limited by M/s Reliance Gas Transportation Infrastructure Limited to the consumers in various parts of the country;

And whereas , no objections were received from the public to the laying of the pipeline;

And whereas , Government of India after considering the said report and on being satisfied that the said land is required for laying the pipeline , has decided to acquire the Right of User therein;
Section 6 of the Now, therefore , in exercise of the powers conferred by sub - section ( 1 ) of said Act, Government of India hereby declares that the Right of User in the land, specified in the Schedule, appended to this notification, is hereby acquired, for laying the pipeline;
And further , in exercise of the powers conferred by sub- section (4) of Section 6 of the said Act, Government of India hereby directs that the Right of User in the said land for laying the pipeline shall , instead of vesting in Government of India vest, on this date of publication of the declaration, in M/s Reliance Gas Transportation Infrastructure Limited, free from all encumbrances .
