सा.का.नि. 862(अ).- केन्द्रीय सरकार , विधि- विरुद्ध क्रिया-कलाप (निवारण ) अधिनियम, 1967 ( 1967 का 37) की धारा 52 की उप-धारा (2) के खण्ड (ग) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , समपहृत संपत्ति की कीमत का अवधारण नियम, 2005 को और संशोधित करने के लिए एतद्वारा निम्नलिखित नियम बनाती है , अर्थात्ः-
1. (1 ) इन नियमों को समपहृत संपत्ति की कीमत का अवधारण (संशोधन) नियम , 2009 कहा जाए।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे।
2. समपहृत संपत्ति की कीमत का अवधारण नियम , 2005 (जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है) के नियम 3 में, निम्नलिखित परन्तुक अंतःस्थापित किया जाएगा, अर्थात्: -
"परन्तु यह कि प्राधिकृत अधिकारी, समपहृत संपत्ति की कीमत निर्धारित करने के लिए संपत्ति के मूल्यांकन के क्षेत्र में किसी विशेषज्ञ मूल्यांकनकर्ता की सेवाएं लेगा । "
3. उक्त नियमों के नियम 5 में, -
"उप-नियम ( 1 ) में , निम्नलिखित परन्तुक अंतःस्थापित किया जाएगा, अर्थात्ः-

[PART II-SEC. 3(1)] (क) परन्तु यह कि इन नियमों के अन्तर्गत समपहृत संपत्ति की कीमत का अवधारण करने की प्रक्रिया इस उप- नियम के अन्तर्गत अभ्यावेदन की प्राप्ति के अगले माह के प्रथम दिन से एक सौ अस्सी दिनों की अवधि के भीतर पूरी कर ली जाएगी" ;
(ख) उप- नियम (2) में , "उसके विधिक नामनिर्देशिती " शब्दों के स्थान पर "समपहृत संपति की कीमत के अवधारण की तारीख से साठ दिनों की अवधि के भीतर उसके विधिक नामनिर्देशिती " शब्द प्रतिस्थापित किए जाएंगे ।
4. उक्त नियमों के नियम 7 में , -
(क) उप-नियम ( 1 ) में, "नियत कीमत को जमा करेगी" शब्दों के स्थान पर " नियम 6 के अन्तर्गत विनिर्दिष्ट आदेश की तारीख से तीस दिनों की अवधि के भीतर नियत कीमत जमा करेगी" शब्द प्रतिस्थापित किए जाएंगे;
(ख) उप- नियम ( 2) में , " उस पर ब्याज" शब्दों के स्थान पर " भारतीय स्टेट बैंक में बचत बैंक खाते में देय ब्याज की विद्यमान दर पर उस पर ब्याज " शब्द प्रतिस्थापित किए जाएंगे ।

NOTIFICATION
New Delhi , the 4th December, 2009
G.S.R. 862(E) . In exercise of the powers conferred by clause ( c) of sub- section (2) of section 52 of the Unlawful Activities ( Prevention) Act , 1967(37 of 1967) , the Central Government hereby makes the following rules further to amend the Determination of Price of the Forfeited Property Rules , 2005 , namely: -
1. ( 1 ) These rules may be called the Determination of Price of the Forfeited Property (Amendment ) Rules , 2009 .
(2) They shall come into force from the date of their publication in the Official Gazette .

2. In the Determination of the Price of the Forfeited Property Rules , 2005 (hereinafter referred to as the said rules) , in rule 3 , the following proviso shall be inserted , namely: -
" Provided that the Authorised Officer shall utilise the services of a valuer who is an expert in the field of valuation of property to arrive at the value of the forfeited property. "
3. In rule 5 of the said rules , -
(a) in sub - rule ( 1 ) , the following proviso shall be inserted , namely: -
"Provided that the process of determining the price of the forfeited property under these rules shall be completed within a period of one hundred and eighty days from the first day of the next month of the receipt of the representation under this sub- rule " ;
(b) in sub- rule ( 2) , for the words " his legal nominee " , the words , " hislegal nominee , within a period of sixty days from the date of determining the price offorfeited property" shall be substituted .
4. In rule 7 of the said rules , -
(a) in sub - rule( 1 ) , for the words " deposit the price fixed" , the words "deposit, the price fixed within a period of thirty days from the date of the order specified under rule 6 " shall be substituted;
(b) in sub- rule(2 ) , for the words " interest thereon " , the words " interest thereon at the prevailing rate of interest as paid on savings bank account in the State Bank of India " , shall be substituted .
