का.आ. 2936(अ).-यतः, मै. कार्बोरन्डम यूनिवर्सल लिमिटेड, जो केरल राज्य में एक निजी संगठन है , ने केरल राज्य में ग्राम थ्रिक्काकरा नोर्थ , तालुक कनयानूर , जिला अर्णाकुलम में सौर- प्रकाश उर्जा क्षेत्र के लिए एक क्षेत्र विशिष्ट विशेष आर्थिक जोन की स्थापना हेतु विशेष आर्थिक जोन अधिनियम, 2005 (2005 का 28 ) , (जिसे एतपश्चात् उक्त अधिनियम कहा गया है ) की धारा 3 के अंतर्गत प्रस्ताव किया है;
(ii ) केन्द्रीय सरकार , एतद्वारा उक्त अधिनियम की धारा 14 की प्रयोजनार्थ उपर्युक्त विशेष आर्थिक जोन के लिए एक समिति , जिसे अनुमोदन समिति कहा जाएगा , गठित करती है , जिसके अध्यक्ष और सदस्य निम्नानुसार हैं , अर्थात्:-
1. विशेष आर्थिक जोन का विकास आयुक्त -अध्यक्ष, पदेन
2. निदेशक अथवा उप - सचिव , भारत सरकार , सदस्य, पदेन और, यतः , केन्द्र सरकार , इस बात से संतुष्ट है कि उक्त अधिनियम की धारा 3 की उप- धारा ( 8 ) के अंतर्गत अपेक्षाओं तथा अन्य संबंधित अपेक्षाओं को पूरा कर लिया गया है और उसने उपर्युक्त विशिष्ट विशेष आर्थिक जोन के विकास , प्रचालन एवं रख - रखाव हेतु उक्त अधिनियम की धारा 3 की उप- धारा ( 10 ) के अंतर्गत दिनांक 27 फरवरी , 2009 को अनुमोदन पत्र प्रदान कर दिया है ;
वाणिज्य एवं उद्योग मंत्रालय , वाणिज्य विभाग या उसका नामिती जिसका स्तर अवर सचिव , भारत सरकार से कम नहीं होगा
-सदस्य, पदेन अतः , अब , विशेष आर्थिक जोन अधिनियम , 2005 की धारा 4 की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और विशेष आर्थिक जोन नियम, 2006 के नियम 8 के अनुसरण में :-
* 3. विशेष आर्थिक जोन पर भू- भागीय क्षेत्राधिकार रखने वाला क्षेत्रीय संयुक्त विदेश व्यापार महानिदेशक :
-सदस्य, पदेन (i ) केन्द्र सरकार , एतद्वारा निम्नलिखित तालिका में उल्लिखित सर्वेक्षण संख्या और क्षेत्र को एक विशेष आर्थिक जोन के रूप में अधिसूचित करती है , अर्थात्:--
4. विशेष आर्थिक जोन पर भू- भागीय क्षेत्राधिकार रखने वाले सीमा शुल्क आयुक्त या केन्द्रीय उत्पाद शुल्क आयुक्त अथवा उनका नामिति जिसका स्तर संयुक्त आयुक्त से कम नहीं होगा

-सदस्य , पदेन 5. विशेष आर्थिक जोन पर भू- भागीय क्षेत्राधिकार रखने वाले आयकर आयुक्त अथवा उसका नामिती जिसका स्तर संयुक्त आयुक्त से कम नहीं होगा
-सदस्य, पदेन 6. निदेशक ( बैंकिंग ) , वित्त मंत्रालय , बैंकिंग प्रभाग , भारत सरकार
-सदस्य, पदेन 7. केरल सरकार द्वारा नामित किए जाने वाले दो अधिकारी जिनका स्तर संयुक्त सचिव से कम नहीं होगा
विशेष आमंत्रिती 8. मै. कार्बोरन्डम यूनिवर्सल लिमिटेड (जोन के विकासकर्त्ता ) का प्रतिनिधि
( iii ) केन्द्र सरकार , एतद्वारा , दिनांक 17 नवम्बर , 2009 को उस तारीख के रूप में निर्धारित करती है , जिस तारीख से उक्त क्षेत्र विशिष्ट विशेष जोन को सीमा शुल्क अधिनियम , 1962 ( 1962 का 52 ) की धारा 7 के अंतर्गत अंतर्देशीय कंटेनर डिपो माना जाएगा ।

NOTIFICATION
New Delhi , the 17th November, 2009
S.O. 2936 ( E ) .- Whereas , M/ s . Carborundum Universal Limited , a private organization in the State of Kerala , has proposed under Section 3 of the Special Economic Zones Act , 2005 (28 of2005) , ( hereinafter referred to as the said Act) ,to set up a sector specific Special Economic Zone for Solar Photovoltaic sector at village Thrikkakara North , Taluka Kanayannur . District Ernakulam in the State of Kerala;
And, whereas , the Central Government is satisfied , thatrequirements under sub - section ( 8 ) of Section 3 of the said Act, and other related requirements are fulfilled and it has granted letter of approval under sub - section ( 10) of Section 3 of the said Act for development , operation and maintenance of the above Special Economic Zone on 27th February, 2009;
Now, therefore, in exercise of the powers conferred by sub - section ( 1 ) of Section 4 of the Special Economic Zones Act , 2005 and in pursuance of rule 8 of the Special Economic Zones Rules , 2006:--
(i) the Central Government hereby notifies the following survey number and the area given below in the table , as a Special Economic Zone , namely: ---

( ii ) the Central Government hereby also constitutes a Committee to be called the Approval Committee for the above sector specific Special Economic Zone for the purposes of Section 14 of the said Act consisting of the following Chairperson and Members , namely:--
1. Development Commissioner of the Special Economic Zone --Chairperson ex-officio
-Member, ex -officio 2. Director or Deputy Secretary to the Government of India , Ministry of Commerce and Industry, Department of Commerce or his nominee not below the rank of Under Secretary to the Government of India
Member, ex-officio 3. Zonal Joint Director General of Foreign Trade , having territorial jurisdiction over the Special Economic Zone
--Member , ex-officio 4. Commissioner of Customs or Central Excise having territorial jurisdiction over the Special Economic Zone or his nominee not below the rank of Joint Commissioner
5. Commissioner of Income Tax having territorial jurisdiction over the Special Economic Zone or his nominee not below the rank of Joint Commissioner --Member, ex-officio
6. Director (Banking) in the Ministry -Member , of Finance Banking Division , Government of India ex-officio
Members , ex-officio 7. Two officers , not below the rank of Joint Secretary , to be nominated by the Government of Kerala
8. Representative of M/ s . Carborun- -Special dum Universal Limited (Developer of the zone) Invitee
( iii ) the Central Government hereby also appoints the 17th day of November , 2009 as the date from which the above sector specific Special Economic Zone shall be deemed to be Inland Container Depot under Section 7 of the Customs Act , 1962 ( 52 of 1962 ) .
