सं. टीएएमपी/48 / 2005-जेएनपीटी. महापत्तन न्यास अधिनियम , 1963 ( 1963 का 38वां) की धारा 48 , 49 और 50 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, महापत्तन प्रशुल्क प्राधिकरण एतदद्वारा , जवाहरलाल नेहरू पत्तन न्यास ( जेएनपीटी ) के प्रचलित दरमान की वैधता को संलग्न आदेशानुसार विस्तारित करता है ।

इस प्राधिकरण ने दिनांक 28 सितम्बर , 2006 को अपने आदेश के द्वारा जवाहरलाल नेहरू पत्तन न्यास के दरमान को 31 मार्च , 2009 . तक की वैधता वाली अवधि के साथ अधिसूचित किया था । प्राधिकरण द्वारा वर्तमान दरमान की वैधता, दिनांक 28 जुलाई , 2009 के अपने आदेश. द्वारा 31 अक्तूबर , 2009 तक बढ़ाई गई थी, यह आदेश भारत के राजपत्र में राजपत्र सं. जी -152 द्वारा 22 अगस्त, 2009 को अधिसूचित किया गया है।
2. जेएनपीटी के दिनांक 29 अक्तूबर , 2008 और 24 दिसम्बर, 2008 के पत्रों के द्वारा दरमान के सामान्य संशोधन के लिए दाखिल प्रस्ताव विचार- विमर्श के लिए रखा जा चुका है । मांगी गई अतिरिक्त सूचनाएँ/स्पष्टीकरण पत्तन के द्वारा दिनांक 18 सितम्बर , 2009 को प्रस्तुत की जा चुकी है। संयुक्त सुनवाई की कार्रवाई का गठन किया गया है जिसके आधार पर नवीन प्रशुल्क आदेश जारी कर सकते हैं ।
3. चूँकि प्रचलित दरमान की वैधता 31 अक्तूबर , 2009 को समाप्त होती है और मामले को अंतिम निर्णय देने में लगने वाले समय को ध्यान में रखते हुए यह प्राधिकरण प्रचलित दरमान की वैधता को 31 मार्च , 2010 तक या जेएनपीटी के प्रशुल्क के सामान्य संशोधन के प्रस्ताव पर पारित आदेश की कार्यान्वयन के प्रभावी तिथि तक, इसमें से जो भी पहले हो विस्तारित करता है ।
4. यदि इसके निष्पादन की समीक्षा के दौरान , 1 अप्रैल, 2009 के बाद वाली अवधि में स्वीकार्य लागत और अनुमेय प्रतिलाभ से अधिक कोई अतिरिक्त अधिशेष उभरता है तो उसे निर्धारित किये जाने वाले प्रशुल्क में पूर्णरूपेण समायोजित किया जायेगा ।

TARIFF AUTHORITY FOR MAJOR PORTS
NOTIFICATION
Mumbai , the 24th November, 2009
No. TAMP/48/2005- JNPT.- In exercise of the powers conferred by Sections 48 , 49 and 50 of the Major Port Trusts Act, 1963 (38 of 1963) , the Tariff Authority for Major Ports hereby extends the validity of the existing Scale of Rates at Jawaharlal Nehru Port Trust as in the Order appended hereto .

ThisAuthority vide its Order dated 28th September, 2006 had notified the Scale of Rates of Jawaharlal Nehru Port Trust (JNPT) with a validity period till 3 1st March , 2009. The validity of the existing SOR was extended by the Authority till 31st October , 2009 vide Order dated 28th July, 2009 which is notified in the Gazette of India on 22nd August, 2009 vide G.No.152 .
2. The proposal filed by JNPT vide its letter dated 29th October , 2008 and 24th December , 2008 for general revision of its Scale of Rates has been taken on consultation . The additional information/clarifications requested has been furnished by the port on 18th September, 2009. Joint hearings have been set up based on which final tariff Orders can be issued .
3. Since the validity of the existing Scale of Rates expires on 31st October , 2009 and recognizing the time required for finalizing the case , this Authority extends the validity of existing Scale of Rates till 31st March , 2010 or till the effective date of implementation of the Scale of Rates for JNPT , whichever is earlier .
4. If any additional surplus over and above the admissible cost and permissible return emerges for the period post 1st April , 2009 , during the review of its performance , such additional surplus will be set off fully in the tariff to be determined.
