न्यूशिपर समीक्षा जाँच शुरुआतं
विषय :-मै, मेरीडियन सोलर एंड डिस्प्ले कं. लि. ( कोरिया
गण. के उत्पादक/निर्यातक ) के अनुरोध पर कोरिया गणराज्य से कैथोड रे कलर पिक्चर ट्यूबों के आयातों पर लगाए गए पाटनरोधी शुल्क की (नियम 22के अंतर्गत ) न्यू शिपर समीक्षा शुरू करना ।
सं. 15/10/2009-डीजीएडी. मै. मेरीडियन सोलर एंड डिस्प्ले कं. लि. (कोरिया गण. के उत्पादक/निर्यातक ) ने निर्दिष्ट प्राधिकारी (जिन्हें इसके बाद प्राधिकारी कहा गया है ) के समक्ष 1995 में यथा संशोधित सीमा शुल्क टैरिफ अधिनियम , 1975 और सीमा- शुल्क टैरिफ ( पाटित वस्तुओं की पहचान , उन पर पाटनरोधी शुल्क का आकलन एवं संग्रहण और क्षति निर्धारण ) नियमावली , 1995 के अनुसार एक आवेदन दायर किया है जिसमें कोरिया गणराज्य से कैथोड रे कलर पिक्चर ट्यूबों ( जिसे एतपश्चात् संबद्ध वस्तु कहा गया है ) के निर्यातों पर प्राधिकारी द्वारा सिफारिश किए गए पाटनरोधी शुल्क की समीक्षा का अनुरोध किया गया है , इस मामले में केन्द्र सरकार ने सीमा शुल्क टैरिफ अधिनियम के अध्याय 85 के अंतर्गत दिनांक 15-5-2009 की अधिसूचना सं. 50/2009-सींमा- शुल्क के अंतर्गत पाटनरोधी शुल्क अधिसूचित किया गया है ।

2. प्राधिकारी ने 7 मई , 2008 की अधिसूचना सं. 14/8/2007-डीजीएडी के तहत थाईलैंड , मलेशिया, चीन जनवादी गणराज्य और कोरिया गणराज्य से कैथोड रे कलर पिक्चर ट्यूबों के आयात के संबंध में प्रारंभिक जांच परिणाम अधिसूचित किए थे और दिनांक 24-7-2008 की अधिसूचना सं. 90/2008- सीमा- शुल्क के तहत केन्द्र सरकार द्वारा अनंतिम पाटनरोधी शुल्क लगाया गया था । दिनांक 17-2-2009 की अधिसूचना सं. 14/8/2007/डीजीएडी के तहत अंतिम जांच परिणाम जारी किए गए थे और 15-5-2009 की अधिसूचना सं. 50/2009-सीमा शुल्क के तहत निश्चयात्मक शुल्क लगाया गया था ।
शामिल निर्यातक
3. वर्तमान जांच कैथोड रे कलर पिक्चर ट्यूब और मै. मेरीडियन सोलर एंड डिस्प्ले कं. लि. (कोरिया गणराज्य के उत्पादक/ निर्यातक) जिन्होंने यथासंशोधित सीमा शुल्क टैरिफ अधिनियम, 1975 के अनुसार आवेदन प्रस्तुत किया है ।
नए निर्यातक के संबंध में समीक्षा की शुरुआत
4. सीमा- शुल्क टैरिफ ( संशोधन ) अधिनियम, 1995 और इसके अंतर्गत बनाए गए नियमों के अनुसार प्राधिकारी के लिए प्रश्नगत निर्यातक देश में किसी निर्यातक अथवा उत्पादक के लिए अलग-अलग पाटन मार्जिन निर्धारित करने के प्रयोजनार्थ समीक्षा करना अपेक्षित है जिसने कोरिया गणराज्य से कैथोड रे कलर पिक्चरट्यूब के आयातों से संबंधित पाटनरोधी जांच के पहले मामले की जांच अवधि के दौरान भारत को संबद्ध वस्तु का निर्यात न किया हो और आवेदक पाटनरोधी शुल्क लगाए जाने वाले निर्यातक देश में किन्ही निर्यातकों अथवा उत्पादकों से संबंधित नहीं हो ।

5. प्राधिकारी पाटनरोधी नियमावली के नियम 22 के अंतर्गत यथानिर्धारित शर्तों से प्रथम दृष्ट्या संतुष्ट होने के बाद मै. मेरीडियन सोलर एंड डिस्प्ले कं. लि. ( कोरिया गण. के उत्पादक/निर्यातक ) द्वारा किए गए अनुरोध के अनुसार दिनांक 17-2-2009 की अधिसूचना सं..14/8/2007 -डीजीएडी के तहत प्राधिकारी द्वारा की गई सिफारिशों के अनुसरण में तथा दिनांक 15-5-2009 की अधिसूचना सं. 50/2009- सीमा-शुल्क को ध्यान में रखते हुए , केन्द्र सरकार द्वारा लगाए गए पाटनरोधी शुल्क की समीक्षा करने का निर्णय लेते हैं ।
6. न्यूशिपर समीक्षा की शुरुआत करने का निर्णय लेने के बाद 17-2-2009 की अधिसूचना सं. 14/8/2007 - डीजीएडी के तहत अधिसूचित अंतिम जांच परिणाम की कोरिया गणराज्य से कैथोड रे कलर पिक्चर ट्यूब के आयात के बारे में समीक्षा किए जाने की आवश्यकता है, प्राधिकारी पाटनरोधी नियमावली के अनुसार मै. मेरीडियन सोलर एंड डिस्प्ले कं. लि. ( कोरिया गण . के उत्पादक/निर्यातक ) के संबंध में अलग पाटन मार्जिन निर्धारित करने के लिए एतद्वारा जांच प्रारंभ करते हैं ।
7. प्राधिकारी पाटनरोधी नियमावली के नियम 22 के अनुसार और दिनांक 15-5-2009 की अधिसूचना सं. 50/2009 -सीमा- शुल्क को ध्यान में रखते हुए इस समीक्षा के पूरा होने तक मै. मेरीडियन सोलर एंड डिस्प्ले कं. लि. ( कोरिया गण. के उत्पादक/ निर्यातक ) द्वारा किए गए कैथोड रे कलर पिक्चर ट्यूब के सभी निर्यातों पर अनंतिम मूल्यांकन की सिफारिश करते हैं ।
जांच अवधि
8. वर्तमान समीक्षा के प्रयोजनार्थ जांच की अवधि । जुलाई , 2009 से 31 दिसम्बर , 2009 ( 6 महीने ) है ।
सूचना प्रस्तुत करना
9. हितबद्ध पक्षकारों को अलग से सूचित किया जा रहा है ताकि वे निर्धारित प्रारूप में और ढंग से संबंधित सूचना प्रस्तुत कर सकें और विनिर्दिष्ट प्राधिकारी , पाटनरोधी एवं संबद्ध शुल्क महानिदेशालय , वाणिज्य एवं उद्योग मंत्रालय वाणिज्य विभाग , भारत सरकार , उद्योग भवन , नई दिल्ली -110011 को अपने विचारों से अवगत करा सकें । कोई अन्य हितबद्ध पक्षकार भी नीचे निर्धारित समय-सीमा के भीतर निर्धारित प्रारूप में और ढंग से उक्त प्राधिकारी को जांच से संबंधित अपने निवेदन प्रस्तुत कर सकते हैं ।
समय सीमा
10. इस समीक्षा से संबंधित सूचना लिखित में भेजी जानी चाहिए ताकि वह जांच अवधि पूरी होने की तारीख से 40 दिनों के भीतर उपर्युक्त पते पर प्राधिकारी के पास पहुँच सके । यदि निर्धारित समय सीमा के भीतर सूचना प्राप्त नहीं होती है अथवा अधूरी सूचना प्राप्त होती है तो प्राधिकारी उपर्युक्त नियमों के अनुसार अपने पास उपलब्ध तथ्यों के आधार पर अपने जांच परिणाम दर्ज कर सकते हैं ।
सार्वजनिक फाइलों का निरीक्षण
11. पाटनरोधी नियमावली के नियम 6 ( 7 ) के अनुसार कोई हितबद्ध पक्षकार अन्य हितबद्ध पक्षकारों द्वारा प्रस्तुत साक्ष्य के अगोपनीय रूपांतर की सार्वजनिक फाइल का निरीक्षण कर सकता है ।

12. सभी हितबद्ध पक्षकार उक्त नियमों के नियम 7 ( 1 ) के अनुसार उपलब्ध कराई गई गोपनीय सूचना के लिए नियम 7 (2 ) के अनुसार अगोपनीय सारांश उपलब्ध कराएंगे ।
13. ऐसे मामलों में जहां हितबद्ध पक्षकार उचित अवधि के भीतर आवश्यक सूचना देने से इंकार करते हैं अथवा अन्य प्रकार से सूचना उपलब्ध नहीं कराते हैं अथवा जांच में अत्यधिक बाधा डालते हैं तो प्राधिकारी अपने पास उपलब्ध तथ्यों के आधार पर अपने जांच परिणाम दर्ज कर सकते हैं और केन्द्र सरकार को ऐसी सिफारिश कर सकते हैं जिन्हें वे उचित समझते हैं ।

New Shipper Reviw Initiation
Subject:-Initiation of New Shipper Review (under Rule 22) of Anti -Dumping duty imposed on imports ofCathode Ray Colour Picture Tubes from Korea RP requested by M/s . Meridian Solar & Display Company Ltd. (Producer/ Exporter from Korea RP) .
No. 15/10/2009 DGAD.M/s . Meridian Solar & Display Company Ltd. (Producer /Exporter from Korea RP). has filed an application in accordance with the Customs Tariff Act , 1975 as amended and Customs Tariff (Identification, Assessment and Collection of Anti- Dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995 before the Designated Authority (hereinafter referred to as the Authority) requesting for a review of the anti - dumping duty recommended by the Designated Authority on exports of Cathode Ray Colour Picture Tubes (hereinafter referred to as subject goods ) from Korea RP in the original anti - dumping investigation where the Central Government has notified the anti- dumpingduty vide Notification No.50/2009-Customs dated 15-5-2009 , falling under Chapter 85 of Customs TariffAct .
2.TheAuthority had notified the preliminary findings concerning imports of Cathode Ray Colour Picture Tubes from Thailand , Malaysia, China PR and Korea RP vide Notification No. 14/8 /2007-DGAD dated 7th May, 2008 and provisional anti - dumping duty was imposed by the Central Government vide Notification No. 90/2008 - Customs dated 24th July, 2008. Final findings were issued vide notification No. 14/ 8/2007 - DGAD , dated the 17th February , 2009 and definitive anti- dumping duty was imposed vide NotificationNo. 50/2009-Customs dated 15-5-2009 .

Exporter Involved
Period of Investigation
9. The period of investigation for the purpose ofthe present review is 1st July, 2009-31st December , 2009 . (6months).
Submission of Information
4. The present investigations relate to exports of Cathode Ray Colour Picture Tubes and M/s . Meridian Solar & Display Company Ltd. (Producer/Exporter from Korea RP) who has filed an application in accordance with the Customs Tariff Act, 1975 as amended.
Initiation of review in respect of new Exporter
10. The interested parties are being informed separately to enable them to submit relevant information in the form and manner prescribed and to make their views known to the Designated Authority, Directorate General ofAnti -Dumping & Allied Duties, Department of Commerce, Ministry ofCommerce and Industry, Government of India, Udyog Bhavan, New Delhi - 110011 . Any other interested party may also make its submissions relevant to the investigation to the above Authority in the prescribed form and manner within the time limit set out below .
Time Limit
5. The Customs Tariff (Amendment) Act , 1995 and theRules madethereunder require the Authority to review for the purpose of determining individual margin of dumping for any exporter or producer in the exporting country in question who has not exported the subject goods to India during the period of investigation of the earlier case of anti-dumping investigation concerning imports of Cathode RayColour Picture Tubes from Korea RP and applicants is not related to any of the exporters and producers in the exporting country who are subjected to anti -dumping duty .
11.All information relating to this review should be sent in writing so as to reach the Authority at the above address not later than forty days from the date of completion of period of investigation . If no information is received withinthe prescribed time limit or the information received isincomplete , the Authority may record its findings on the basis of the facts available before the Authority in accordance with the Rules Supra.
Inspection of Public File
6. The Authority having been prima facie satisfied withthe conditions as prescribed under Rule 22 ofAnti- Dumping Rules , decides to review the Anti- Dumping duty imposed by the Central Government in pursuance of the recommendations made by the Authority vide Notification No. 14/8/2007 - DGAD , dated the 17th February , 2009 , and having regard to Notification No. 50/2009-Customs dated 15-5-2009, as requested by M/ s .Meridian Solar & Display CompanyLtd.(Producer Exporter from Korea RP) .
12. In terms of Rule 6(7) of Anti- Dumping Rules , any interested party may inspect the public file containing non- confidential version of the evidence submitted by other interested parties.
13.All interested parties shall provide a confidential summary in terms of Rule 7(2) , for the confidential information provided as per Rule 7 ( 1 ) of the rules supra .
7.Having decided to initiate New Shipper review, the final findings notified vide Notification No. 14/8/2007- DGAD, dated the 17th February, 2009 need to be reviewed with regard to import of Cathode Ray Colour Picture Tubes from Korea RP, the Authority hereby initiates investigations to determine separate dumping margin in respect ofM/ s . Meridian Solar & Display Company Ltd. (Producer/ Exporter from KoreaRP).
14. In case whereas interested party refuses access to, or otherwise does not provide necessary information within a reasonable period, or significantly impedes the investigation, the Authority may record its findings on the basis of the facts available to the Authority and make such recommendations to the Central Government as deemed fit.
R. GOPALAN, Designated Authority 8. The Authority recommends provisional assessment on all exports of Cathode Ray Colour Picture Tubes made by M/ s . Meridian Solar & Display Company Ltd. (Producer/Exporter from Korea RP) of subject goods , till this review is completed, in accordance with the Rule 22 of the Rules Supra and having regard to Notification No. 50/2009 -Customs dated 15-5-2009.
