सा.का.नि. 801(अ).-केन्द्र सरकार, महापत्तन न्यास अधिनियम, 1963 ( 1963 का 38 ) की धारा 132 की उप- धारा ( 1 ) के साथ पठित धारा 124 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए मुरगांव पत्तन के न्यासी मण्डल द्वारा बनाए गए और इस अधिसूचना के साथ संलग्न अनुसूची में मुरगांव पत्तन न्यास कर्मचारी ( अधिवर्षिता तथा सेवानिवृत्ति की आयु ) ) संशोधन विनियम , 2009 का अनुमोदन करती है ।
2. उक्त संशोधित विनियम दिनांक 30 सितम्बर , 2007 से प्रभावी होंगे ।

मुरगांव पत्तन कर्मचारी ( अधिवर्षिता और सेवानिवृत्ति की आयु ) संशोधन विनियम , 2009
महापत्तन न्यास अधिनियम, 1963 ( 1963 का 38 ) की धारा 124 की उप- धारा ( 1 ) तथा ( 2 ) के साथ पठित धारा 28 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए मुरगांव पत्तन न्यास के न्यासी मंडल, मुरगांव पत्तन कर्मचारी ( अधिवर्षिता और सेवानिवृत्ति की आयु ) विनियम , 1974 में और संशोधन करने हेतु निम्नलिखित विनियम बनाता है , यथाः-
1. ( क) इन विनियमों के महापत्तन कर्मचारी ( अधिवर्षिता और सेवानिवृत्ति की आयु ) संशोधन विनियम, 2009 कंहा जाएगा ।
(ख ) ये विनियम दिनांक 30 सितम्बर , 2007 से प्रभावी होंगे ।
2. मुरगांव पत्तन कर्मचारी ( अधिवर्षिता और सेवानिवृत्ति की आयु) विनियम, 1974 के विनियम 4 को निम्नलिखित विनियम से प्रतिस्थापित किया जाएगा , यथा-
4. सेवानिवृत्ति आयु को शासित करने वाला नियम:
इन विनियमों के किसी अन्य उपबन्ध को छोड़कर मंडल का प्रत्येक कर्मचारी साठ वर्ष की आयु प्राप्त करने वाले माह के अंतिम दिन के उपराह्न से सेवानिवृत्त होगा :

बशर्ते कि मंडल कर्मचारी जिसकी जन्म तिथि माह की पहली तारीख है , वह साठ वर्ष प्राप्त करने वाले माह के पूर्ववर्ती माह के अंतिम दिन के अपराहन से मंडल सेवा से निवृत्त होगा ।
टिप्पणी : वह तारीख, जब कोई कर्मचारी 60 वर्ष की आयु प्राप्त करता है , का निर्धारण कर्मचारी द्वारा नियुक्ति के समय घोषित जन्म तारीख तथा जहां तक संभव हो अभिपुष्ट दस्तावेजी साक्ष्य जैसे कि मैट्रिक प्रमाणपत्र या जन्म पंजी के उद्धहरण प्रस्तुत करने पर यथोचित प्राधिकारी द्वारा स्वीकार किए जाने के बाद ही किया जाएगा । इस प्रकार किसी कर्मचारी द्वारा घोषित तथा यथोचित प्राधिकारी द्वारा स्वीकार जन्म की उसकी सेवा पुस्तिका तैयार करने के बाद अथवा किसी भी हालत में परिवीक्षा अवधि की समाप्ति अथवा विधिवत घोषित किए जाने के बाद , जो भी पहले हो बदला नहीं जाएगा। किसी कर्मचारी की जन्म तारीख में बाद में कोई परिवर्तन मात्र सक्षम प्राधिकारी की मंजूरी के बाद ही किया जा सकता है , यदि यह स्थापित हो जाए कि सेवा पुस्तिका में जन्म तारीख दर्ज करने में वास्तव में लिपिकीय त्रुटि हुई है ।

G.S.R.. 801 (E ) . In exercise of the powers conferred by sub - section (1 ) of Section 124 , read with sub- section( 1) ofsection 132 of the Major Port Trusts Act , 1963 (38 of 1963 ), the Central Government hereby approves the Mormugao Port Employees' ( Superannuation and Age of Retirement ) Amendment Regulations , 2009 made by the Board ofTrustees for the PortofMormugao and set out in the Schedule annexed to this Notification.
2. The said Amendment Regulations shall be deemed to have come into force on the 30th September, 2007 .

SCHEDULE
Mormugao Port Employees' ( Superannuation and Age of Retirement) Amendment Regulations , 2009 In exercise of the powers conferred by section 28 read with section 124 ( 1 ) and (2) of the Major Port Trusts Act, 1963 (38 of 1963 ), the Board of Trustees of the Mormugao Port Trust hereby makes the following regulations further to amend the Mormugao Port Employees ' ( Superannuation and Age of Retirement) Regulations , 1974 namely :-

1. (a) These Regulations may be called the Mormugao Port Employees ' (Superannuation and Age of Retirement ) Amendment Regulations , 2009 .
(b) They shall come into force from 30th September, 2007 .
2. In theMormugao Port Employees ' ( Superannuation and Age of Retirement) Regulations, 1974 for regulation 4, the following regulation shall be substituted , namely :-
4. Principle Governing Age of Retirement :
Except as otherwise provided in these regulations , every employee of the Board shall retire from service on the afternoon of the last day of the month in which he attains the age of sixty years:
Provided that an employee of the Board whose date of birth is the first of a month , shall retire from the service of the Board on the afternoon of the last day of the preceding month in which he attains the age of sixty years .
Note : The date on which an employee attains the age of 60 years shall be determined with reference to the date of birth declared by the employee at the time of his appointment and accepted by the appropriate authority on production, as far as possible , of confirmatory documentary evidence such as Matriculation Certificate or extracts from Birth Register. The date of birth so declared by an employee and accepted by the appropriate authority shall not be subject to any alteration after the preparation ofhis Service Book and in any event, after the completion of probation period or declaration of quasi- permanency, whichever is earlier . An alteration in the date ofbirth ofan employee can be made at a later stage only with the sanction of a competent authority, if it is established that a bona fide clerical mistake has been committed in recording the date of birth in the Service Book.
