का.आ. 2961 (अ). अतः संयुक्त सचिव , भारत सरकार जिन्हें विदेशी मुद्रा संरक्षण और तस्करी निवारण अधिनियम , 1974 (1974का 52)की धारा 3 की उप- धारा ( 1 ) के अन्तर्गत विशेष रूप से शक्ति प्रदान की गई है , ने उक्त उप- धारा के अधीन आदेश फाइल सं. 673/03/2009-सी. शु. VIII दिनांक 23-9-2009 को जारी किया और यह निर्देश दिया कि श्री मुरलीधर उर्फ़ कन्हया जैन उर्फ राजू भाई उर्फ मुरली , ( 1 ) 2904/19 , प्रथम स्थल , हनुमान मार्किट , रुई मंडी, सदर बाजार, नई दिल्ली; ( 2 ) भोपालगढ़ , नई बस डिपो (बस अड्डा) , जिला-जोधपुर , राजस्थान को निरुद्ध कर लिया जाए और केन्द्रीय कारागार , तिहाड़, नई दिल्ली में अभिरक्षा में रखा जाए ताकि उन्हें भविष्य में विदेशी मुद्रा संरक्षण और संवर्धन में किसी प्रकार के प्रतिकूल कार्य करने से रोका जा सके ।
2. अतः केन्द्रीय सरकार के पास यह विश्वास करने का कारण है कि पूर्वोक्त व्यक्ति फरार हो गया है या स्वयं को छिपा रखा है जिससे यह आदेश निष्पादित नहीं किया जा सकता ।
3. अतः अब उक्त अधिनियम की धारा 7 की उप- धारा ( 1 ) के खण्ड ( ख) द्वारा प्रदत्त शक्ति का प्रयोग करते हुए केन्द्रीय सरकार एतद्वारा पूर्वोक्त व्यक्ति को यह निर्देश देती है कि वह शासकीय राजपत्र में इस आदेश के प्रकाशित होने के 7 दिन के भीतर पुलिस आयुक्त, दिल्ली व पुलिस महानिदेशक , राजस्थान के सम्मुख उपस्थित हो ।

ORDER
New Delhi , the 20th November , 2009
S.O. 2961 (E). Whereas the Joint Secretary to the Government of India, specially empowered under sub- section ( 1 ) of Section 3 of the Conservation of Foreign Exchange and Prevention ofSmuggling Activities Act, 1974 (52of1974) issued order F. No. 673/03/2009-Cus . VIII, dated 23-9-2009 under the said sub - section directing that Shri Murlidhar @ Kanhaya Jain @ Rajubhai @ Murli , R/ o-( i ) 2904/19 , 1st Floor , Hanuman Market, Rui Mandi , Sadar Bazar , New Delhi ; (ii ) Bhopalgarh , New Bus Depot (BusAdda) , District Jodhpur, Rajasthan , be detained and kept in custody in Central Jail , Tihar , New Delhi with a view to preventing him from acting in any manner prejudicial to the conservation and augmentation -of foreign exchange in future.
2. Whereas the Central Government has reasons to believe that the aforesaid person has absconded or has been concealing himself so that the order cannot be executed.
3. Now, therefore , in exercise of the powers conferred by clause (b) of sub- section ( 1 ) of Section 7 of the said Act, the Central Government hereby directs the aforesaid person to appear before the Commissioner of Police , Delhi or the Director General ( Police) , Government of Rajasthan, Jaipur within 7 days of the publication of this order in the Official Gazette.
