सा.का.नि. 800(अ).-केन्द्र सरकार, महापत्तन न्यास अधिनियम, 1963 ( 1963 का 38 ) की धारा 132 की उप - धारा ( 1 ) के साथ पठित धारा 124 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , नव मंगलूर पत्तन न्यास के न्यासी मंडल द्वारा बनाए गए और इस अधिसूचना के साथ संलग्न अनुसूची में दिए गए नव मंगलूर पत्तन न्यास कर्मचारी (निवृत्ति ) संशोधन विनियम, 2009 को अनुमोदित करती है ।.
2. उक्त संशोधन विनियम 30 सितम्बर , 2007 से प्रवृत्त होंगे ।
अनुसूची
नव मंगलूर पत्तन न्यास कर्मचारी ( निवृत्ति ) तृतीय संशोधन विनियम, 2009
महापत्तन न्यास अधिनियम, 1963 ( 1963 का 38 ) की धारा 28 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , नव मंगलूर पत्तन न्यास का न्यासी मंडल नव मंगलूर पत्तन न्यास कर्मचारी ( निवृत्ति ) विनियम , 1980, में पुनः संशोधन करते हुए , निम्नलिखित विनियम बनाता है , अर्थात्:-
1. इन विनियमों को नव मंगलूर पत्तन न्यास कर्मचारी ( निवृत्ति ) तृतीय संशोधन विनियम , 2009 कहा जाएगा ।
2. वर्तमान के नव मंगलूर पत्तन न्यास कर्मचारी (निवृत्ति) विनियम , 1980 , में वर्तमान विनियम 3 की जगह निम्नलिखित विनियम प्रतिस्थापित होंगे , अर्थात्:
" 3. निवृत्ति आयु. इस विनियम में जब तक अन्य कोई प्रावधान न हो , पत्तन के प्रत्येक कर्मचारी अपनी साठ वर्ष आयु पूरा होने के माह के आखिरी दिन अपराह्न सेवा से निवृत्त होगा :
बशर्ते कि पत्तन का कोई कर्मचारी जिसकी जन्म तिथि किसी महीने की पहली तारीख हो , वह अपनी साठ वर्ष आयु पूरा होने के माह के पूर्ववर्ती माह के आखिरी दिन अपराह्न पत्तन की सेवा से निवृत्त होगा । "

NOTIFICATION
New Delhi , the 7th November , 2009
G.S.R. 800(E) . In exercise of the powers conferred by sub - section ( 1 ) of Section 124 , read with sub - section ( 1 ) ofSection 132 ofthe Major Port Trusts Act, 1963 (38 of 1963) , the Central Government hereby approves the New Mangalore PortTrust Employees (Retirement) Amendment Regulations , 2009 made by the Board of Trustees for the Port of New Mangalore and set out in the Schedule annexed to this Notification .
2. The said Amendment Regulations shall be deemed to have come into force on the 30th September, 2007.
SCHEDULE
New Mangalore Port Trust Employees (Retirement ) Third Amendment Regulations , 2009
In exercise ofthe powers conferred by Section 28 of the Major Port Trusts Act, 1963 ( 38 of 1963 ) , the Board of Trustees of the New Mangalore Port Trust hereby makes the following regulations further to amend the New Mangalore PortTrust Employees ( Retirement) Regulations , 1980 namely :-
1. These Regulations may be called the New Mangalore Port Trust Employees (Retirement) Amendment Regulations , 2009 .
2. In the New Mangalore Port Trust Employees ( Retirement ) Regulations , 1980 for regulation 3 , the following regulation shall be substituted , namely :-
"3. Age of Retirement . Except as otherwise provided in these regulations, every employee of the Board shall retire from service on the afternoon of the last day of the month in which he attains the age of sixty years :
:
Provided that an employee of the Board whose date of birth is the first of a month , shall retire from the service of the Board on the afternoon of the last day of the preceding month in which he attains the age of sixty years . "
