सं. टीएएमपी/42/2005-एनएमपीटी. महापत्तन न्यास अधिनियम, 1963 ( 1963 का 38 वां ) की धारा 48 , 49 और 50 के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, महापत्तन प्रशुल्क प्राधिकरण एतद्वारा , न्यू मंगलौर पत्तन न्यास के प्रचलित दरमान की वैधता को संलग्न आदेशानुसार विस्तारित करता है ।

न्यूमंगलौर पत्तन न्यास ( एनएमपीटी ) के वर्तमान प्रचलित दरमान को इस प्राधिकरण ने दिनांक 11 मई, 2006 को पिछली बार दिनांक 11 मई , 2006 के आदेश संख्या टीएएमपी/42/2005 - एनएमपीटी द्वारा अनुमोदित किया था । आदेश के साथ दरमान को भी भारत के राजपत्र में 13 जून , 2006 को राजपत्र संख्या 99 द्वारा प्रकाशित किया गया था । अनुमोदित दरमान की वैधता को 31 मार्च , 2009 तक निर्धारित कीगई थी ।
2. इस प्राधिकरण ने दिनांक 17 जून , 2009 के अपने आदेश द्वारा एनएमपीटी के वर्तमान प्रचलित दरमान की वैधता को 30 सितम्बर , 2009 तक, इस शर्त पर विस्तारित किया था कि 01 अप्रैल , 2009 के बाद वाली अवधि में स्वीकार लागत और अनुमय प्रतिलाभ से अधिक प्रोद्भूत अधिशेष को निर्धारित किए जाने वाले प्रशुल्क में पूर्णरूपेण समायोजित किया जाएगा । यह आदेश दिनांक 20 जून, 2009 को भारत के राजपत्र में राजपत्र संख्या 107 के द्वारा अधिसूचित किया गया था ।
3. अब एनएमपीटी ने रजिस्टर्ड कार्गो हैंडलिंग विंग ( आर.सी. एच. डब्ल्यू) और व्यवसाय पूर्वानुमान से आय व्यय को प्रतिबिम्बित करने में आ रही कुछ कठिनाइयाँ व्यक्त की हैं और उसने दरमान के सामान्य संशोधन के प्रस्ताव को दाखिल करने हेतु 31 दिसम्बर , 2009 तक का समय मांगा है । इसी बीच अपने प्रचलित दरमान की वैधता को 31 मार्च , 2010 तक या संशोधित दरमान की अधिसूचना तिथि तक इसमें से जो भी पहले हो तक विस्तारित करने का अनुरोध किया है ।

4. एनएमपीटी की प्रस्तुतियों को ध्यान में रखते हुए और यह समझते हुए कि प्रचलित दरमान की वैधता 30 सितम्बर , 2009 को समाप्त हो रही है , यह प्राधिकरण एनएमपीटी के प्रचलित दरमान की वैधता को, एनएमपीटी को इस निदेश के साथ , 31 मार्च , 2010 तक विस्तार प्रदान किया है कि वह अपने दरमान के सामान्य संशोधन के लिए प्रस्ताव अधिकतम 31 दिसम्बर , 2009 तक दाखिल कर दें ।
5. यदि 01 अप्रैल , 2009 के बाद वाली अवधि में स्वीकार्य लागत और अनुमेय प्रतिलाभ से अधिक कोई अतिरिक्त अधिशेष उभरता है तो उसे निर्धारित किए जाने वाले प्रशुल्क में पूर्णरूपेण समायोजित किया जाएगा ।

TARIFF AUTHORITY FOR MAJOR PORTS
NOTIFICATION
Mumbai , the 24th November 2009
No. TAMP/42/2005 - NMPT . In exercise of the powers conferred under Sections 48 , 49 and 50 of the Major PortTrusts Act , 1963 (38 of 1963 ) , the Tariff Authority for Major Ports hereby extends the validity of the existing Scale of Rates at the New Mangalore Port Trust as in the Order appended hereto.
TARIFF AUTHORITY FOR MAJOR PORTS
Case No. TAMP/42/2005 - NMPT ORDER (Passed on this the 23rd day of October, 2009)
The existing Scale of Rates (SOR) of the New Mangalore Port Trust (NMPT ) was last approved by this Authority vide Order No. TAMP/42 /2005 - NMPT dated 11th May, 2006. The Order along with the SOR was published in the Gazette of India on 13th June , 2006 vide Gazette No. 99. The validity ofthe approved SOR was prescribed till 31st March, 2009 .
2. This Authority vide Order dated 17th June , 2009 had extended the validity of the existing SOR of NMPT till 30th September, 2009 subject to the condition that additional surplus , if any , over and above the admissible cost and permissible return for the period post Ist April , 2009 will be adjusted fully in the tariff to be determined . This Order was notified in the Gazette of India on 20th June , 2009 vide Gazette No. 107 .
3. The NMPT has now expressed certain difficulties in projecting the income /expenditure from Registered Cargo Handling Wing ( RCHW) and the traffic forecast and also stated that the delay in filing the proposal is beyond its control. The NMP'F has sought time upto 31st Deeember , 2009 for filing its proposal of general revision of SOR, In the meanwhile , it has requested to extend the validity of the existing SOR till 31st March , 2010 or up to the date of notification ofthe revised SOR, whichever is earlier .
4. In view of the submission made by the NMPT , and also recognising that the validity of the existing SOR expired on 30th September , 2009,this Authority extends the validity of the existing SOR ofNMPT till 31st March , 2010with adirection to the NMPT to file its proposal for general revision of its Scale of Rates latest by 31st December , 2009.
5. Additional surplus , if any, over and above the admissible cost and permissible return for the period post 1stApril , 2009 will be adjusted fully in the tariff to be determined .
