सं. 2/11 (5)/03-बीईई. 4. कतिपय विनियमों का निम्नलिखित प्रारूप जिसे ब्यूरो, केन्द्रीय सरकार के पूर्व अनुमोदन से ऊर्जा संरक्षण अधिनियम, 2001 (2001 का 52) की धारा 58 की उपधारा (2) के खंड (झ) के साथ पठित धारा 14 के खंड (घ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, बनाने का प्रस्ताव करती है जिन्हें उक्त अधिनियम की धारा 50 की उपधारा (1 ) के अपेक्षानुसार ऐसे सभी व्यक्तियों की जानकारी के लिए जिनके उससे प्रभावित होने की संभावना है प्रकाशित किया जाता है इसके द्वारा और सूचना दी जाती है कि उक्त प्रारूप विनियमों पर उस तारीख से इस अधिसूचना के सजपत्र में प्रकाशन की तारीख से पैंतालीस दिन की अवधि के अवसान के पश्चात् विचार किया जाएगा ।
ऐसे किसी आक्षेप या सुझाव पर जो उक्त प्रारूप विनियमों के संबंध में पैंतालीस दिन की उक्त अवधि की समाप्ति के पूर्व किसी व्यक्ति से प्राप्त हो सकेंगे , ब्यूरो द्वास विचार किया जाएगा ।
आक्षेप याः सुझाव यदि कोई हों, उन्हें महानिदेशक ऊर्जा दक्षता ब्यूरो, विद्युत मंत्रालय, चौथा तत्त, सेवा भवन, आर. के. पुरम सैक्टर 1 नई दिल्ली 110066 को भेजे जा सकेंगे ।
प्रारूप विनियमः
1. संक्षिप्त नाम और प्रारंभ-( 1 ) इन विनियमों का संक्षिप्त नाम ऊर्जा दक्षता ब्यूरो ( घरेलू फ्रास्ट फ्री प्रशीतकों के लेबलों पर उनके संप्रदर्शन की विशिष्टियां और रीति) संशोधन विनियम, 2009 है ।
(2) ये राजपत्र में उनके अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. ऊर्जा दक्षता ब्यूरो ( घरेलू फ्रास्ट फ्री प्रशीतकों के लेबलों पर उनके संप्रदर्शन की विशिष्टियां और रीति) विनियम, 2009 (जिसे इसमें इसके पश्चात् मूल नियम कहा गया है) के विनियम 2 के उपविनियम (1) में, -
(क) खंड (क) के पश्चात् निम्नलिखित खंड अंतःस्थापित किया जाएगा, अर्थात् :--
" (कक) " "प्ररुप" से इन विनियमों से उपाबद्ध प्ररुप अभिप्रेत हैं,
(ख) खंड (ग) के पश्चात् निम्नलिखित खंड अंतःस्थापित किया जाएगा, अर्थात् :--
6 (गक) " " अनुज्ञा- पत्र धारी " से वह व्यक्ति अभिप्रेत है जिसको विनियम 7 के अधीन अनुज्ञा मंजूर की गई है ;";
3. मूल विनियम में विनियम 5, के पश्चात् निम्नलिखित विनियम अंतःस्थापित किया जाएगा, अर्थात् :-- "6. लेबल के संप्रदर्श के लिए अनुज्ञा (1 ) ब्यूरो की अनुज्ञा प्राप्ति के बिना कोई लेबल घरेलू फ्रास्ट फ्री प्रशीतकों पर नहीं लगाया जाएगा ।
(2) उपविनियम (1 ) के अधीन ब्यूरो की अनुज्ञा प्राप्त करने के प्रयोजन के लिए आवेदन प्ररूप । या इलेक्ट्रानिक रुप में किया जाएगा ।
परंतु घरेलू फ्रास्ट फ्री प्रशीतकों के प्रत्येक मॉडल के लिए पृथक आवेदन किया जाएगा ।
(3) उपविनियम (2) के अधीन प्रत्येक आवेदन के साथ निम्नलिखित लगे होंगे-
(क) ऊर्जा दक्षता ब्यूरो नई दिल्ली के पक्ष में आहरित डिमांड ड्राफ्ट या संदाय के किसी इलेक्ट्रानिक ढंग द्वारा संदेय एक हजार रुपए की आवेदन फीस ;
(ख) ऊर्जा दक्षता ब्यूरो नई दिल्ली के पक्ष में डिमांड ड्राफ्ट द्वारा संदेय एक लाख रुपए का लेबल प्रतिभूति फीस या संदाय किसी इलेक्ट्रानिक ढंग से ; और
(ग) उसमें विनिर्दिष्ट दस्तावेज ।
7. अनुज्ञा की मंजूरी- (1 ) विनियम 6 के अधीन प्राप्त आवेदन पर विचार करने के पश्चात् और यह समाधान हो जाने के पश्चात् कि उसमें सभी अपेक्षाओं का पालन किया गया है । ब्यूरो इस प्रकार प्राप्ति की तारीख से एक मास की अवधि के भीतर विनियम 8 में विनिर्दिष्ट ऐसे निबंधनों और शर्तों के अध्यधीन प्ररुप 2 या इलेक्ट्रानिक प्ररुप में घरेलू फ्रास्ट फ्री प्रशीतकों पर लेबल चिपकाने के लिए आवेदक को अनुज्ञा जारी करेगा ।
(2) ब्यूरो प्ररुप 3 में रजिस्टर रखेगा और उसमें अनुज्ञा - पत्र धारी का नाम रजिस्टर करेगा ।
(3) उपविनियम (1 ) के अधीन इस प्रकार मंजूर की गई अनुज्ञा , तीन वर्ष की अवधि के लिए विधिमान्य होगी और जिसे तीन वर्ष की और अवधि के लिए नवीकृत किया जा सकेगा ।
(4) अनुज्ञा के नवीकरण के लिए कोई आवेदन इसकी समाप्ति से कम से कम तीन मास पूर्व किया जाएगा और उसके साथ ऊर्जा दक्षता ब्यूरो , नई दिल्ली के पक्ष में आहरित डिमांड ड्राफ्ट में या संदाय के इलेक्ट्रानिक ढंग द्वारा संदेय पांच सौ रुपए की फीस लगी होगी ।
(5) उपविनियम (4) के अधीन नवीकरण के लिए आवेदन की प्राप्ति पर और यह समाधान हो जाने पर कि इसमें साथ सभी अपेक्षाओं का पालन किया गया है, ब्यूरो ऐसी प्राप्ति के एक मास की अवधि के भीतर प्ररुप 2 में अनुज्ञा की नवीकरण कर सकेगा ।
8. लेबल पर विशिष्टियों को प्रदर्शित करने के लिए निबंधन और शर्तें प्रत्येक अनुज्ञा- पत्र धारी निम्नलिखित निबंधनों और शर्तों का पालन करेगा, अर्थात् :--
(क) घरेलू फ्रास्ट फ्री प्रशीतकों के लेबल पर प्रदर्शित सितारा स्तर अधिनयम की धारा 14 के खंड ( क) के अधीन अधिसूचित घरेलू फ्रास्ट फ्री प्रशीतकों के लिए ऊर्जा खपत मानकों के अनुरूप होगा ।

(ख) लेबल केवल ऐसे घरेलू फ्रास्ट फ्री प्रशीतकों के मॉडल पर चिपकाया जाएगा जिसके लिए अनुज्ञा की मंजूरी दी गई है ;
(ग) अनुज्ञा- पत्र धारी अपनी लागत पर, लेबल को मुद्रित करेगा और घरेलू फ्रास्ट फ्री प्रशीतकों पर चिपकाएगा ;
(घ) अनुझा-पत्र धारी यह सुनिश्चित करेगा कि घरेलू फ्रास्ट फ्री प्रशीतकों के लेबल पर प्रदर्शित सितारा स्तर हर समय अनुरक्षित रखा जाता है ;
(ङ) आवेदक विनियम 9 में यथाविनिर्दिष्ट लेबल फीस का संदाय करेगा ;
(च) अनुज्ञा- पत्र धारी लेबलीकृत उपस्कर के उत्पादन के ब्यौरों से अंतर्विष्ट एक विवरण और वित्तीय वर्ष के प्रत्येक तिमाही के आगामी समापन के भीतर प्रत्येक तिमाही के लिए देय उद्द्भुत लेबल की फीस प्रस्तुत करेगा ।
(छ) अनुज्ञा- पत्र धारी ऐसे अन्य निबंधन और शर्तों का पालन करेगा जिसे ब्यूरो विनिर्दिष्ट करें ।
9. लेबल फीस ( 1 ) प्रत्येक अनुज्ञा-पत्र धारी ब्यूरो को घरेलू फ्रास्ट फ्री प्रशीतकों इस प्रकार चिपकाए गए लेबल पर दस रुपए की लेबल फीस का संदाय करेगा ।
(2) उपविनियम (1 ) के अधीन विनिर्दिष्ट. लेबल फीस प्रत्येक वित्तीय वर्ष की अंतिम तारीख से एक मास के भीतर वार्षिक रूप से संदाय की जाएगी :
परंतु इस प्रकार विनिर्दिष्ट अवधि के भीतर लेबल फीस का संदाय करने में असफल रहने पर विनियम 6 के उपविनियम (3) के खंड (ख) के अधीन ब्यूरो लेबल प्रतिभूति फीस से उस पर दस प्रतिशत ब्याज सहित संदत्त शोध्य रकम वसूल कर सकेगा ।
10. लेबल प्रतिभूति फीस का प्रतिदाय- विनियम 9 के उपविनियम (2) के परंतुक के अध्यधीन, घरेलू फ्रास्ट फ्री प्रशीतकों का विनिर्माण ना होने पर अनुज्ञा- पत्र धारी लेबल प्रतिभूति के संदाय का हकदार होगा।
11. ब्यूरो द्वारा सत्यापन (1 ) ब्यूरा , स्वप्रेरणा से या प्राप्त शिकायत पर यह सुनिश्चित करने के लिए सत्यापन करेगा कि घरेलू फ्रास्ट फ्री प्रशीतकों सितारा स्तर और लेबल पर प्रदर्शित अन्य विशिष्टियों के अनुरूप और अनुज्ञा के अन्य निबंधन और शर्तों का अनुपालन करता है ।
(2) जहां उपविनियम (1) के अधीन प्राप्त की गई शिकायत का ब्यूरो द्वारा सत्यापित किसी प्रयोगशाला में घरेलू फ्रास्ट फ्री प्रशीतकों का परीक्षण अपेक्षित है वहां ऐसे परीक्षण करने के लिए समनुदेशिती को सूचना जारी की जाएगी और शिकायतकर्ता से ब्यूरो के पास परीक्षण , परिवहन और अन्य आनुषंगिक व्यय से संबंधित, जो ब्यूरो द्वारा अग्रिम में अवधारित किए जाएं ऐसे व्यय जमा करने के लिए कहा जाएगा ।
(3) जहां परीक्षण के लिए प्रयोग किए जाने वाले घरेलू फ्रास्ट फ्री प्रशीतकों के नमूने परीक्षण में असफल हो जाते हैं, वहां ब्यूरो अनुझा-पत्र धारी अपनी लागत पर घरेलू फ्रास्ट फ्री प्रशीतकों के प्रथम, परीक्षण नमूनों की दुगनी मात्रा सहित दूसरा परीक्षण को संचालित करेगा ।

(4) जहां दूसरा परीक्षण भी असफल हो जाता है, वहां ब्यूरो यह निदेश देगा कि अनुज्ञा- पत्र धारी दो मास की अवधि के भीतर-
(क) घरेलू फ्रास्ट फ्री प्रशीतकों के लेबल पर प्रदर्शित सितारा स्तर को शुद्ध करेगा या परीक्षण के दौरान पाई गई त्रुटियों और कमियों को दूर करेगा ;
(ख) ब्यूरो के निदेशों का पालन करने के लिए बाजार से सभी स्टॉक को वापस लेगा ; और
(ग) विज्ञापन सामग्री पर प्रदर्शित विशिष्टियों में परिवर्तन करेगा ।
(5) जहां अनुज्ञा-पत्र धारी उपविनियम (4) के अधीन ब्यूरो द्वारा जारी किए गए निदेशों का अनुपालन करने में असफल रहता है , वहां ब्यूरो,-
(क) अनुझा वापस ले लेगा ;
(ख) उपभोक्तओं को ऐसी रीति में अधिसूचित करेगा जो वह उपयुक्त समझे ;
(ग) अधिनियम की धारा 27 के अधीन ऐसे अनुज्ञा-पत्र धारी के विरुद्ध न्यायनिर्णायक कार्रवाइयां आरंभ करेगा ।
12. अनुज्ञा का रद्दकरण ब्यूरो, विनियम 7 के अधीन मंजूर की गई अनुज्ञा को वापस ले सकेगा यदि अनुज्ञा-पत्र धारी,-
रहता है ; (क) विनियम 8 के अधीन विनिर्दिष्ट किन्ही निबंधनों और शर्तों का अनुपालन करने में असफल
(ख) विनियम 9 के अधीन विनिर्दिष्ट अवधि के भीतर लेबल फीस का संदाय करने में असफल रहता है ।

में ब्यूरो द्वारा विहित लेबल के उपयोग के लिए प्राधिकार के समनुदेशन के लिए आवेदन करता हूं/करते हैं ।
2. निर्माणकारी सुविधा उपर्युक्त उपस्कर का... और... (कंपनी का नाम) द्वारा (कारखाने का नाम और पता) में विनिर्माण किया जाता है ।
3. जानकारी का ब्यौरा उपस्कर, कंपनी, विनिर्माण सुविधा, परिक्षण के लिए प्रमाण पत्र उत्पाद लेबल से संबंधित जानकारी के ब्यौरे उपाबंध क में दिए गए हैं । फर्मों या सोसाइटियों के रजिस्ट्रार/ उद्योग निदेशक (लघु उद्योग की इकाइयों की दशा में) द्वारा जारी किए गए निगमन प्रमाणपत्र या फर्म के नाम तथा इसके विनिर्माणकारी परिसरों को अधिप्रमाणित करने वाले उसी प्रकार के अन्य दस्तावेजों की एक फोटो प्रति संलग्न की जाती है ।
क) आवेदक : को (नाम और पदनाम) कंपनी/फर्म/आदि की ओर से इस आवेदन को करने के लिए प्राधिकृत किया जाता है और वह इस आवेदन में दी गई जानकारी की सत्यता के लिए उत्तरदायी होगा ।

1. ऊर्जा दक्षता ब्यूरों ( घरेलू फ्रास्ट फ्री प्रशीतकों के लेबलों पर उनके संप्रदर्शन की विशिष्टियां और रीति) विनियम, 2009 के विनियम 7 के उपबंधों के अनुसरण में , ब्यूरों इस उपाबद्ध में दिए गए अनुमोदन के ब्यौरों के अनुसार लेबल लगाने के लिए अनुज्ञात करता है ।
2. यह अनुज्ञा निम्नलिखित के अध्यधीन है-
(क) घरेलू फ्रास्ट फ्री प्रशीतकों के लिए के लेबल पर दर्शित सितारा स्तर अधिनियम की धारा 14 के खंड (क) के अधीन अधिसूचित घरेलू फ्रास्ट फ्री प्रशीतकों के लिए ऊर्जा खपत मानक के रूप होगा ;
(ख) घरेलू फ्रास्ट फ्री प्रशीतकों के केवल ऐसे मॉडलों पर लेबल लगाया जाएगा जिसमें लिए अनुज्ञा की मंजूरी की गई है ;
(ग) अनुज्ञा-पत्र धारी की लागत पर घरेलू फ्रास्ट फ्री प्रशीतकों पर लेबल की मुद्रित किया जाएगा औ लगाया जाएगा ।
(घ) अनुज्ञा- पत्र धारी यह सुनिश्चित करेगा कि घरेलू फ्रास्ट फ्री प्रशीतकों के लेबल पर सितार स्तर को हर समय अनुरक्षित किया जाएगा ;
(ङ) अनुज्ञा- पत्र धारी प्रति लेबल दस रुपए की लेबल फीस का संदाय करेगा ;
(च) अनुज्ञा- पत्र धारी, वित्तीय वर्ष की प्रत्येक तिमाही के अंत के आगामी मास के भीतर प्रत्येक तिमाही के लिए लेबलीकृत उपस्कर के उत्पादन के ब्यौरे और उद्भुत देय लेबल फीस का विवरण ब्यूरों को प्रस्तुत करेगा और वही ब्यौरे ब्यूरो को स्वाचालित प्रणाली से भी प्रस्तुत किए जाएंगे ;
(छ) अनुज्ञा - पत्र धारी घरेलू फ्रास्ट फ्री प्रशीतकों के ऐसे अन्य ब्यौरे उपलब्ध कराएगा जैसा जब ब्यूरो चाहे, जिसके लिए अनुज्ञा को मंजूरी दी गई हैं ।

3. यह अनुज्ञा .. से. तक विधिमान्य होगी और इसे और यथाविहित रूप में नवीकृत किया जा सकेगा । आप ब्यूरो के पूर्व अनुमोदन के सिवाय अनुज्ञा की विधिमान्य अवधि के दौरान बाजार से घरेलू फ्रास्ट फ्री प्रशीतकों को वापस नहीं लेंगे ।

No. 2/11 ( 5 )/03 - BEE . 4. The following draft of certain regulations which the Bureau, with the previous approval of the Central Government , proposes to make in exercise ofthe powers conferred by clause ( d) of section 14 read with clause (i ) of sub- section (2 ) of section 58 of the Energy Conservation Act , 2001 ( 52 of 2001 ) , is hereby published as required by sub- section ( 1 ) of section 58 of the said Act for the information of all persons likely to be affected thereby; and notice is hereby given that the said draft regulations shall be taken into consideration on or after the expiry of a period of forty five days from the date of publication of this notification in the Official Gazette .
Any objection or suggestion which may be received from any person with respect to the said draft regulations before the expiry of the aforesaid period of forty five days shall be taken into consideration by the Bureau .
Objection or suggestion, if any, may be addressed to the Director - General , Bureau of Energy Efficiency . Ministry of Power , 4th Floor, Sewa Bhavan , R. K. Puram , Sector - 1 , New Delhi - 110 066 .
Draft Regulations
1. Short title and commencement.- ( 1 ) These regulations may be called the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Household Frost Free Refrigerators ) Amendment Regulations , 2009.
Gazette. (2) They shall come into force on the date of their final publication in the Official
2. In the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Household Frost Free Refrigerators ) Regulations , 2009 (hereinafter referred to as the principal regulations ) , in regulation 2, in sub- regulation ( 1 ) , -
(a) after clause ( a) , the following clause shall be inserted , namely: -
" (aa) " Form " means a form appended to these regulations ; " ;

(b) after clause (c) , the following clause shall be inserted , namely: -
"(ca) permittee " "means a person to whom permission has been granted under regulation 7; " ;
3 In the principal regulations , after regulation 5 , the following regulations shall be inserted, namely:-
"6. Permission for display of label.- ( 1 ) No label shall be affixed on a household frost free refrigerator without obtaining the permission of the Bureau.
(2) For the purpose of obtaining permission of the Bureau under sub - regulation (1) , an application shall be made in Form - I or in electronic Form;
Provided that separate application shall be made for each model of household frost free refrigerator ;
(3) Every application under sub - regulation (2) shall be accompanied by
(a) an application fee of rupees one thousand payable demand draft drawn in favour of the Bureau of Energy Efficiency , New Delhi or by any electronic mode of payment ;
(b) a label Security Fee of rupees one lakh payable by demand draft drawn in favour of the Bureau of Energy Efficiency , New Delhi or by any electronic mode of payment ;
(c) documents specified therein.
7. Grant of permission .- ( 1 ) On receipt of an application under regulation 6 and after being satisfied that all requirements therein are complied with , the Bureau may, within a period of one month from the date of such receipt . grant, subject to such terms and conditions as are specified in regulation 8 , permission for affixing label on household frost free refrigerator in Form II or in electronic form.
(2) The Bureau shall maintain a register in Form - III and enter the name of permittee therein.
(3) The permission so granted under sub- regulation ( 1 ) shall be valid for a period ofthree years and may be renewed for a further period of three years by the Bureau .
(4) An application for renewal of permission shall be made at least three months before its expiry and shall be accompanied by a fee of rupees five hundred payable . by demand draft drawn in favour of the Bureau of Energy Efficiency . New Delhi or by any electronic mode of payment .
(5) Onreceipt of application for renewal under sub - regulation ( 4 ) and after being satisfied that all requirements are complied with , the Bureau may, within a period of one month from the date of such receipt, renew permission in Form II .

8. Terms and conditions for display of particulars on label . Every permittee shall comply with the following terms and conditions , namely: -
(a) The star level displayed on the label of household frost free refrigerator shall conform to energy consumption standards for household frost free refrigerator notified under clause ( a) of section 14 of the Act ;
(b) the label shall be affixed only on such model of household frost free refrigerator for which permission has been granted ;
the label shall be printed and affixed on the household frost free refrigerator at the cost of the permittee; (c)
(d) the permittee shall ensure that the star level displayed on the label of household frost free refrigerator shall be maintained at all time;
(e) the permittee shall pay the label fee as specified in regulation 9 ;
(f) the permittee furnish to the Bureau a statement containing details of production of labelled equipment and the accrued labelling fee due for each quarter within the following month of the close of each quarter of the financial year;
(g) the permittee shall comply with such other terms and conditions which the Bureau may specify.
9. Label Fee . - ( 1 ) Every permittee shall pay to the Bureau a label fee of rupees ten on each label so affixed on the distribution transformer .
(2) The label fee specified under sub - regulation ( 1 ) shall be paid annually within one month from the date of closure of each financial year :
Provided that on failure to pay the label fee within the period so specified, the Bureau may recover the amount due with interest thereon at ten per cent . from the Label Security Fee paid under clause ( b ) of sub - regulation (3 ) of regulation 6 .
10. Refund of Label Security Fee: Subject to the proviso to sub- regulation (2) of regulation 9 , a permittee shall be entitled to a refund of the Label Security Fee on ceasing to manufacture household frost free refrigerator .
11. Verification by the Bureau ( 1) The Bureau may , either suo motu , or on the complaint received by it, carry out verification to ensure that the household frost free refrigerator conforms to the star level and other particulars displayed on its label and that it complies with the other terms and conditions of permission.
(2) Where upon a complaint received under sub - regulation ( 1 ) , the Bureau is required to carry out verification, by testing the household frost free refrigerator
in a laboratory , a notice shall be issued to the permittee for carrying out such testing and the complainant shall be called upon to deposit, such expenses relating to testing , transportation and other incidental expenses with the Bureau, within such time , as may be determined it.

(3) Where samples of household frost free refrigerator used for testing fails the test, the permittee shall be afforded another opportunity and the Bureau shall conduct a second test with twice the quantity of household frost free refrigerator used in the first test, at the cost of the permittee.
(4) Where the second test also fails , the Bureau shall direct that the permittee shall , within a period of two months , -
(a) correct the star level displayed on the label of the household frost free refrigerator or remove the defects and deficiencies found during testing;
(b) withdraw all the stocks from the market to comply with the directions of the Bureau; and
(c) change the particulars displayed on advertising material.
(5) Where the permittee fails to comply with the directions issued by the Bureau under sub - regulation (4) , the Bureau shall -
(a) withdraw the permission ;
(b) notify the consumers in such manner as it deems fit;
(c) initiate adjudication proceedings against such permittee under section 27 of the Act.
12. Cancellation of Permission The Bureau may cancel the permission granted under regulation 7 , if the permittee -
(a) fails to comply with any of the terms and conditions specified under regulation 8;
(6) fails to pay label fee within the period specified under regulation 9 .

1. Pursuant to the provisions of regulation 7 of the Bureau of Energy Efficiency (Particulars and Manner of their display on Labels of Household frost free refrigerator) Regulations , 2009, the BUREAU hereby permits you to affix Label as per details of approvals set out in the Annexure .
2. This permission is subject to-
a. the star level displayed on the label of the household frost free refrigerator shall conform to energy consumption standards for household frost free refrigerator notified under clause (a) of section 14 of the Act;
b. the label shall be affixed only on such model of household frost free refrigerator for which permission has been granted;

3. Thispermission shall be valid from and may be renewed as prescribed. You shall not withdraw the household frost free refrigerator from the market during the validity period of permission except with the prior approval of the Bureau .
4. The unique label series code for the equipment is and should appear on the label as per the approved design.
5. Where the star level plan on review is modified by the Bureau and the star level of the household frost free refrigerator stand modified, you shall seek the permission afresh .
