सं. टीएएमपी/63/ 2005-सीओपीटी. महापत्तन न्यास अधिनियम , 1963 ( 1963 का 38 ) की धारा 48 , 49 और 50 द्वारा प्रदत्त शक्तियोंका प्रयोग करते हुए, महापत्तन प्रशुल्क प्राधिकरण , एतदद्वारा , कोचीन पत्तन न्यास ( सीओपीटी ) के प्रचलित दरमान की वैधता को संलग्न ओदशानुसार विस्तारित करता है ।
महापत्तन प्रशुल्क प्राधिकरण प्रकरण सं. टीएएमपी/63 /2005-सीओपीटी आदेश (अक्तूबर, 2009 के 23 वें दिन पारित)
कोचीन पत्तन न्यास ( सीओपीटी ) के प्रचलित दरमान को 31 मार्च , 2009 तक निर्धारित किया गया था, जिसे इस प्राधिकरण ने अपने आदेश दिनांक 28 जुलाई , 2009 के द्वारा जो 22 अगस्त , 2009 को भारत का राजपत्र में अधिसूचना संख्या जी -157 द्वारा अधिसूचित हुआ है, 31 अक्तूबर , 2009 तक विस्तारित किया गया था ।
2. पत्तन के द्वारा दाखिल दरमान के सामान्य संशोधन के प्रस्ताव को विचार- विमर्श के लिए रखा गया है । परामर्शी प्रक्रिया के एक भाग के रूप में 20 जून, 2009 को सुनवाई का किया गया था । प्रस्ताव पर प्राधिकरण द्वारा मांगी गई अतिरिक्त सूचनाएँ/स्पष्टीकरण पत्तन से अभी तक प्रतीक्षित है । सीओपीटी को पूर्व से ही अपने जवाब अधिकतम 30 अक्तूबर , 2009 तक प्रस्तुत करने की सलाह दी जा चुकी है ।
3. पत्तन से आवश्यकै सूचना प्राप्ति के बाद अंतिम विचार- विमर्श के लिए पहले मामले का सूक्ष्म परीक्षण और विश्लेषण करने के लिए और अधिक समय की आवश्यकता है ।
4. इस स्थिति में, सीओपीटी के प्रचलित दरमान की वैधता को 31 दिसम्बर , 2009 तक या सीओपीटी के प्रशुल्क के सामान्य संशोधन के प्रस्ताव पर पारित आदेश की कार्यान्वयन के प्रभावी तिथि तक , इसमें से जो भी पहले हो विस्तारित किया जाता है ।
5. यदि इसके निष्पादन की समीक्षा के दौरान , 1 अप्रैल , 2009 के बाद वाली अवधि में स्वीकार्य लागत और अनुमेय प्रतिलाभ से अधिक कोई अतिरिक्त अधिशेष उभरता है तो उसे निर्धारित किये जाने वाले प्रशुल्क में पूर्णरूपेण समायोजित किया जायेगा ।

TARIFF AUTHORITY FOR MAJOR PORTS
NOTIFICATION
Mumbai, the 24th November 2009
No. TAMP/63/2005- COPT.- In exercise of the powers conferred by Sections 48 , 49 and 50 of the Major Port Trusts Act, 1963 (38 of 1963 ), the Tariff Authority for Major Ports hereby extends the validity of the existing Scale of Rates at Cochin Port Trust as in the Order appended hereto.

(Passed on this the 23rd day of October , 2009 )
The validity ofthe existing Scale of Rates (SOR ) of the Cochin Port Trust ( COPT) was prescribed till 31st March , 2009which was extended by this Authority till 31st October , 2009 by Order dated 28th July, 2009 which is notified in the Gazette of India on 22nd August, 2009 vide G.No. 157.
2. The proposal for general revision of the SOR filed by the port is taken on consultation and joint hearing was held on 20th June , 2009. Additional information/clarification sought by us on the proposal is still awaited from the port, despite reminders. The COPT has already been advised to furnish its response latest by 30th October , 2009.
3. After receipt of the requisite information from the port, some more time would be required for scrutinizing and analyzing the case for final consideration .
4. In light ofthis position , the validity of the existing Scale of Rates of COPT is extended till 31st December , 2009 ortill the effective date of implernentation of the Order to be passed on the proposal of COPT for general review of its tariff, whichever is earlier
5. If any additional surplus over and above the admissible cost and permissible return emerges for the period post 1st April , 2009, during the review of its performance , such additional surplus will be set off fully in the tariff to be determined.
