सं. टीएएमपी/33/2003 - एनएमपीटी. महापत्तन न्यास अधिनियम , 1963 ( 1963 का 38 ) की धारा 49 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, महापत्तन प्रशुल्क प्राधिकरण , एतद्वारा न्यू मंगलौर पत्तन न्यास द्वारा दीर्घ अल्पकालिक शर्तों के आधार पर पट्टे पर दी गई भूमि कीसाक्षेप में पट्टे किराये की वैधतां को संलग्न आदेशानुसार विस्तारित करता है ।

(अक्तूबर , 2009 के 23 वें दिन पारित )
न्यूमंगलौर पत्तन न्यास द्वारा दीर्घ अल्पकालिक शर्तों के आधार पर आबंटित भू- खण्ड के पट्टे- किराये अंतिम बार इस प्राधिकरण ने 20जनवरी , 2005 को संशोधित किए थे । इस प्राधिकरण द्वारा अनुमोदित पट्टे किराये 19 फरवरी , 2007 तक वैध थे ।
2. दर की वैधता को समय - समय पर विस्तारित किया गया था और अंतिमबार , इसे 31 अक्तूबर , 2009 तक या प्राधिकरण के आदेश दिनांक 28 जुलाई , 2009 के द्वारा प्रस्ताव पर पारित आदेश की कार्यान्वयन के प्रभावी तिथि तक , इसमें से जो पहले हो विस्तारित किया गया था ।
3. एनएनपीटी अपने पत्र दिनांक 15 अक्तूबर , 2009 के द्वारा प्रचलित पट्टे- किराये को नई दरमान की अनुमोदन देने वाली तिथि तक जारी रखने के लिए अनुरोध किया है ।
4. प्रस्ताव की प्रारम्भिक सूक्ष्म परीक्षण के दौरान पत्तन से प्राप्त की गई स्पष्टीकरण/ अतिरिक्त सूचनाएँ परीक्षाधीन हैं । चूँकि प्रचलित पट्टे-किराये की वैधता 31 अक्तूबर, 2009 को समाप्त होती है । मामले को अंतिम निर्णय देने के पहले लगने वाले समय को ध्यान में रखते हुए , यह प्राधिकरण प्रचलित पट्टे- किराये की वैधता को 31 मार्च, 2010 तक या अनुमोदित होने वाली पट्टे- किराये की कार्यान्वयन के प्रभावी तिथि से इसमें से जो भी पहले हो तक विस्तारित करता है ।

NOTIFICATION
Mumbai , the 24th November, 2009
No. TAMP/33 /2003 - NMPT .-In exercise of the powers conferred by Section 49 of the Major Port Trusts Act,. 1963 (38 of 1963 ) , the Tariff Authority for Major Ports hereby extends the validity of lease rentals in respect of land leased by the New Mangalore Port Trust on long/short term basis as in the Order appended hereto.

(Passed on this the 23rd day of October , 2009)
The lease rental of the lands allotted by the New Mangalore Port Trust ( NMPT) on long term/ short term basis were last revised by this Authority on 20th January . 2005. The lease rentals approved by this Authority were valid upto 19th February, 2007 .
2. The validity of the rates was extended from time to time , and it was extended till 31st October, 2009 or till the effective date of implementation of the Order to be passed by this Authority, whichever is earlier vide Order dated 28th July, 2009.
3. The NMPT vide its letter dated 15th October , 2009 has requested to allow the existing lease rentals to continue till the new SOR is approved.
4. On preliminary scrutiny of the proposal, clarifications / additional information were obtained from the port, which are under examination . Since the validity of the existing lease rentals expires on 31st October, 2009 and recognizing the time required for finalizing the case , this Authority extends the validity of the existing lease rentals till 31st March, 2010 or till the effective date of implementation of the revised lease rentals , whichever is earlier .
