सा.का.नि. 814(अ). खाद्य अपमिश्रण निवारण नियम , 1955 का और संशोधन करने के लिए कतिपय नियमों का निम्नलिखित प्रारूप जिसे केन्द्रीय सरकार ने केन्द्रीय खाद्य मानक समिति के परामर्श के पश्चात्, खाद्य अपमिश्रण निवारण अधिनियम, 1954 (1954 का 37) की धारा 23 की उपधारा ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बनाने का प्रस्ताव करती है और उक्त उपधारा की अपेक्षानुसार उन सभी व्यक्तियों की जानकारी के लिए जिनके उससे प्रभावित होने की संभावना है , प्रकाशित किया जाता है और यह सूचना दी जाती है कि उक्त प्रारूप नियमों पर उस तारीख से जिसको भारत के उस राजपत्र की प्रतियां, जिसमें यह सूचना प्रकाशित की जाती है, जनता को उपलब्ध करा दी जाती है, साठ दिन की अवधि की समाप्ति के पश्चात् विचार किया जाएगा ;
आक्षेप और सुझाव यदि कोई हो, सचिव, स्वास्थ्य और परिवार कल्याण मंत्रालय , भारत सरकार, निर्माण भवन , नई दिल्ली 110011 को भेजे जा सकेंगे ।
ऐसे किन्हीं आक्षेपों और सुझावों पर जो विनिर्दिष्ट अवधि के समाप्त होने से पूर्व उक्त प्रारूप नियमों की बाबत किसी व्यक्ति से प्राप्त होंगे , केन्द्रीय सरकार द्वारा विचार किया जाएगा ।
प्रारूप नियम
1. (1 ) इन नियमों का संक्षिप्त नाम खाद्य अपमिश्रण निवारण ( 8वां संशोधन ) नियम, 2009 है । ( 2) ये राजपत्र में उनके अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. खाद्य अपमिश्रण निवारण नियम, 1955 के परिशिष्ट ख में, -
(i ) आयातित रेपसीड आयल (तोरिया का तेल) से संबंधित मद क 17.18 और उससे संबंधित प्रविष्टियों के स्थान पर निम्नलिखित मद और प्रविष्टियां रखी जाएंगी, अर्थात् : --
" क 17.18- रेपसीड या सरसों का तेल- निम्न ईरुसिक अम्ल से ऐसा तेल अभिप्रेत है जो ब्रेसिका की कम्पेस्ट्रीज, जुंसिया अथवा नेपस किस्मों के स्वच्छ और अच्छे निम्न ईरुसिक अम्ल वाले रेपसीड के बीजों से निमोड़न या विलायक निष्कर्षण पद्धति द्वारा अभिप्राप्त किया गया है और यह साफ होगा, दुर्गंध, निलंबित या अन्य विजातीय पदार्थ, पृथक्कत जल, रंजक और सुरुचिकारक पदार्थ या खनिज तेल से मुक्त होगा तथा इसमें ईरुसिक अम्ल 2 % ( कुल वसा अम्लके % के अनुसार) से अधिक नहीं होगा और निम्नलिखित मानकों के अनुरूप होगा , अर्थात् : --
40° सें० पर ब्यूटिरो रेफ्रेक्टोमीटर पठन .. .58.6-61.7
40° सें ० पर अपवर्तनांक... .1.465-1.467
आयोडिन मान (विज पद्धति) . 105-126
या साबुनीकरण मान..... 182-193
..0.6 से अधिक नहीं
अम्ल मान ...

बेलीयर परीक्षण (अविलता ताप - ऐसेटिक अम्ल पद्धति) .
आर्जेमोन तेल के लिए परिक्षण ऋणात्मक होना चाहिए
हाइड्रोसैनिक अम्ल के लिए परीक्षण
(फेरिक -क्लोराइड परीक्षण ) . परीक्षण में पास
विलायक निष्कर्षण द्वारा अभिप्राप्त रेपसीड आयल मानव उपभोग के लिए प्रदाय केवल उसे परिष्कृत किए जाने के पश्चात् ही किया जाएगा और मद क 17.15 के अधीन अधिकथित मानकों, सिवाय अम्ल मूल्य जो 0.6 से अधिक नहीं होगा , के अनुसार होगा तथा प्रज्जवलन ताप (पेन्स की मार्टन बंद पद्धति) 250° सें 0 से कम नहीं होगा और इस प्रकार परिष्कृत तेल में हैक्सेन 5.00 पीपीएम से अधिक नहीं होगा ।
अनुज्ञात खाद्य योजक हो सकते हैं ।
परंतु इसमें इन नियमो के अधीन

NOTIFICATION
New Delhi , the 12th November , 2009
G.S.R. 814( E) .-The following draft of certain rules further to amend the Prevention of Food Adulteration Rules , 1955, which the Central Government, after consultation with the Central Committee for Food Standards , proposes to make in exercise of the powers conferred by sub- section ( 1 ) of section 23 of the Prevention of Food Adulteration Act, 1954 (37 of 1954) , is hereby published, as required by the said sub-section, for the information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette of India in which this notification is published , are made available to the public ;
Objections or suggestions , if any , may be forwarded to the Secretary, Ministry of Health and Family Welfare , Government of India, Nirman Bhawan, New Delhi - 110011 .
The objections or suggestions , which may be rePceived from any person, with respect to the said draft rules , before the expiry of the period so specified, will be considered by the Central Government .
DRAFT RULES
1. (1 ) These rules may be called the Prevention of Food Adulteration (8th Amendment) Rules , 2009 ,
(2) They shall come into force on the date of their final publication in the Official Gazette.
2. In the Prevention of Food Adulteration Rules 1955 , in Appendix -B,
(i) for the item A.17.18 relating to IMPORTED RAPESEED OIL- ( Toria -ka-tel) and entries relating thereto, the following item and entries shall be substituted , namely: -
"A.17.18 RAPESEED or MUSTARD OIL - LOW ERUCIC ACID means the oil obtained from clean and sound low erucic acid oil bearing seeds of rapeseed belonging to compestris , juncea, or napus varieties of Brassica by the method of expression or solvent extraction and it shall be clear, free from rancidity , suspended or other foreign matter, separated water , added colouring or flavouring substances or mineral oil and shall contain not more than 2 % erucic [PART II-SEC. 3 (i) ]

acid ( as % of total fatty acids ) and shall conform to the following standards , namely: -
58.6-61.7 Butyro- refractometer reading at 40 ° C.

Rapeseed oil obtained by solvent extraction shall be supplied for human consumption only if it is refined and it shall conform to the standard laid down under item A.17.15 except acid value which shall be not more than 0.6 .Additionally, and it shall have Flash Point ( Penske Marten Closed method) not less than 250 °C and the oil so refined shall contain Hexane not more than 5.00ppm;
Provided that it may contain food additives permitted under these rules . "
