सं. टीएएमपी/57/2005-एमबीपीटी.-महापत्तन न्यास अधिनियम, 1963 ( 1963 का 38 ) की धारा 48 , 49 और 50 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , महापत्तन प्रशुल्क प्राधिकरण , एतद्वारा , मुंबई पत्तन न्यास के प्रचलित दरमान की वैधता को संलग्न आदेशानुसार विस्तारित करता है ।
महापत्तन प्रशुल्क प्राधिकरण प्रकरण सं. टीएएमपी/57 /2005- एमबीपीटी आदेश (अक्तूबर, 2009 के 23वें दिन पारित )
इस प्राधिकरण ने दिनांक 28 सितम्बर, 2006 के अपने आदेश के द्वारा मुंबई पत्तन न्यास ( एमबीपीटी ) के दरमान को दिनांक 31 मार्च, 2009 तक की वैधतावाली अवधि के साथ अधिसूचित किया था । एमबीपीटी के दरमान की वैधता प्राधिकरण द्वारा पिछली बार , दिनाक 28 जुलाई, 2009 के आदेश द्वारा 31 अक्तूबर , 2009 तक बढ़ाई गई थी, यह आदेश भारत के राजपत्र में राजपत्र सं. 153 के माध्यम से अधिसूचित किया गयाहै।
2. एमबीपीटी ने प्रशुल्क के सामान्य संशोधन करने के लिए प्रस्ताव दाखिल किया है जिसे संबंधित. उपयोगकर्ता/उपयोगकर्ताओं के संगठन के विचार-विमर्श के लिए रखा गया है। निवेदित अतिरिक्त सूचनाएं/ स्पष्टीकरण पत्तन से अभी तक प्रतीक्षित है ।
3. एमबीपीटी ने दिनांक 15 अक्तूबर , 2009 के अपने पत्र के द्वारा दरमान प्रचलित की वैधता को 31 दिसम्बर , 2009 तक जारी रखने के लिए निवेदन किया है कि वह नया प्रस्ताव दाखिल करने पर गंभीरता से सोच रहा है। एमबीपीटी अपने प्रस्ताव को नवम्बर महीने के प्रथम सप्ताह तक प्रस्तुत करने के लिए सलाह दिया जा चुका है।
4. चूँकि प्रचलित प्रशुल्क की वैधता 31 अक्तूबर , 2009 को समाप्त होती है । नवीन प्रस्ताव पर निर्धारित विचार - विमर्श की प्रक्रिया में लगने वाले समय को ध्यान में रखते हुए, यह प्राधिकरण प्रचलित दरमान की वैधता को 31 मार्च , 2010 तक या एमबीपीटी के प्रशुल्क के सामान्य संशोधन के प्रस्ताव पर पारित आदेश की कार्यान्वयन के प्रभावी तिथि तक, इसमें से जो भी पहले हो विस्तारित करता है।
5. यदि इसके निष्पादन की समीक्षा के दौरान , 1 अप्रैल , 2009 के बाद वाली अवधि में स्वीकार्य लागत और अनुमेय प्रतिलाभ से अधिक कोई अतिरिक्त अधिशेष उभरता है तो उसे निर्धारित किये जाने वाले प्रशुल्क में पूर्णरूपेण समायोजित किया जायेगा ।

TARIFF AUTHORITY FOR MAJOR PORTS
NOTIFICATION
Mumbai , the 24th November , 2009
No. TAMP/57/2005- MBPT . In exercise of the powers conferred by Sections 48 , 49 and 50 of the Major Port Trusts Act , 1963 (38 of 1963 ) , the Tariff Authority for Major Ports hereby extends the validity of the existing Scale ofRates atMumbai Port Trust as in the Order appended hereto.

ORDER
(Passed on this the 23rd day of October , 2009)
This Authority vide its Order dated 28th September, 2006 had notified the Scale of Rates of Mumbai Port Trust (MBPT) with a validity period till 31st March , 2009. The validity of SOR of MBPT was last extended by the Authority vide Order dated 28th July, 2009 till 31st October, 2009 which is notified in the Gazette of India on 22nd August, 2009 vide G.No.153:
2. The MBPT has filed its proposal for general revision of its tariff which is taken on consultation with the relevant users /user organizations . The additional information/ clarifications requested from the port are awaited .
3. The MBPT vide its letter dated 15th October , 2009 has requested to grant permission for continuation ofthe existing Scale of Rates till 31st December , 2009 on the ground that MBPT contemplates to submit a fresh proposal . The MBPT has already been advised to submit its proposal by first week of November , 2009.
4. Since the validity of the existing tariff expires on 31st October , 2009 and recognizing the time required for processing the fresh proposal following the usual consultation process prescribed, this Authority extends the validity of existing Scale of Rates till 31st March , 2010 or till the effective date of implementation of the Order to be passed on the proposal to be submitted by MBPT, whichever is earlier.
5. If any additional surplus over and above the admissible cost and permissible return emerges for the period post 1st April , 2009, during the review of its performance , such additional surplus will be set off fully in the tariff to be determined.
