फा. सं. 01 /89/180/विविध/65/एएम 05/पी.सी. विदेश व्यापार नीति, 2009-2014 के पैराग्राफ 2.4 के तहत प्रदत्त शक्तियों का प्रयोग करते हुए महानिदेशक, विदेश व्यापार प्रक्रिया- पुस्तक ( खण्ड-1 ) 2009-2014 में, एतद्द्वारा , निम्नलिखित संशोधन करते हैं :
1. संशोधन के बाद पैराग्राफ 2.32.2 को निम्नानुसार पढ़ा जाएगा :-
2.32 धात्विक छीजन और स्क्रैप का आयात
2.32.1 किसी प्रकार के धात्विक छीजन , स्क्रैप का आयात इस शर्त के अधीन होगा कि उसमें खतरनाक , जहरीला छीजन , रेडियोएक्टिव से दूषित छीजन/स्क्रैप जिसमें रेडियोएक्टिव शामिल हो, किसी प्रकार के हथियार , गोला बारुद , बारुदी सुरंगों जिंदा या चली हुई गोलियों के खोल या किसी भी प्रकार का अन्य विस्फोटक सामान चाहे वह प्रयोग किया गया हो या नहीं , शामिल नहीं होगा ।
2.32.2 निम्नलिखित प्रकार के धात्विक छीजन और स्क्रैप का आयात कुछ शतों के अधीन मुक्त होगा , जिनका विस्तृत ब्यौरा निम्नलिखित है :-

खंडित रूप : खंडित रूप में धात्विक छीजन और स्क्रैप का आयात निम्नलिखित शर्तों के मद्दे भारत के सभी पत्तनों से अनुमत किया जाएगा:
क. माल की निकासी के समय आयातक को सीमा शुल्क प्राधिकारी को निम्नलिखित दस्तावेज प्रस्तुत करने होंगे :
1. परिशिष्ट -5 में उल्लिखित किसी भी जाँच और प्रमाणन अभिकरणों से परिशिष्ट-5 के अनुलग्नक-1 में दिये गये प्रपत्र के अनुसार इस आशय का पोतलदान पूर्व जाँच प्रमाण - पत्र की खेप के विकिरण स्तर की जाँच की गई और स्क्रैप में प्राकृतिक बैकग्राउण्ड स्तर से अधिक विकिरण स्तर ( गामा और न्यूट्रान ) शामिल नहीं है । प्रमाण- पत्र में उक्त स्थान के बैकग्राउण्ड विकिरण स्तर का मूल्य का उल्लेख करेगा तथा स्क्रैप का अधिकतम विकिरण स्तर भी बताएगा; और
II. आयातक और निर्यातक के बीच हुए समझौते की प्रति यह दर्शाते हुए कि इस खेप में किसी भी प्रकार के रेडियो एक्टिव से दूषित किसी भी रुप में शामिल नहीं है ।
होदाईडेह, यमन और बंदार अबास और ईरान से आयात केवल खंडित रूप में होगा ।
अखंडित संकुचित और अलग-अलग रूप उपरोक्त पैरा 2.32.2 में अखंडित, संकुचित और अलग-अलग रूप में धात्विक छीजन और स्क्रैप का आयात निम्नलिखित शर्तों के मद्दे किया जाएगा ।
क. माल की निकासी के समय आयातक सीमा शुल्क निम्नलिखित दस्तावेज प्रस्तुत करेगा :-
1. परिशिष्ट-5 में उल्लिखित किसी भी जांच और प्रमाणन अभिकरणों से परिशिष्ट-5 के अनुलग्नक-1 में दिये गये प्रपत्र के अनुसार इस आशय का पोतलदान पूर्व जांच प्रमाण- पत्र कि:-
( i ) इस खेप में किसी भी प्रकार के हथियार , बारूद, माइन्स , शैल्स, कार्टराईजेज , या किसी भी रूप में प्रयुक्त अथवा अन्य रूप में कोई विस्फोटक सामग्री नहीं है और खेप के विकिरण स्तर की जाँच की गई और स्क्रैप में प्राकृतिक बैकग्राउण्ड स्तर से अधिक विकिरण स्तर ( गामा और न्यूट्रान ) नहीं पाया गया । प्रमाण - पत्र में उक्त के बैकग्राउण्ड विकिरण स्तर का मूल्य भी होगा तथा स्क्रैप का अधिकतम विकिरण स्तर भी होगा ।
(ii ) आयातित मदें वास्तव में ऐसे वर्गीकरण के लिए अन्तर्राष्ट्रीय रूप से स्वीकृत मापक के अनुसार एक धात्विक अपशिष्ट/स्क्रैप/पुराने/दोषपूर्ण है ।
II . आयातक और निर्यातक के बीच समझौते की प्रति जिसमें यह उल्लेख किया गया हो कि इस खेप में किसी भी प्रकार के हथियार , बारूद, माइन्स, शैल्स, कार्टराईजेज , रेडियो एक्टिव कटैमिनेटेड अथवा किसी भी रूप में प्रयुक्त अथवा अन्य रूप में कोई विस्फोटक सामग्री नहीं है ।
ख. स्क्रैप का आयात केवल निम्नलिखित नामित पत्तनों द्वारा किया जा सकेगा और ईओयू तथा एस ए ई जैड के मामले में भी कोई अपवाद अनुमत नहीं होगा :
" 1. चैन्नई, 2. कोचीन , 3. इन्नोर , 4. जे.एन.पी.टी. , 5. काण्डला, 6. मोर्मुगुआ, 7. मुम्बई, 8. न्यू मैंगलोर, 9. पारादीप , 10. तूतीकोरिन , 11. विशाखापट्नम , 12. आईसीडी लोनी गाजियाबाद, 13. पिपावा , 14. मुन्द्रा, 15. कोलकाता, 16. आईसीडी लुधियाना , 17. आईसीडी दादरी ( ग्रेटर नोएडा ) , 18. आईसीडी नागपुर , 19. आईसीडी जोधपुर , 20. आईसीडी जयपुर , 21. आईसीडी उदयपुर , 22. सी एफ एस मुलुंड , 23. आईसीडी कानपुर , 24. आईसीडी अहमदाबाद , 25. आईसीडी पीत्तमपुर और 26. आईसीडी मलानपुर । " असाधारण

2.32.2. क. यदि कोई ऐजेंसी परिशिष्ट -5 के तहत सूची में शामिल होना चाहती है तो वे परिशिष्ट -5 क के प्रारूप के तहत विदेश व्यापार महानिदेशालय के कार्यालय में आवेदन जमा करवा सकते हैं जिस पर एक अंतर मंत्रालीय समिति द्वारा विचार किया जाएगा ।
(क) एजेन्सी की गतिविधियों, उसका इतिहास , सदस्यता , संगठनात्मक ढाँचा , मानव शक्ति आदि का संक्षिप्त ब्यौरा ।
( ख ) धात्विक स्क्रैप का निरीक्षण करने हेतु आधारभूत ढाँचा बनाने, संभार तंत्र , परीक्षण प्रयोगशाला आदि ।
(ग ) कम्पनियों/एजेन्सियों की सूची जिनके लिए परीक्षण किया जा चुका है ।
2.32.3 तथापि , अन्य प्रकार की धात्विक छीजन और स्क्रैप का आयात आईटीसी ( एच एस ) की शर्तों तथा प्रावधानों के अनुसार अनुमत किया जाएगा ।
2.32.4 पुराने और दोषपूर्ण , पुराने कपड़े ( चीथड़े ) प्लास्टिक बोतलें/छीजन और समुद्री जहाजों के विषय में आयात नीति आई टी सी (एच एस ) में उल्लिखित है ।
2. तद्नुसार, प्रक्रिया पुस्तक , खण्ड-1 के परिशिष्ट -5 के अनुलग्नक 1 को संशोधित किया जाता है और इस सार्वजनिक सूचना के साथ संलग्न किया जाता है ।
3. इसे लोकहित में जारी किया जाता है ।

2. आयात प्रेषण , ऐसे वर्गीकरण के लिए अन्र्तराष्ट्रीय रूप से स्वीकृत मानकों के अनुसार वास्तव में, धात्विक स्क्रैप/पुराना माल/दोषपूर्ण है ।
3. मैं/ हम एतद्वारा घोषणा करता हूँ करते हैं कि इस प्रमाण पत्र में दिए गए विवरण एवं कथन सत्य एवं सही हैं और उनमें से कुछ भी छुपाया अथवा रोका नहीं गया है ।

No. 01 /89/180/Misc.65 /AM 05/PC- II (B).-In exercise ofpowers conferred under Paragraph 2.4 of the Foreign Trade Policy2009-2014, the Director General of Foreign Trade hereby makes the following amendments in Handbook of Procedures , (Vol . 1 ), 2009-2014 .
1. After amendment , paragraph 2.32.2 shall be read as under :
"2.32 Import of Metallic Waste and Scrap.
2.32.1 Import of any form of metallic waste , scrap will be subject to the condition that it will not contain hazardous , toxicwaste, radioactive contaminated waste/scrap containing radioactive material , any type of arms , ammunition, mines , shells , live or used cartridge or any other explosive material in any form either used or otherwise.
2.32.2 Import of following types of metallic waste and scrap will be free subject to conditions detailed below:

Import of metallic waste and scrap listed above in shredded form shall be permitted through all ports of India subject to following conditions :
a. Importer shall furnish following documents to customs at the time of clearance of goods:
( 1 ) Pre- shipment inspection certificate as per the format in Annexure - 1 to Appendix- 5 , from any of the Inspection and Certification agencies given in Appendix- 5 , to the effect that the consignment was checked or radiation level and scrap does not contain radiation level ( gamma and neutron) in excess of natural background. The certificate shall give the value of background radiation level at that place as also the maximum radiation level on the scrap; and
( II ) Copy of the contract between the importer and the exporter stipulating that the consignment does not contain any radioactive contaminated material in any form.
Import from Hodiadeh , Yemen and Bandar Abbas , Iran will be in shredded form only.
Unshredded compressed and loose form:
Import of metallic waste , scrap listed in para 2.32.2 above in unshredded compressed and loose form shall be subject to the following conditions :
a. Importer shall furnish the following documents to the Customs at the time of clearance ofgoods .
( 1) Pre-shipment inspection certificate as per the format in Annexure - Ito Appendix - 5 from any of the Inspection and Certification agencies given in Appendix-5 to the effect that :
(i) the consignment does not contain any type of arms , ammunition, mines , shells , cartridges or any other explosive material in any form either used or otherwise , and that the consignment was checked for radiation level and it does not contain radiation level (gamma and neutron) in excess of natural background. The certificate shall give the value of background radiation level at that place as also the maximum radiation level on the scrap.
(ii) The imported item is actually a metallic waste/scrap/seconds/defective as per the internationally accepted parameters for such a classification.
(II) Copy of the contract between the importer and the exporter stipulating that the cosignment does not contain any type of arms , ammunition , mines, shells , cartridges radioactive contaminated, or any other explosive material in any form either used or otherwise.
b. Import ofscrap would take place only through following designated ports and no exception would be allowed even in case of EOUS , SEZs :
1. Chennai , 2. Cochin , 3 Ennore , 4. JNPT , 5. Kandla, 6. Mormugao , 7. Mumbai , 8. New Mangalore , 9. Paradip , 10. Tuticorin, 11. Vishakhapatnam, 12. ICD , Loni , Ghaziabad , 13. Pipava , 14. Mundra, 15. Kolkata, 16. ICD, Ludhiana, 17. ICD, Dadri (Greater Noida) , 18. ICD, Nagpur , 19. ICD , Jodhpur, 20. ICD , Jaipur, 21. ICD , Udaipur , 22. CFS , Mulund, 23. ICD, Kanpur , 24. ICD , Ahmedabad, 25. ICD, Pitampur and 26. ICD , Malanpur .
2.32.2.A In case any agency wishes to be enlisted under Appendix - 5, they may furnish an application to the office ofDirector General of Foreign Trade with the following documents in the format in Appendix- 5 - A, which will be consideredby an Inter - Ministerial Committee .
(a)A. brief on the activities of the agency , its history , membership , organisational structure , manpower , etc. (b) Infrastructural setup , logistics , testing labs etc. for carrying out the inspection of metallic scrap.
(c) List of companies /agencies for which testing has been carried out.
2.32.3 However, import of other kinds of metallic waste and scrap will be allowed in terms of conditions of ITC(HS) .
2.32.4 Import policy for second and defective, rags , PET bottles/waste and ships is given in ITC (HS ) . "
