सं. टीएएमपी/27/ 2008-आईसीटीपीएल. महापत्तन न्यास अधिनियम, 1963 ( 1963 का 38 ) की धारा 48 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए महापत्तन प्रशुल्क प्राधिकरण एतद्वारा मुम्बई पत्तन न्यास पर इंदिरा कंटेनर टर्मिनल प्राइवेट लिमिटेड के प्रचालन के लिए अंतरिम प्रशुल्क व्यवस्था की वैधता को संलग्न आदेशानुसार विस्तारित करता है ।

यह प्रकरण मुम्बई पत्तन न्यास पर इंदिरा कंटेनर टर्मिनल प्राइवेट लिमिटेड के प्रचालन के लिए प्राधिकरण द्वारा अनुमोदित प्रचलित अंतरिम प्रशुल्कव्यवस्था की वैधता के विस्तार से संबंधित है ।
2. इस प्राधिकरण ने आईसीटीपीएल की अंतरिम प्रशुल्क व्यवस्था को 31 मार्च, 2009 की वैधतावाली अवधि तक आदेश संख्या टीएएमपी/27/2008 - आईसीटीपीएल दिनांक 25 नवम्बर, 2008 द्वारा अनुमोदित किया है । इस प्राधिकरण द्वारा , अंतरिम प्रशुल्क व्यवस्था की वैध ता को पिछली बार दिनांक 17 जून , 2009 को आदेश द्वारा 30 सितम्बर, 2009 तक विस्तारित किया गया था । यह आदेश राजपत्र सं. 104 द्वारा 20 जून , 2009 को अधिसूचित किया गया था ।
3. दरमान के निर्धारण के लिए आईसीटीपीएल द्वारा दाखिल प्रस्ताव को परामर्श के लिए लिया गया है । प्रचालक ने भी प्रस्ताव पर मांगी गई अतिरिक्त सूचनाएं और स्पष्टीकरण प्रस्तुत कर दी हैं ।
4. चूँकि प्रचलित अंतरिम प्रशुल्क व्यवस्था 30 सितम्बर , 2009 को समाप्त हो गई है , यह प्राधिकरण प्रकरण को निर्णय देने में लगने वाले समय को देखते हुए , आईसीटीपीएल को प्रचलित अंतरिम प्रशुल्क व्यवस्था की वैधता को 31 मार्च , 2010 तक या आईसीटीपीएल के द्वारा दाखिल प्रस्ताव पर अंतिम निपटान तक , विस्तारित करता है , इसमें जो भी पहले हो ।
5. यदि प्रचालन कार्य शुरू होने के दिन से स्वीकार्य लागत और अनुमेय प्रतिलाभ से अधिक कोई अतिरिक्त अधिशेष आईसीटीपीएल के द्वारा अर्जित किया जाता है तो उसे निर्धारित किये जाने वाले प्रशुल्क में पूरी तरह समायोजित किया जाएगा ।

NOTIFICATION
Mumbai , the 23rd November , 2009
No. TAMP/27/2008- ICTPL.- In exercise of the powers conferred under Section 48 ofthe Major Port Trusts Act , 1963 (38 of 1963 ), the Tariff Authority for Major Ports hereby extends the validity of the interim tariff arrangement for operations of the Indira Container Terminal Private Limited at Mumbai Port Trust, as in the Order appended hereto.

This case relates to the extension of the validity of the interim tariff arrangement approved by this Authority for the operations of the Indira Container Terminal Private Ltd. (ICTPL) at the Mumbai Port Trust.
2. This Authority has approved interim tariff arrangement of ICTPL vide Order No. TAMP/27 /2008- ICTPLdated 25th November , 2008 with a validity period till 3 1st March ,2009. The validity of the interim tariff arrangement was last extended by this Authority till 30th September , 2009 vide Order dated 17th June , 2009. This Order is notified in the Gazette of India on 20th June , 2009 vide Gazette No. 104 .
3. The proposal filed by the ICTPL for fixation of the SOR is taken on consultation . The operator has also furnished the additional information/clarifications .
4. Since the validity of the interim tariff arrangement expired on 30th September, 2009 and recognizing the time required for finalizing the case , this Authority extends the validity of interim tariff arrangement till 31st March , 2010 or till the effective date of implementation of the Scale of Rates for ICTPL, whichever is earlier .
5. Additional surplus , ifany, over and above the admissible cost and permissible return earned by the ICTPL from the date of commencement of operation will be assessed and adjusted fully in the tariff to be determined.
