सं. टीएएमपी/49/2008-जीटीआईपीएल.-महापत्तन न्यास अधिनियम , 1963 ( 1963 का 38 ) की धारा 48 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , महापत्तन प्रशुल्क प्राधिकरण एतद्वारा गेटवे टर्मिनल्स इंडिया प्राइवेट लिमिटेड के प्रचलित दरमान की वैधता संलग्न आदेशानुसार , विस्तारित करता है ।

यह प्रकरण गेटवे टर्मिनल्स इंडिया प्राइवेट लिमिटेड के प्रचलित दरमान की वैधता के विस्तार से संबंधित है ।
2. जीटीआईपीएल के प्रचलित दरमान को इस प्राधिकरण ने आदेश सं. टीएएमपी/ 71 /2005- जीटीआईपीएल दिनांक 23 अगस्त, 2006 पिछली बार अनुमोदित किया था । इस आदेश ने दरमान की वैधता को 31 दिसम्बर , 2008 तक निर्धारित किया था । इस प्राधिकरण ने 17 जून , 2009 के आदेश द्वारा दिनांक 17 जून , 2009 को पिछली बार दरमान की वैधता को 30 सितम्बर, 2009 तक विस्तारित किया है । जिसे भारत के राजपत्र में 20 जून, 2009 को राजपत्र सं. 109 द्वारा अधिसूचित किया गया है ।
3. 8 मई , 2009 को जीटीआईपीएल ने दरमान की समीक्षा के लिए अपना संशोधित प्रस्ताव दाखिल कर दिया है जिसे विचार-विमर्श के लिए रखा गया है । प्रस्ताव पर मांगी गई अतिरिक्त सूचनाएँ एवं स्पष्टीकरण प्रचालक ने प्रस्तुत कर दी हैं जो छानबीन के अंतर्गत हैं । इस प्रकरण को अंतिम विचार- विमर्श के लिए परिपक्व होने में कुछ और समय लेगा ।
4. चूँकि प्रचलित दरमान की वैधता 30 सितम्बर , 2009 को समाप्त होती है , यह प्राधिकरण जीटीआईपीएल के प्रचलित दरमान की वैधता को 31 मार्च, 2010 तक या जीटीआईपीएल के द्वारा दाखिल प्रशुल्क प्रस्ताव पर अंतिम निपटान तक , जो भी पहले हो विस्तारित करता है ।
5. यदि 1 अप्रैल, 2009 के बाद वाली अवधि में स्वीकार्य लागत और अनुमेय प्रतिलाभ से अधिक कोई अतिरिक्त अधिशेष उभरता है तो उसे निर्धारित किये जाने वाले प्रशुल्क में पूरी तरह समायोजित किया जायेगा ।

NOTIFICATION
Mumbai , the 24th November , 2009
No. TAMP/49/2008- GTIPL . In exercise of the powers conferred under Section 48 of the Major Port Trusts Act, 1963 (38 of 1963 ) , the Tariff Authority for Major Ports hereby extends the validity of the Scale of Rates of the Gateway Terminals India Private Limited as in the Order appended hereto .

ORDER
(Passed on this 23rd day of October , 2009)
This case relates to the extension of the validity of the existing Scale of Rates (SOR) of Gateway Terminals India PrivateLimited (GTIPL).
2. The existing Scale of Rates (SOR) of the GTIPL was last approved by this Authority vide Order No.TAMP/71 / 2005-GTIPI . dated 23rd August, 2006. The Order prescribed the validity of the SORtill 31st December , 2008. The Authority haslast extended the validity of the SOR till 30th September , 2009 vide Order dated 17th June , 2009 , which is notified in the Gazette of India on 20th June, 2009 vide G. No. 109 .
3. The GTIPL has filed its revised proposal on 8th May, 2009 for review of its SOR which is taken on consultation. The operator has also furnished the additional information /clarifications which are under scrutiny.
4. The GTIPL vide its letter dated 7th September , 2009 has requested to retain the existing Scale of Rates till 31stDecember, 2009 ( Since the validity of the existing SOR has expired on 30th September , 2009 and recognizing the time required for finalizing the case ). This Authority extends the validity of the existing SOR till 31st March , 2010 or till the effective date of implementation of the revised Scale of Rates , whichever is earlier .
5. Additional surplus , if any, over and above the admissible cost and permissible return for the period post 1st January , 2009 will be adjusted fully in the tariff to be determined.
