सा.का.नि. 803(अ). केन्द्रीय सरकार, नागरिकता अधिनियम , 1955 ( 1955 का 57) की धारा 18 की उप- धारा ( 1 ) और उप - धारा ( 3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , नागरिकता ( नागरिकों का रजिस्ट्रीकरण और राष्ट्रीय पहचान पत्रों का जारी किया जाना ) नियम , 2003 में निम्नलिखित संशोधन करती है, अर्थात्:-
1. ( 1) इन नियमों का संक्षिप्त नाम नागरिकता ( नागरिकों का रजिस्ट्रीकरण और राष्ट्रीय पहचान पत्रों का जारी किया जाना ) संशोधन नियम , 2009 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. नागरिकता ( नागरिकों का रजिस्ट्रीकरण और राष्ट्रीय पहचान पत्रों का जारी किया जाना ) नियम, 2003 (जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है ) के नियम 2 के खण्ड (ड ) के पश्चात् निम्नलिखित खण्ड अंतःस्थापित किया जाएगा , अर्थात्: -
'(डक) " अनुसूची " से इन नियमों से उपाबद्ध अनुसूची अभिप्रेत है; ' ।
3. उक्त नियमों के नियम 4 के पश्चात्, निम्नलिखित नियम अंतःस्थापित किया जाएगा , अर्थात् " 4क. असम राज्य में भारतीय नागरिकों के राष्ट्रीय रजिस्टर के संबंध में विशेष उपबंध (1) नियम 4 में किसी बात के होते हुए भी नागरिकता ( नागरिकों का रजिस्ट्रीकरण और राष्ट्रीय पहचान पत्रों का जारी किया जाना ) संशोधन नियम, 2009 के प्रारंभ होने पर और उसके पश्चात् असम राज्य को लागू होंगे ।
( 2 ) केन्द्रीय सरकार, असम राज्य में भारतीय नागरिकों के राष्ट्रीय रजिस्टर के प्रयोजनों के लिए, असम राज्य के भारतीय नागरिकों के राष्ट्रीय को तैयार करने के लिए, सभी निवासियों से , प्रत्येक कुटुंब और व्यक्तिके संबंध में विनिर्दिष्ट विशिष्टियों के संग्रहण के लिए, राज्य में स्थानीय क्षेत्रों के निवासियों से जिसके अंतर्गत नागरिकों का राष्ट्रीय रजिस्टर 1951 और 1971 से पूर्व निर्वाचक सूची के आधार पर नागरिकता का प्रास्थिति भी सम्मिलित होगी , संपूर्ण असम राज्य से आवेदन प्ररूप आमंत्रित करेगी ।

(3) अधिसूचित करेगा । नागरिक रजिस्ट्रीकरण के महारजिस्ट्रार राजपत्र में प्रगणन की अवधि और उसकी कालावधि
(4) असम राज्य में भारतीय नागरिकों के राष्ट्रीय रजिस्टर को तैयार करने की रीति इन नियमों से उपाबद्ध अनुसूची में यथाविनिर्दिष्ट अनुसार होगी । "
4. उक्त नियम के नियम 18 के पश्चात्, निम्नलिखित अनुसूची अंतःस्थापित की जाएगी, अर्थात् : -

असम राज्य में भारतीय नागरिकों के राष्ट्रीय रजिस्टर को तैयार करने की रीति के विशेष उपबंध
1. परिभाषाएं-- (1 ) इस अनुसूची में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हों,
(क) "नागरिकों का राष्ट्रीय रजिस्टर, 1951 " , से असम राज्य में निवास करने वाले भारतीय नागरिकों के ब्यौरे जिसमें गृह मंत्रालय के निदेशों के अधीन 1951 की जनगणना के साथ तैयार किए गए भारतीय नागरिकों के राष्ट्रीय रजिस्टर में यथा उल्लिखित ब्यौरे अभिप्रेत हैं ;
(ख) " 1971 से पूर्व निर्वाचक नामावली ", से 1971 वर्ष से पूर्व संबंधित अवधि में भारत निर्वाचन आयोग या असम राज्य के राज्य निर्वाचन आयोग द्वारा तैयार की गई मतदाताओं के ब्यौरों को अंतर्विष्ट करने वाली निर्वाचक नामावली अभिप्रेत हैं ;
(2 ) सभी अन्य शब्दों और पदों के जो इसमें प्रयुक्त है, और परिभाषित नहीं हैं किंतु इन नियमों के नियम 2 में परिभाषित हैं वहीं अर्थ होंगे जो उस नियम में हैं ।
2. असम राज्य में भारतीय नागरिकों के राष्ट्रीय रजिस्टर का प्ररूप तैयार करने की रीति, - (1 ) (क) जिला मजिस्ट्रेट, यथाउपलब्ध नागरिकों के राष्ट्रीय रजिस्टर, 1951 और 1971 वर्ष से पूर्व की निर्वाचक नामावली की प्रतियों को, पर्याप्त संख्या में, प्रकाशित करेगा और उन्हें प्रकाशित करने और उसे व्यापक प्रसार और प्रत्येक गांव और वार्ड में लोक निरीक्षण के लिए , नागरिक रजिस्ट्रीकरण के स्थानीय रजिस्ट्रार को भेजेगा ।
(ख) नागरिक रजिस्ट्रीकरण के स्थानीय रजिस्ट्रार अभिलेखों को प्रदर्शन के लिए और आवेदन प्ररूप जारी करने के लिए और प्राप्ति के लिए केन्द्रीय स्थानीय सार्वजनिक स्थान का चयन करेगा ।

(ग) नागरिक रजिस्ट्रीकरण के स्थानीय रजिस्ट्रार अपनी अधिकारिता के अधीन क्षेत्र में अभिलेखों का अभिरक्षक होगा और कार्यालय अवधि के दौरान इसके प्रदर्शन के लिए उत्तरदायी होगा ।
(2) नागरिक रजिस्ट्रीकरण के स्थानीय रजिस्ट्रार भरे हुए आवेदन प्ररूपों को उसी स्थान पर, जहां आवेदन जारी किए गए थे और आवेदकों को उनकी रसीद जारी की गई थी, प्राप्त करेगा ।
(3) नागरिक रजिस्ट्रीकरण के स्थानीय रजिस्ट्रार उपपैरा (3 ) के अधीन आवेदन प्राप्त करने के पश्चात्, आवेदनों की संवीक्षा करेगा और उनके सत्यापन करने के पश्चात् एक समेकित सूची तैयार करेगा जिसमें निम्नलिखित व्यक्तियों के नाम अंतर्विष्ट होंगे , अर्थात् : -
(क) ऐसे व्यक्तियों के नाम जो 1971 से पूर्व निर्वाचक सूची या नागरिकों के राष्ट्रीय रजिस्टर, 1951 में उपदर्शित हैं ;
(ख) उपर्युक्त खंड (क) में वर्णित व्यक्तियों के वंशज ।
3. आवेदनों की संवीक्षा (1 ) पैरा 2 के उपपैरा (3) के अधीन प्राप्त आवेदनों की संवीक्षा अभिलेखों से आवेदन प्ररूप में अभिकथित जानकारी को मिलान कर की जाएगी और व्यक्ति जिसकी जानकारी अनुक्रम में पाई जाएगी समेकित सूची में उसका नाम सम्मिलित करने के लिए पात्र होगा ।
(2) व्यक्तियों के नाम जो सक्षम प्राधिकारी द्वारा अवैध प्रवासी या विदेशी नागरिक घोषित कर दिए गए हैं के नाम समेकित सूची में सम्मिलित नहीं होंगे :
परंतु उन व्यक्तियों के नाम जो असम राज्य में 1966 के पश्चात् और 25 मार्च, 1971 से पहले आए हैं और वह विदेशी रजिस्ट्रीकरण प्रादेशिक अधिकारी के साथ रजिस्ट्रीकृत है और जो सक्षम प्राधिकारी द्वारा अवैध प्रवासी या विदेशी नागरिक के रूप में घोषित नहीं हैं, समेकित सूची में सम्मिलित होने के पात्र होंगें ।
(3) व्यक्तियों के नाम जो असम राज्य के मूल निवासी हैं और उनके बालक तथा वंशज जो भारत के नागरिक हैं, यदि ऐसे व्यक्तियों की नागरिकता युक्तियुक्त संदेह के बिना सुनिश्चित है और रजिस्ट्रीकरण प्राधिकारी का समाधान होने पर समेकित सूची में सम्मिलित होंगे ।
(4) नागरिक रजिस्ट्रीकरण के स्थानीय रजिस्ट्रार पैतृक संबंधो के संबंध या पैरा (2) के उपपैरा (3) के अधीन आवेदन में अधिकथित किसी विशिष्टि में कोई संदेह होने की दशा में, मामले को अन्वेषण के लिए जिला मजिस्ट्रेट को संदर्भित किया जाएगा और इसके विनिश्चय को नागरिक रजिस्ट्रीकरण के स्थानीय रजिस्ट्रार और व्यक्ति या परिवार को भी सूचित किया जाएगा ;
(5) नागरिक रजिस्ट्रीकरण के स्थानीय रजिस्ट्रार, 1971 को या उससे पूर्व असम राज्य से भिन्न किसी निवासी या जो 1971 के पश्चात् असम राज्य में किसी विभिन्न जिले से अंतरित हुआ है, की दशा में, यदि THE GAZETTE OF INDIA : EXTRAORDINARY

वह यह विचार करता है कि यह आवश्यक है कि सूचना का सत्यापन अंतर जिला या अंतरराज्य पत्र व्यवहार के माध्यम से करेगा ।
4. समेकित सूची का प्रकाशन (1 ) नागरिक रजिस्ट्रीकरण के स्थानीय रजिस्ट्रार सभी आवेदनों की संवीक्षा के पश्चात् ग्राम और वार्ड वार समेकित सूची तैयार करेगा तथा सूची की प्रत्येक प्रविष्टि को प्राधिकृत करेगा ।
(2) जिला मजिस्ट्रेट, उप पैरा ( 1 ) के अधीन समेकित सूची का प्रकाशन, तैयार और प्राधिकृत प्राधिकरण करेंगे जो असम राज्य में भारतीय नागरिकों के राष्ट्रीय रजिस्टर का प्रारूप होगा और इस पर आपत्ति और सुझाव , ग्राम तथा वार्ड में विस्तृत परिचालन द्वारा स्थानीय समाचार पत्रों में असम राज्य में भारतीय नागरिकों के राष्ट्रीय रजिस्टर प्ररूप का प्रकाशन की बाबत एक सार्वजनिक सूचना प्रकाशित कराएगा ।
(3) नागरिक रजिस्ट्रीकरण के स्थानीय रजिस्ट्रार असम राज्य में भारतीय नागरिकों के राष्ट्रीय रजिस्टर के अंतिम प्रकाशन के पहले किसी भी समय ऐसे व्यक्तियों के नाम का सत्यापन करा सकेंगे या सीधे कर सकेंगे जिसे वह उचित समझें ।
(4) नागरिक रजिस्ट्रीकरण के स्थानीय रजिस्ट्रार असम्यक उत्त्पीड़न के अभिकथन के आवेदन पर विशेष सावधानी से ध्यान देंगे । इस सत्यापन के संचालन के दौरान उनकी जानकारी में लाई जाती है और वह उस पर सम्यक् विचार करते हुए , आवश्यक कार्रवाई करेंगे ।
(5) नागरिक रजिस्ट्रीकरण के जिला रजिस्ट्रार के द्वारा सत्यापन रिपोर्ट की परीक्षा की जाएगी ।
(6) नागरिक रजिस्ट्रीकरण के जिला रजिस्ट्रार, यथास्थिति आदेश द्वारा , और सम्मिलित करने के कारणों को लेखबद्ध करते हुए , सत्यापन की रिपोर्ट को निस्तारित करते हुए, नामों को अपवर्जित करेंगे और सत्यापन की रिपोर्ट जिसमें नामों को सम्मिलित करने के लिए अनुज्ञात किया गया है तथा जिन्हें सम्मिलित करने के लिए अनुज्ञात नहीं किया गया है, ऐसे सभी मामलों की सूची के साथ ग्राम या वार्ड वार पृथक् पृथक रखेंगे ।
5. अतिरिक्त सूची का प्रकाशन- पैरा 4 के उपपैरा (6) के अधीन नागरिक रजिस्ट्रीकरण का जिला रजिस्ट्रार के विनिश्चय के पश्चात् अतिरिक्त सूची, यदि कोई हो, पैरा 2 के अधीन विनिर्दिष्ट रीति में भारतीय नागरिकों के राष्ट्रीय रजिस्टर प्रारूप का प्रकाशन होगा ।
(1 ) कोई व्यक्ति,-
6. दावे और आक्षेप
(क) जिसका नाम पैरा 1 के अधीन प्रकाशत भारतीय नागरिकों के राष्ट्रीय रजिस्टर प्ररूप में या. पैरा 4 के अधीन प्रकाशित अतिरिक्त सूची में उपसंजात नहीं है अपना दावा आवश्यक दस्तावेजों के समर्थन के साथ प्रस्तुत करेगा ; या [ भाग II- खण्ड 3 ( i) ]

(ख) पैरा (2) के अधीन प्रकाशित 'भारतीय नागरिकों के राष्ट्रीय रजिस्टर प्ररूप में या पैरा (4) के अधीन प्रकाशित सूची में सम्मिलित किसी नाम के सम्मिलित होने की आपत्तियां,
ऐसे प्रकाशन की तारीख से तीस दिन की अवधि के भीतर नागरिक रजिस्ट्रीकरण के स्थानीय रजिस्ट्रार के समक्ष प्रस्तुत करेगा ।
(2) नागरिक रजिस्ट्रीकरण के स्थानीय रजिस्ट्रार उपपैरा (1 ) के खंड (क) के अधीन प्राप्त दावों की सूची और उप पैरा ( 1 ) के खंड (ख ) अधीनं आक्षेपों की सूची पृथक् रजिस्टरों में कालानुक्रम में रखेगा ।
(3) नागरिक रजिस्ट्रीकरण के स्थानीय रजिस्ट्रार प्रत्येक व्यक्ति को जो उपपैरा (1) के अधीन अपना दावा या आक्षेप फाइल करता है, कोई दस्तावेज, यदि कोई हो, अपने दावे या आक्षेप के समर्थन में फाइल करता है और आवेदक या आक्षेपकर्ता को सुनवाई का युक्तियुक्त अवसर देने के पश्चात्, यथास्थिति, उसके दावे या आक्षेप का निपटान करेगा ।
7. अनुपूरक सूची का प्रकाशन नागरिक रजिस्ट्रीकरण के स्थानीय रजिस्ट्रार पैरा 6 के उपपैरा (3) के अधीन दावे और आक्षेपों के निपटान के पश्चात् यथास्थिति नामों को सम्मिलित करने के या उनका लोप करने के लिए एक अनुपूरक सूची प्रकाशित करेगा और उसके पश्चात् नागरिक रजिस्ट्रीकरण के महारजिस्ट्रार असम राज्य में भारतीय नागरिकों के अंतिम रजिस्टर का प्रकाशन करेगा ।
8. अपील- कोई व्यक्ति जो पैरा 7 के अधीन दावे और आक्षेपों के विनिश्चय के निष्कर्षों से उसका समाधान नहीं होता है विदेशी नागरिक (अधिकरण) आदेश, 1964 के अधीन गठित पदाभिहित अधिकरण के समक्ष ऐसे आदेश की तारीख से साठ दिन की अवधि के भीतर अपील कर सकेगा और अधिकरण द्वारा अपील के निपटान पर नामों का यथास्थिति सम्मिलित करना या उनका लोप असम राज्य में भारतीय नागरिकों के राजकीय रजिस्टर में होगा ।

New Delhi , the 9th November, 2009
G.S.R. 803 (E). In exercise of the powers conferred by sub - sections ( 1 ) and (3 ) of section 18 of the Citizenship Act , 1955 (57 of 1955) , the Central Government hereby makes the following rules to amend the Citizenship ( Registration of Citizens and Issue of National identity cards) Rules ,2003 , namely: -
1. (1) These rules may be called the Citizenship (Registration of Citizens and Issue ofNational Identity Cards ) Amendment Rules , 2009.

Gazette. (2) They shall come into force on the date of their publication in the Official
2. In the Citizenship (Registration of Citizens and issue of National Identity Cards) Rules , 2003 ( hereinafter referred to as the said rules ), in rule 2, after clause (m), the following clause shall be inserted , namely: -
' (ma) " Schedule " means a Schedule appended to these rules ; ' .
3. After rule 4 of the said rules , the following rule shall be inserted, namely: -
"4A. Special provisions as to National Register of Indian Citizens in State of Assam.- ( 1 ) Nothing in rule 4 shall , on and after the commencement of the citizenship (Registration of Citizens and Issue of National Identity Cards) Amendment Rules , 2009 , apply to the State of Assam .
(2) The Central Government shall , for the purpose, of the National Register of Indian Citizens in the State of Assam , cause to carry out throughout the State of Assam for preparation of the National Register of Indian Citizens in the State of Assam by inviting applications from all the residents , for collection of specified particulars relating to each family and individual , residing in a local area in the State including the citizenship status based on the National Register of Citizens 1951 and the electoral rolls prior to the year 1971 .
(3) The Registrar General of Citizens Registration shall notify the period and duration of the enumeration in the Official Gazette .
(4) The manner of preparation of the National Register of Indian Citizens in the State of Assam shall be such as specified in the Schedule appended to these rules ." .
4. After rule 18 of the said rules , the following Schedule shall be inserted, namely:-

' SCHEDULE

SPECIAL PROVISIONS AS TO MANNER OF PREPARATION OF NATIONAL REGISTER OF INDIAN CITIZEN IN STATE OF ASSAM
1. Definitions.-( 1 ) In this Schedule , unless the context otherwise requires , --
(a) "National Register of Citizens 1951 " means the Register containing details of Indian citizens residing in the State of Assam, as mentioned in the National Register of Citizens which was prepared along with 1951 census under a directive of the Ministry of Home Affairs;
(b) " electoral rolls prior to 1971 " means the electoral rolls containing details of voters as prepared by the Election Commission of India or the State Election Commission of the State of Assam in a relevant period prior to the year 1971 .
(2) All other words and expressions used herein and not defined but defined in rule 2 of these rules , shall have the meanings , respectively, assigned to them in that rule .
2. Manner of preparation of draft National Register of Indian Citizen in State of Assam .-- ( 1 ) ( a) The District Magistrate shall cause to be published the copies of the National Register of Citizens 1951 and electoral rolls prior to the year 1971 , as available, in sufficient numbers and publish it and send the same to the LocalRegister of Citizen Registration for wide circulation and public inspection in each village and ward.
(b) The Local Registrar of Citizen Registration shall select centrally located public places for display of the records and for issue and receipt of the application forms .
(c) The Local Registrar of Citizens Registration shall be the custodian of the records in the area under his jurisdiction and shall be responsible for its display during the office hours .
(2) The Local Registrar of Citizen Registration shall receive the filled up application forms , at the same place where the applications are issued, and issue the receipt thereof to the applicant .
(3) The Local Registrar of Citizen Registration, after the receipt of the application under sub - paragraph (3 ) shall scrutinize the applications and after its verification, prepare a consolidated list thereof which shall contain the names of the following persons , namely: -- THE GAZETTE OF INDIA : EXTRAORDINARY

(a) persons whose names appear in any of the electoral rolls prior to the year 1971 or in National Register of Citizens , 1951 ;
(b) descendants of the persons mentioned in clause ( a) above .
3. Scrutiny of applications.--- ( 1 ) The scrutiny of applications received under
in the application form with the official records and the persons , of whom the sub- paragraph (3 ) of paragraph 2 shall be made by comparing the information stated information is found in order , shall be eligible for inclusion of their names in the consolidated list .
(2) The names of persons who have been declared as illegal migrants or foreigners by the competent authority shall not be included in the consolidated list:
Provided that the names of persons who came in the State of Assam after 1966 . and before the 25th March , 1971 and registered themselves with the Foreigner Registration Regional Officer and who have not been declared as illegal migrants or foreigners by the competent authority shall be eligible to be included in the consolidated list;
(3) The names of persons who are originally inhabitants of the State of Assam and their children and descendants , who are Citizens of India, shall be included in the consolidated list if the Citizenship of such persons is ascertained beyond reasonable doubt and to the satisfaction of the registering authority;
(4) The Local Registrar of Citizens Registration may , in case of any doubt in respect of parental linkage or any particular mentioned in the application received under sub - paragraph (3 ) of paragraph 2 , refer the matter to the District Magistrate for investigation and his decision and Local Registrar of Citizens Registration shall also inform the same to the individual or the family ;
(5) The Local Registrar of Citizens Registration may , in case of any person who was resident of any place other than the State of Assam on or before 1971 or who have shifted to different districts in the State of Assam after 1971 , if he considers it necessary , verify the information though, inter -District and inter- State correspondences.
4. Publication of consolidated list. ( 1 ) The Local Registrar of Citizen Registration shall, after completion of scrutiny of all applications , prepare the consolidated list village and ward wise and authenticate each entry in the list .
(2) The District Magistrate , shall cause to publish the consolidated list, prepared and authenticated under sub -paragraph ( 1 ) , as draft of the National Registrar of Indian Citizens in the State of Assam, and cause to publish a public notice with regard to publication of the draft National Register of Indian Citizens in the State of Assam in the local news paper having vide circulation in the village and ward inviting objections and suggestions on it.

(3) The Local Registrar of Citizen Registration may at any time before the final publication of the National Register of Indian Citizens in the State of Assam may cause or direct to cause verification of names of such persons considered necessary.
(4) The Local Registrar of Citizen Registration shall take special care in attending the instances of allegation of undue harassment, if brought to their notice during the conduct of verification and take necessary action as he may consider appropriate.
(5) The report of the verification shall be examined by the District Registrar of Citizen Registration .
(6) The District Registrar of Citizen Registration shall , by order , and for reasons to recorded in writing for inclusion or, as the case may be, exclusion of names , dispose of the report of the verification, and the report of verification which are allowed for inclusion of names and which are not allowed for inclusion shall be kept separately, village and ward wise along with a list of all such cases .
5. Publication of additional list.--- ( 1 ) After the decision of the District Registrar of Citizens Registration under sub - paragraph (6) of paragraph 4, the additional list, if any , to the draft National Register of Indian Citizens shall be published in the manner specified under paragraph 2 .
6. Claims and objection. ( 1 ) Any person may---
(a) Whose names do not appear in the draft National Register of Indian Citizens published under paragraph 2 or in the additional list published under paragraph 4, file his claim, along with necessary documents in support of thereof; or (b) Object to inclusion of any name in the draft National Register of Indian Citizens published under paragraph 2 or in the additional list published under paragraph 4 ,
Within a period of thirty days from the date of such publication, before the Local Registrar of Citizen Registration.
(2) The Local Registrar of Citizen Registration shall maintain the list of claims received under clause (a) of sub - paragraph ( 1 ) and the objections received under clause (b) of sub - paragraph ( 1 ) in separate registers in chronological order ;
(3) The Local Registrar of Citizen Registration shall , give a notice to every person, who has filed his claim or objection under sub - paragraph ( 1 ) to file documents , if any, in support of his claim or objection, and after giving the reasonable opportunity of hearing to the applicant or objector , dispose of the claim or, as the case may be, the objection .

7. Publication of supplementary list .-- The Local Registrar of Citizen Registration shall , after the disposal of claims and the objections under sub- paragraph ( 3 ) of paragraph 6 , prepare and publish a supplementary list for inclusion or deletion of names , as the case may be , and thereafter , the Registrar General of Citizens Registration shall publish the final National Register of Indian Citizens in the State of Assam .
8. Appeal. Any person , not satisfied with the outcome of the decisions of the claims and objections under paragraph 7 , may prefer appeal , before the designated Tribunal constituted under the Foreigners (Tribunals ) Order , 1964 within a period of sixty days from the date of such order; and on the disposal of appeal by the Tribunals the names shall be included or deleted, as the case may be , in the National Register of Indian Citizens in the State of Assam . ' .
