ORDER
आदेश नईदिल्ली, 20 नवम्बर, 2009
New Delhi , the 20th November, 2009 का.आ. 2960(अ). अतः संयुक्त सचिव , भारत सरकार जिन्हेंविदेशी मुद्रा संरक्षण और तस्करी निवारण अधिनियम, 1974 (1974 का 52) की धारा 3 की उप- धारा ( 1 ) के अन्तर्गत विशेष रूप से शक्ति प्रदान की गई है , ने उक्त उप- धारा के अधीन आदेश फा. सं. 673/02/2009-सी. शु. VIII , दिनांक 23-9-2009 को जारी किया और यह निर्देश दिया कि श्री राज कुमार अग्रवाल उर्फ मुन्ना, एसयू-184 , जीएफ , पार्क सिटी होटल के निकट, पीतमपुरा , नई दिल्ली को निरुद्ध कर लिया जाए और केन्द्रीय कारागार, तिहाड़ , नई दिल्ली में अभिरक्षा में रखा जाए ताकि उन्हें भविष्य में विदेशी मुद्रा संरक्षण और संवर्धन में किसी प्रकार के प्रतिकूल कार्य करने से रोका जासके ।
S.O. 2960(E ).-Whereas , the Joint Secretary to the Government of India , specially empowered under sub-section ( 1 ) of Section 3 ofthe Conservation of Foreign Exchange and Prevention of Smuggling Activities Act, 1974. (52 of1974) issued order F. No. 673/02/2009-Cus . VIII , dated 23-9-2009 under the said sub - section directing that Shri Raj Kumar Aggarwal @ Munna , R/ o - SU - 184 , G.F. , Near Park Citi Hotel , Pitampura , New Delhi, be detained and kept incustody in Central Jail , Tihar , New Delhi with a view to preventing him from acting in any manner prejudicial to the conservation and augmentation of foreign exchange in future.
2. अतः केन्द्रीय सरकार के पास यह विश्वास करने का कारण है कि पूर्वोक्त व्यक्ति फरार हो गया है या स्वयं को छिपा रखा है जिससे यह आदेश निष्पादित नहीं किया जा सकता ।
2. Whereas , the Central Government has reasons to believe that the aforesaid person has absconded or has been concealing himself so that the order cannot be executed.
3. अतः , अब, उक्त अधिनियम की धारा 7 की उप - धारा ( 1 ) के खण्ड ( ख ) द्वारा प्रदत्त शक्ति का प्रयोग करते हुए केन्द्रीय सरकार एतद्वारा पूर्वोक्त व्यक्ति को यह निर्देश देती है कि वह शासकीय राजपत्र में इस आदेश के प्रकाशित होने के 7 दिन के भीतर पुलिस आयुक्त, दिल्ली के सम्मुख उपस्थित हो ।
3. Now, therefore , in exercise ofthe powers conferred by Clause (b) of sub-section ( 1 ) of Section 7 of the said Act, the Central Government hereby directs the aforesaid perosn to appear before the Commissioner ofPolice , Delhi within7 days ofthe publication ofthis order in the Official Gazette.
