सा.का.नि. 828(अ).-केंद्रीय सरकार, रेल दावा अधिकरण अधिनियम , 1987 ( 1987 का 54) की धारा 30 की उप- धारा ( 2 ) के खंड ( ख ) के साथ पठित उप- धारा ( 1 ) और धारा 30 ( क ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, रेल दावा अधिकरण ( अध्यक्ष, उपाध्यक्ष और सदस्यों का वेतन और भत्ता तथा सेवा की शर्तें ) नियम , 1989 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:-
1. (1 ) इन नियमों का संक्षिप्त नाम रेल दावा अधिकरण ( अध्यक्ष , उपाध्यक्ष और सदस्यों का वेतन और भत्ता तथा सेवा की शर्तें ) संशोधन नियम , 2009 है ।
(2 ) ये 1 जनवरी , 2006 से प्रवृत्त हुए समझे जाएंगे ।
2. रेल दावा अधिकरण ( अध्यक्ष, उपाध्यक्ष और सदस्यों का वेतन और भत्ता तथा सेवा की शर्तें ) नियम , 1989 के नियम 8 में उप-नियम ( 2 ) के स्थान पर निम्नलिखित उप - नियम रखा जाएगा , अर्थात्:-
" (2) उप - नियम ( 1 ) के अधीन पेंशन , सेवा के प्रत्येक पूरे वर्ष के लिए चौदह हजार पांच सौ बत्तीस रु. प्रति वर्ष की दर से संगणित की जाएगी किंतु यह इस शर्त के अधीन होगी कि इस नियम के अधीन संदेय पेंशन की कुल रकम , ऐसी किसी पेंशन की रकम सहित जिसके अंतर्गत ऐसी पेंशन , यदि कोई हो, का सारांशित भाग भी है, जो अधिकरण में पद धारण करते हुए प्राप्त किया गया है या जिसे प्राप्त करने का वह हकदार है , चार लाख अस्सी हजार रुपए प्रतिवर्ष से अधिक नहीं होगी । "

स्पष्टीकारक ज्ञापन
केंद्रीय सरकार ने , केंद्रीय सरकार के कर्मचारियों की पेंशन के संबंध में छठे केंद्रीय वेतन आयोग की सिफारिशों को कार्यान्वित करने की दृष्टि से 1 जनवरी , 2006 से अध्यक्ष , उपाध्यक्ष और सदस्यों की पेंशन को पुनरीक्षित करने का विनिश्चय किया है । यह प्रमाणित किया जाता है कि रेल दावा अधिकरण के किसी भी अध्यक्ष, उपाध्यक्ष और सदस्यों पर प्रस्तावित संशोधन को भूतलक्षी रूप से प्रभावी करने से प्रतिकूल प्रभाव पड़ने की संभावना नहीं है ।

NOTIFICATION
New Delhi , the 12th November, 2009
G.S.R. 828 ( E ). In exercise of the powers conferred by sub- section ( 1 ) read with clause (b) of sub - section (2) of Section30 and Section 30A ofthe Railway Claims Tribunal Act, 1987 (54 of 1987), the Central Government hereby makes the following rules further to amend the Railway Claims Tribunal (Salaries and Allowances and Conditions of Services of Chairman, Vice-Chairman and Members) Rules , 1989, namely:-
1.( 1) These rules may be called the Railway Claims Tribunal (Salaries and Allowances and Conditions ofServices ofChairman, Vice- Chairman and Members) Amendment Rules , 2009 .
(2) They shall be deemed to have come in force with effect from the 1st day of January , 2006 .
2. In the Railway Claims Tribunal ( Salaries and Allowances and Conditions of Services of Chairman , Vice- Chairman and Members ) Rules , 1989, in rule 8 , for sub -rule (2) , the following sub -rule shall be substituted, namely :-
"(2) Pension under sub - rule ( 1 ) shall be calculated at the rate ofrupees fourteen thousand five hundred and thirty two per annum for each completed year of service subject to the condition that the aggregate amount of pension payable under this rule , together with the amount of any pension including commuted portion of pension , if any , drawn or entitled to be drawn while holding office in the Tribunal shall not exceed rupees four lakh eighty thousand per annum ."

EXPLANATORY MEMORANDUM
With a view to implement the recommendations ofthe Sixth Central Pay Commission regarding Central Government Employees' pension, the Central Government has decided to revise the pension of the Chairman , Vice-Chairman and Members with effect from the 1st day of January , 2006. It is certified that no Chairman , Vice-Chairman and Member ofthe Railway Claims Tribunal is likely to be affected adversely by the proposed amendment being given retrospective effect .
