सं. टीएएमपी/47/2005- एमओपीटी. महापत्तन न्यास अधिनियम , 1963 ( 1963 का 38 ) की धारा 48 , 49 और 50 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , महापत्तन प्रशुल्क प्राधिकरण , एतद्वारा मुरगाँव पत्तन न्यास के प्रचलित दरमान की वैधता को संलग्न आदेशानुसार विस्तारित करता है ।

आदेश

मुरगाँव पत्तन न्यास के प्रचलित दरमान को दिनांक 30 अक्तूबर , 2006 के आदेश के द्वारा 31 मार्च , 2009 तक निर्धारित किया था । इस प्राधिकरण ने इस वैधता को दिनांक 28 जुलाई , 2009 के आदेश के द्वारा 31 अक्तूबर , 2009 तक विस्तारित किया था जो दिनांक 22 अगस्त , 2009 के राजपत्र संख्या 156 के द्वारा भारत के राजपत्र में अधिसूचित किया गया है ।
2. एमओपीटी ने प्रशुल्क के सामान्य संशोधन हेतु प्रस्ताव दाखिल कर दिया है , जिसे संबंधित उपयोगकर्ताओं/उपयोगकर्ता संगठनों से परामर्श हेतु रखा गया है, प्रस्ताव पर प्राधिकरण के द्वारा मांगी गई अतिरिक्त सूचनाएं स्पष्टीकरण पत्तन प्रस्तुत कर चुका है ।
3. दिनांक 27 जून , 2009 को पत्तन के द्वारा संशोधित प्रस्ताव को संबंधित उपयोक्ताओं के टीका-टिप्पणी के लिए भी परिचालित किया है ।
4. संयुक्त सुनवाई परामर्शात्मक प्रक्रिया के भाग के रूप में संयुक्त सुनवाई निर्धारित की गयी है । यद्यपि संयुक्त सुनवाई के उपरांत मामला को विश्लेषण एवं सूक्ष्म परीक्षण के लिए और प्राधिकरण द्वारा अंतिम विचार विमर्श में अभी और कुछ समय लेगा ।
5. चूँकि प्रचलित दरमान की वैधता 31 अक्तूबर , 2009 को समाप्त होती है , यह प्राधिकरण एमओपीटी के प्रचलित दरमान की वैधता को 31 मार्च , 2010 तक या एमपीटी के प्रशुल्क के सामान्य संशोधन के प्रस्ताव पर पारित आदेश के कार्यान्वयन की प्रभावी तिथि तक, इसमें से जो भी पहले हो , विस्तारित करता है ।
6. यदि इसके निष्पादन की समीक्षा के दौरान 1 अप्रैल , 2009 के बाद वाली अवधि में स्वीकार्य लागत और अनुमेय प्रतिलाभ से अधिक कोई अतिरिक्त अधिशेष उभरता है तो उसे निर्धारित किये जाने वाले प्रशुल्क में पूर्णरूपेण समायोजित किया जाएगा ।

NOTIFICATION
Mumbai , the24th November , 2009
No. TAMP/47/2005- MOPT. In exercise of the powers conferred by Sections 48, 49 and 50 of the Major Port Trusts Act , 1963 (38 of 1963) , the Tariff Authority for Major Ports hereby extends the validity of the existing Scale of Rates atMormugao Port Trust as in the Order appended hereto .

(Passed on this the 23rd day of October , 2009)
Thevalidity ofthe existing Scale ofRates ofthe Mormugao Port Trust (MOPT) was prescribed till 31st March , 2009. vide Order dated 30th October, 2006. This Authority extended the validity till 31st October , 2009 vide Order dated 28th July, 2009 which is notified in the Gazette of India on 22nd August, 2009 vide Gazette No. 156 .
2. The MOPT has filed its proposal for general revision of its tariff which is taken on consultation with the relevant users/user organizations . On a preliminary scrutiny of the proposal the additional information / clarifications were also obtained from the port .
3. The revised proposal dated 27th June, 2009 filed by the port has also been circulated to the concerned users for their comments .
4. Joint hearing as part of the consultative process is set up on 28th October , 2009. It will , however, take some more time after the joint hearing for analyzing the case and finally disposing it .
5. Since the validity ofthe existing SOR expires on 31st October , 2009, this Authority extends the validity ofthe existing Scale of Rates of MOPT till 3 Ist March , 2010 or till the effective date of implementation of the Order to be passed on the proposal of MOPT for general review of its tariff, whichever is earlier.
6. If any additional surplus over and above the admissible cost and permissible return emerges for the period post 1st April , 2009 , during the review of its performance , such additional surplus will be set off fully in the tariff to be determined.

इन्टरनेशनल सीपोर्ट्स ( हल्दिया ) प्राइवेट लिमिटेड ( आईएसएचपीएल ) के प्रचलित दरमान को 31 मार्च , 2009 तक वैधतावाली अवधि के साथ निर्धारित किया गया था । दरमान की वैधता को दिनांक 28 जुलाई , 2009 के आदेश के द्वारा विस्तारित किया गया था जो 22 अगस्त, 2009 के राजपत्र संख्या जी -151 के द्वारा भारत के राजपत्र में अधिसूचित किया गया है ।
2. आईएसएचपीएल के द्वारा दाखिल प्रस्ताव को प्रशुल्क मामला के रूप में पंजीकृत किया गया है और निर्धारित परामर्शी-प्रक्रिया को शुरू कर दी गयी है ।
3. इसलिए , यह प्राधिकरण आईएसएचपीएल के प्रचलित दरमान की वैधता को 31 मार्च , 2010 तक या आईएसएचपीएल के प्रशुल्क के सामान्य संशोधन के प्रस्ताव , पर पारित आदेश की कार्यान्वयन के प्रभावी तिथि तक , इसमें से जो भी पहले हों विस्तारित करता है ।
4. इसके निष्पादन की समीक्षा के दौरान , यदि 1 अप्रैल , 2009 के बाद वाली अवधि में स्वीकार्य लागत और अनुमेय प्रतिलाभ से अधिक कोई अतिरिक्त अधिशेष उभरता है तो उसे निर्धारित किये जाने वाले प्रशुल्क में पूर्णरूपेण समायोजित किया जाएगा ।

In exercise of the powers conferred by Sections 48 of the Major Port Trusts Act, 1963 (38 of 1963 ) , the Tariff Authority for Major Ports hereby extends the validity ofthe existing Scale of Rates at Interna- tional Sea Ports (Haldia ) Private Limited , as in the Order appended hereto .

(Passed on this , the 23rd day of October , 2009)
This existing Scale of Rates ( SOR ) of International Seaports ( Haldia ) Private Ltd. ( ISHPL ) was prescribed with a validity period till 31st March , 2009. The validity ofthe SOR was extended till 31st October , 2009 vide Order dated 28th July, 2009which is notified in the Gazette of India on 22nd August, 2009 vide G.No. 151 ..
2. The proposal filed by ISHPL is registered as tariff case and the usual consultative procedure prescribed is initiated.
3. This Authority, therefore , extends the validity of the existing Scale of Rates of ISHPL till 31st March , 2010 or till the effective date of implementation of the Order to be passed on the proposal of ISHPL for general review of its tariff, whichever is earlier
4. Ifany additional surplus over and above the admissible cost and permissible return emerges for the period post 1st April , 2009, during the review of its performance, such additional surplus will be set offfully in the tariff to be determined .

सं. टीएएमपी/10/2009-सीआईटीपीएल. महापत्तन न्यास अधिनियम , 1963 ( 1963 का 38वां ) की धारा 48 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , महापत्तन प्रशुल्क प्राधिकरण, चेन्नै पत्तन न्यास पर चेन्नै इंटरनेशनल टर्मिनल प्राइवेट लिमिटेड (सीआईटीपीएल) के प्रचालनों के लिए अंतरिम प्रशुल्क व्यवस्था की वैधता को संलग्न आदेशानुसार विस्तारित करता है ।

यह प्रकरण चेन्नै पत्तन न्यास पर चेन्नै इंटरनेशनल टर्मिनल प्राइवेट लिमिटेड ( सीआईटीत्रीएल ) की अंतरिम प्रशुल्क व्यवस्था की वैधता के विस्तार से संबंधित है ।
2. इस प्राधिकरण ने सीआईटीपीएल की अंतिम प्रशुल्क व्यवस्था को 30 जून , 2009 तक की वैधता के साथ दिनांक 15 मई , 2009 के आदेश संख्या टीएएमपी/ 10/2009- सीआईटीपीएल द्वारा अनुमोदित किया था । अंतरिम प्रशुल्क व्यवस्था की वैधता को इस प्राधिकरण द्वारा पिछली बार 17 जून, 2009 के आदेश द्वारा 30 सितम्बर, 2009 तक विस्तारित किया गया था । यह आदेश भारत के राजपत्र सं. 102 द्वारा दिनांक 20 जून, 2009 को अधिसूचित किया गया है ।
3. सीआईटीपीएल के प्रशुल्क स्थरीकरण के प्रस्ताव को विचार- विमर्श के लिए रखा गया है । सीआईटीपीएल और चेन्नै पत्तन न्यास अतिरिक्त सूचनाएं/स्पष्टीकरण प्रस्तुत कर चुके हैं जो अभी छानबीन के अंतर्गत है ।
4. प्रशुल्क न बढ़ाने के अपने ग्राहकों के अनुरोध को ध्यान में रखते हुए , सीआईटीपीएल ने दिनांक 16 सितम्बर, 2009 केअपने पत्र द्वारा प्रचलित अंतरिम प्रशुल्क की वैधता 31 दिसम्बर , 2009 तक विस्तारित करने का अनुरोध किया है ।
5. सीआईटीपीएल की प्रस्तुतियों को ध्यान में रखते हुए और चूँकि प्रचलित अंतरिम प्रशुल्क व्यवस्था की वैधता 30 सितम्बर , 2009 को समाप्त हो गई हैं, यह प्राधिकरण सीआईटीपीएल की प्रचलित अंतरिम प्रशुल्क व्यवस्था की वैधता 31 मार्च , 2010 तक या सीआईटीपीएल द्वारा दाखिल प्रस्ताव पर अंतिम निपटान होने तक , इसमें से जो भी पहले हो विस्तारित करता है ।
6. यदि सीआईटीपीएल द्वारा अपने प्रचालन कार्य शुरू होने वाले दिन से स्वीकार्य लागत और अनुमेय प्रतिलाभ से अधिक कोई अतिरिक्त अधिशेष अर्जित किया जाता है तो उसे निर्धारित किये जाने वाले प्रशुल्क में पूरी तरह समायोजित किया जायेगा ।

No. TAMP/ 10/2009 -CITPL .-- In exercise of the powers conferred under Section 48 of the Major Port TrustsAct, 1963 (38 of 1963 ) , the Tariff Authority for Major Ports hereby extends the validity of the interim tariff arrangement for operations of Chennai International Terminals Private Ltd. ( CITPL) at the Chennai Port Trust, as in the Order appended hereto .

(Passed on this the 23rd day ofOctober , 2009)
This case relates to the extension of the validity of the interim tariff arrangement of the Chennai International Terminals Private Ltd. (CITPL) at the Chennai Port Trust .
2. The interim tariff arrangement approved by this Authority vide Order No. TAMP/ 10/2009 - CITPL dated 15thMay, 2009 for operations of the CITPL was valid till 30th June , 2009. The validity of the interim tariff arrangement was lasted extended till 30th September, 2009 vide Order dated 17th June, 2009 which is notified in the Gazette of India on 20th June , 2009 vide Gazette No. 102 .
3. The proposal of CITPL for fixation of its tariff is taken on consultation . The CITPL and Chennai Port Trust have also furnished the additional information /clarifications , which are under scrutiny .
4. The CITPL vide letter dated 16th September, 2009 has submitted that in view of the strong request from its customers not to increase the tariff, the CITPL has requested to extend the present interim tariff till 31th December , 2009 .
5. Inview of the submissions made by the CITPL and since the validity of the existing interim tariff arrangement hasexpired on 30th September, 2009 and recognizing the time required for finalizing the case , this Authority extends the validity ofthe existing interim arrangement at the CITPL till 31st March , 2010 or the effective date of implementation ofthe Scale ofRates for CITPL , whichever is earlier .
6. Additional surplus , if any, over and above the admissible cost and permissible return earned by the CITPL from the date of commencement of its operations will be fully adjusted in the tariff to be determined.
