सं. टीएएमपी/9/2006- केपीटी. महापत्तन न्यास अधिनियम , 1963 ( 1963 का 38 ) की धारा 49 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए महापत्तन प्रश्शुल्क प्राधिकरण एतद्वारा , कांडला पत्तन न्यास द्वारा आबंटित गाँधीधाम नगर की आबंटित भूमि खण्ड के किराया पट्टे की वैधता को संलग्न आदेशानुसार विस्तारित करता है ।

कांडला पत्तन न्यास ( केपीटी ) द्वारा आबंटित गांधीधाम नगर भूमि खण्ड के पट्टेदारी किराये 22 अप्रैल , 2008 को इस प्राधिकरण द्वारा अनंतिम से संशोधित किए गए थे । कथित आदेश , राजपत्र सं. 100 के माध्यम से 16 जून , 2008 को भारत के राजपत्र में अधिसूचित किया गया था । इस प्राधिकरण द्वारा अनुमोदित पट्टा किराया , जिनकी वैधता अवधि 5 वर्ष अर्थात् 31 दिसंबर , 2008 तक थी , पिछले प्रभाव, 1 जनवरी , 2004 से क्रियान्वित किए गए थे ।
2. इस प्राधिकरण ने पट्टे किरायों की वैधता पत्तन के निवेदन पर 1 जुलाई , 2009 से चार महिनों के लिए अपने आदेश दिनांक 28 जुलाई, 2009 के द्वारा विस्तारित की थी जो भारत के राजपत्र में अधिसूचना संख्या जी-154 के द्वारा अधिसूचित किया गया है ।
3. केपीटी के दिनांक 2 जुलाई, 2009 के पत्रानुसार भूखण्ड के मूल्य का निर्धारण करने के लिए भूखण्ड मूल्यांकक को नियुक्त किया जा रहा था जिससे छह महीनों के अंदर अपना काम पूरा कर लेने की उम्मीद थी । यद्यपि पत्तन ने प्रस्ताव दाखिल नहीं किया है , चूंकि केपीटी द्वारा आबंटित भूमि खण्ड के किराया पट्टे की वैधता 31 अक्तूबर , 2009 को समाप्त हो रही है, यह आवश्यक हों गया है कि प्रचलित पट्टे- किराया की वैधता को इस तिथि से आगे विस्तारित किया जाये । महापत्तनों की भूमि संबंधी नीति पर सरकार द्वारा जारी किये गये मार्गनिर्देशों में समझौता की शर्त है कि जब तक पट्टा किराया सक्षम अधिकारी द्वारा संशोधित नहीं किये जाते तब तक उनमें प्रति वर्ष 2 % की दर से वृद्धि होती रहेगी । अप्रैल 2008 में इस प्राधिकरण के द्वारा अनुमोदित आदेश भी सरकारी मार्गनिर्देशों के अनुसार शर्तों को निर्धारित करता है । पट्टा किरायों की वर्तमान अनुसूची भी , प्राधिकरण द्वारा दरों का संशोधन किए जाने तक, पट्टा किरायों में 2 % वार्षिक वृद्धि का प्रावधान करता है ।

4. इसलिए , यह प्राधिकरण कांडला पत्तन न्यास द्वारा आबंटित भूमि के प्रचलित पट्टे- किराये की वैधता को 1 नवंबर , 2009 से 31 मार्च , 2010 तक या केपीटी द्वारा दखिल किये जाने वाले प्रस्ताव पर अंतिम निर्णय पारित होने वाले तिथि तक , इसमें से जो भी पहले हो , विस्तारित करता है ।

NOTIFICATION
Mumbai , the 24th November , 2009
No. TAMP/9 /2006- KPT .In exercise of the powers conferred by Section 49 of the Major Port Trusts Act , 1963 (38 of 1963 ) , the Tariff Authority for Major Ports hereby extends the validity of the lease rentals of the Gandhidham Township Lands allotted by the Kandla Port Trust as in the Order appended hereto .

The lease rentals of the Gandhidham Township lands allottedby the Kandla Port Trust ( KPT) were revised provisionally by this Authority on 22nd April , 2008. The said Order was notified in the Gazette of India on 16th June , 2008 vide Gazette No. 100. The lease rentals approved by this Authority were implementable with retrospective effect from 1st January, 2004 with a validity period of five years , i.e. upto 31st December , 2008 .
2. At the request of the port this Authority extended the validity of the lease rentals for a period of four months from 1st July, 2009 by Order dated 28th July, 2009 which is notified in the Gazette of India on 22nd August, 2009 vide G.No. 154 .
3. KPT vide its letter dated 2nd July, 2009 informed that a land valuer was being appointed for ascertaining the value of land and the work was expected to be completed within six months . Although the port has not filed a proposal , since the validity of the existing lease rentals for lands allotted by KPT expires on 31st October , 2009 , it is necessary to extend the validity of the existing lease rentals beyond that date . The guidelines issued by the Government on land policy ofmajor ports stipulate that the lease rentals shall be escalated by 2% per annum till they are revised by the Competent Authority. The Order approved by this Authority in April 2008 also prescribes this condition in terms with the Government guidelines . The existing Schedule of lease rentals already provide for an annual escalation of 2 % in the lease rentals till the rates are revised by this Authority.
4. This Authority, therefore , extends the validity of the existing lease rentals for land allotted by the Kandla Port Trust from 1st November , 2009 till 31st March, 2010 or till final disposal of the proposal (to be ) filed by the KPT, whichever isearlier.
