का.आ. 2891 (अ).-यतः मै. डिशमैन इन्फ्रास्ट्रक्चर लिमिटेड , जो गुजरात राज्य में एक निजी संगठन है , ने गुजरात राज्य के ग्राम कल्याणगध एवं गंगद , तालुका बावला , जिला अहमदाबाद में औषधीय सामग्री के लिए एक क्षेत्र विशिष्ट विशेष आर्थिक जोन की स्थापना हेतु विशेष आर्थिक जोन अधिनियम, 2005 ( 2005 का 28 ) , ( जिसे एतद्पश्चात् उक्त अधिनियम कहा गया है ) की धारा 3 के अंतर्गत प्रस्ताव किया है ;
और यतः केन्द्र सरकार इस बात से संतुष्ट है कि उक्त अधिनियम की धारा 3 की उप- धाध ( 8 ) के अंतर्गत अपेक्षाओं तथ्य अन्य संबंधित अपेक्षाओं को पूरा कर लिया गया है और उसने उपर्युक्त विशिष्ट विशेष आर्थिक जोन के विकास, प्रचालन एवं रखरखाव हेतु उक्त अधिनियम की धारा 3 की उप - धारा ( 10 ) के अंतर्गत दिनांक 17 अप्रैल, 2008 को अनुमोदन पत्र प्रदान कर दिया है ;.
अतः अब विशेष आर्थिक जोम अधिनियम, 2005 की धारा 4 की उप -धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और विशेष आर्थिक जोन नियम , 2006 के नियम 8 के अनुसरण में:-
( i ) केन्द्र सरकार एतद्द्वारा निम्नलिखित तालिका में उल्लिखित सर्वेक्षण संख्या और क्षेत्र को एक विशेष आर्थिक जोन के रूप में अधिसूचित करती है , अर्थात्:-

( ii ) केन्द्रीय सरकार एतद्द्वारा उक्त अधिनियम की धारा 14 के प्रयोजनार्थ उपर्युक्त विशेष आर्थिक जोन के लिए एक समिति , जिसे
अनुमोदन समिति कहा जाएगा , गठित करती है , जिसके अध्यक्ष और सदस्य निम्नानुसार हैं , अर्थात् :
1. विशेष आर्थिक जोन का विकास आयुक्त -अध्यक्ष , पदेन
2. निदेशक अथवा उप- सचिव , भारत सरकार , वाणिज्य एवं उद्योग मंत्रालय , वाणिज्य विभाग या उसका -सदस्य, पदेन
नामिती जिसका स्तर अवर सचिव , भारत सरकार से कम नहीं होगा
3. विशेष आर्थिक जोन पर भू- भागीय क्षेत्राधिकार रखने वाला क्षेत्रीय संयुक्त विदेश व्यापार महानिदेशक -सदस्य , पदेन
4. विशेष आर्थिक जोन पर भू- भागीय क्षेत्राधिकार रखने वाले सीमा शुल्क आयुक्त या केन्द्रीय उत्पाद -सदस्य, पदेन
शुल्क आयुक्त अथवा उनका नामिती जिसका स्तर देत आयुक्त से कम नहीं होगा

6 निदेशक ( बैंकिंग ) , वित्त मंत्रालय , बैंकिंग प्रभाग , भारत सरकार

-सदस्य , पदेन 7. गुजरात सरकार द्वारा नामित किए जाने वाले दो अधिकारी जिनका स्तर संयुक्त सचिव से कम नहीं होगा
& मैं. डिशमैन इन्फ्रास्ट्रक्चर लिमिटेड ( जोन के विकासकर्ता ) का प्रतिनिधि
-विशेष आमंत्रिती
( iii ) केन्द्रीय सरकार एतद्द्वारा , दिनांक 13 नवम्बर , 2009 को उस तारीख के रूप में निर्धारित करती है जिस तारीख से उक्त क्षेत्रा विशिष्ट विशेष जोन को सीमा शुल्क अधिनियम , 1962 ( 1962 का 52 ) की धारा 7 के अंतर्गत अंतर्देशीय कंटेनर डिपो माना जाएगा ।

NOTIFICATION
New Delhi , the 13th November, 2009
S.O. 2891 ( E). Whereas M/s . Dishman Infrastructure Limited , a private organisation in the State ofGujarat has proposed under Section 3 of the Special Economic Zones Act, 2005 (28 of2005 ) ( hereinafter referred to as the said Act)10 set up a sector specific Special Economic Zone for pharmaceutical sector at villages Kalayangadh and Gangad, Taluka Bavla, District Ahmedabad in the State ofGujarat;
And whereas , the Central Government is satisfied that requirements under sub -section (8) of Section 3 of the said Act, and other related requirements are fulfilled and it has granted letter of approval under sub- section ( 10 ) of Section 3 of the said Act fordevelopment, operation and maintenance of the above Special Economic Zone on the 17th April , 2008;
Now, therefore, in exercise of the powers conferredby sub- section ( 1 ) of Section 4 ofthe Sepcial Economic Zones Act, 2005 and in pursuance of rule 8 ofthe Special Economic Zones Rules, 2006 :-
( i) the Central Government hereby notifies the following area with survey numbers given below in the Table , as a Special Economic Zone, namely:-

( ii ) the Central Government hereby constitutes a Committee to be called the Approval Committee for the above sector specific Special Economic Zone for the purposes of Section 14 of the said Act consisting of the following Chairperson andMembers , namely:-

-Member, ex -officio 2. Director or Deputy Secretary to the Government of India. Ministry of Commerce and Industry, Department of Commerce or his nominee not below the rank of Under Secretary to the Government of Indua

( iii ) the Central Government hereby also appoints the 13th day of November , 2009 as the date from which the above sector specific Special Economic Zone shall be deemed to be Inland Container Depot under Section 7 ofthe Customs Act, 1962 (52 of 1962).
