विषय:- जैविक आर्गेनिक गेहूँ का निर्यात-शर्तों के संबंध में ।
का.आ. 3142(अ). विदेश व्यापार नीति, 2009-2014 के पैराग्राफ 1.3 और पैराग्राफ 2.1 के साथ पठित विदेश व्यापार ( विकास एवंविनियमन) अधिनियम, 1992 ( 1992 की संख्या 22 ) की धारा 3 ( 2 ) के साथ पठित धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्र सरकार, एतद्वारा , समय- समय पर यथा संशोधित, अधिसूचना संख्या 33 ( आर ई -2007 ) /2004--2009 दिनांक 8 अक्तूबर , 2007 में तत्काल प्रभाव से निम्नानुसार संशोधित करती है ।
2. अधिसूचना संख्या 33 ( आर ई-2007 )/2004-2009 दिनांक 8-10-2007 के पैरा 2 के अंत में निम्नलिखित को जोड़ा जाएगा :- " 2.8 तथापि गेहूँ के निर्यात पर प्रतिबन्ध जैविक ( आर्गेनिक ) गेहूँ के निर्यात पर निम्नलिखित रूप से लागू नहीं होगा :-

( i ) एपीडा द्वारा विधिवत् प्रमाणित जैविक ( आर्गेनिक ) गेहूँ का निर्यात 5000 मी. टन प्रति वर्ष
कीसीमा तक अनुमत किया जाएगा;
(आर्गेनिक गेहूँ)
( ii ) अनुमत निर्यात पोत लदान से पहले एपीडा नई दिल्ली के पास संविदाओं के पंजीकरण के
मद्दे भी होगा;
( iii ) निर्यात केवल सीमा शुल्क ई डी आई पत्तनों से ही अनुमत किया जाएगा । "
3. निर्यात किए जाने वाले जैविक ( आर्गेनिक ) गेहूँ की मात्रा की खाद्य एवं सार्वजनिक वितरण विभाग के साथ - साथ वाणिज्य विभाग/विदेश व्यापार महानिदेशालय को भेजी जाने वाली मासिक रिपोर्ट के माध्यम से डी जी सी आई एण्ड एस के साथ- साथ सीमा शुल्क विभाग दोनों के द्वारा मासिक आधार पर निगरानी की जाएगी ।
4. अधिसूचना सं. 33 ( आर ई -2007)/2004-2009 दिनांक 8 अक्तूबर , 2007 के अन्य सभी प्रावधान अपरिवर्तित रहेंगे तथा लागू रहेंगे ।
5. इसे लोकहित में जारी किया जाता है ।

Subject : Export of Organic Wheat-Conditions regarding .
S.O. 3142 (E ) .- In exercise of the powers conferred by Section 5 read with Section 3 (2) of the Foreign Trade (Development amd Regulation) Act, 1992 (No. 22 of 1992) and also read with Para 1.3 and Para 2.1 of the Foreign Trade Policy , 2009-2014 , the Central Government hereby makes , with immediate effect, following amendments to Notification No. 33 (RE- 2007 )/2004-2009 , dated 8th October , 2007 as amended from time to time.
2. Following shall be added at the end of Para 2 of Notification No. 33 ( RE - 2007)/2004-2009, dated 8-10-2007:----
"2.8 Ban on export of wheat shall , however , not be applicable to export of organic wheat as follows :-

(i) Export of organic wheat duly certified by APEDA shall be permitted subject to a limit of 5,000 MT per annum ;
(ii) Export allowed is also subject to registration of contracts with APEDA , New Delhi prior to shipment;
(iii) Exports shall be allowed only from Customs EDI Ports ."
3. The quantity of organic wheat to be exported shall be monitored on a monthly basis both by the Customs Department as well as by DGCI & S , through monthly reports to be sent to the Department of Commerce /DGFT , as well as to the Department of Food and Public Distribution .
4. All other provisions of the Notification No. 33 ( RE - 2007) /2004-2009, dated 8th October , 2007 , shall remain unchanged , and shall continue to apply.
5. This issues in Public interest.
