सं. टीएएमपी/36/ 2005-सीएचपीटी. म न्यास अधिनियम , 1963 ( 1963 का 38वां ) की धारा 48 , 49 और50 के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , महापत्तन प्रशुल्क प्राधिकरण एतद्वारा , चेन्नै पत्तन न्यास के प्रचलित दरमान की वैधता को संलग्न आदेशानुसार विस्तारित करता है ।

यह मामला चेन्नै पत्तन न्यास सीएचपीटी के प्रचलित दरमान की वैधता के विस्तार से संबंधित है ।
2. सीएचपीटी के प्रचलित दरमान को इस प्राधिकरण ने 7 मार्च , 2006 को पिछली बार आदेश सं. टीएएमपी/36/2005- सीएचपीटी द्वारा अनुमोदित किया था । आदेश ने दरमान की वैधता को 31 मार्च , 2008 तक निर्धारित किया था । इसके बाद दरमान की वैधता को इस प्राधिकरण ने दिनांक 17 जून , 2009 के आदेश के द्वारा 30 सितम्बर , 2009 तक विस्तारित किया था । जिसे भारत के राजपत्र में दिनांक 20 जून , 2009 को अधिसूचना सं. 106 के द्वारा अधिसूचित किया गया है । सीएचपीटी दिनांक 29 सितम्बर, 2009 के अपने पत्र के द्वारा 1 अक्तूबर , 2009 तक दमान की वैधता को विस्तारित करने का अनुरोध किया है ।
3. सीएचपीटी ने दमान के संशोधन के लिए प्रस्ताव दाखिल कर दिया है । प्रस्ताव में से उठे विभिन्न सवालों पर मांगी गई सूचनाओं एवं स्पष्टीकरणों को पत्तन ने हाल ही में प्रस्तुत किया है जो छानबीन की प्रक्रिया के अंतर्गत है। इस प्राधिकरण द्वारा इस प्रकरण पर अंतिम रूप से विचार करने हेतु परिपक्व होने में कुछ और समय लग सकता है ।
4. चूंकि प्रचलित दरमान की वैधता 30 सितम्बर , 2009 को समाप्त होती है और मामले को अंतिम रूप देने के लिए लगने वाले समय को ध्यान में रखते हुए , यह प्राधिकरण सीएचेपीटी के प्रचलित दरमान की वैधता को 31 मार्च , 2010 तक या सीएचपीटी द्वारा दाखिल प्रशुल्क प्रस्ताव पर अंतिम निपटान होने तक , इसमें से जो भी पहले हो विस्तारित करता है ।
5. यदि 1 अप्रैल, 2008 के बाद वाली अवधि में स्वीकार्य लागत और अनुमेय प्रतिलाभ से अधिक कोई अतिरिक्त अधिशेष उभरता है तो उसे निर्धारित किए जाने वाले प्रशुल्क में पूर्णरूपेण समायोजित किया जायेगा ।

NOTIFICATION
Mumbai , the 24th November , 2009
No. TAMP/36/2005 - CHPT.-In exercise of the powers conferred under Sections 48, 49 and 50 of the Major Port Trusts Act , 1963 (38 of 1963 ), the Tariff Authority for Major Ports hereby extends the validity of the Scale of Rates at the Chennai Port Trust as in the Order appended hereto.

This case relates to the extension of the validity of the existing Scale of Rates of the Chennai Port Trust (CHPT) .
2. The existing Scale of Rates (SOR) of the CHPT was last approved by this Authority vide Order No. TAMP/ 36/ 2005-CHPT, dated 7th March , 2006. The Order prescribed the validity of the SOR till 31st March , 2008. Subsequently , the validity of the SOR was extended by this Authority till 30th September , 2009 vide Order dated 17th June , 2009 , which is notified in the Gazette of India on 20th June, 2009 vide Gazette No. 106. The CHPT vide its letter dated 29th September , 2009 has requested to extend the validity of the existing Scale of Rates for further period from 1st October, 2009 .
3. The CHPT has filed its proposal for revision of its SOR . Additional information / clarifications requested on various points emerging from the proposal are furnished recently by the port which is under scrutiny. It may take some more time for the caseto mature for final consideration of this Authority.
4. Since the validity of the existing SOR has expired on 30th September , 2009 and recognising the time required for finalising the case this Authority extends the validity of the existing SOR of the CHPT till 31st March , 2010 or till the effective date of implementation of the revised Scale of Rates, whichever is earlier .
5. Additional surplus , if any , over and above the admissible cost and permissible return for the period post 1stApril , 2008 will be adjusted fully in the tariff to be determined .
