सा.का.नि. 869(अ). भारतीय मानक ब्यूरो अधिनियम , 1986 (1986 का 63 ) की धारा 38 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , भारतीय मानक ब्यूरो की कार्यकारिणी समिति , केन्द्रीय सरकार के पूर्व अनुमोदन से , भारतीय मानक ब्यूरो (वैज्ञानिक संवर्ग में भर्ती ) विनियम, 2002 में संशोधन करने के लिए एतद्वारा निम्नलिखित विनियम बनाती है , अर्थात्:--
1. ( 1 ) इन विनियमों को भारतीय मानक ब्यूरो ( वैज्ञानिक संवर्ग में भर्ती ) संशोधन विनियम , 2009 कहा जाएगा ।
(2) ये राजपत्र में प्रकाशन की तिथि से प्रवृत्त होंगे ।
2. भारतीय मानक ब्यूरो ( वैज्ञानिक संवर्ग में भर्ती ) विनियम,
2002 ( जिन्हें इसके पश्चात् मूल नियम कहा गया है ) के विनियम 2 , के-
(1 ) खण्ड ( ख ) को निम्नलिखित खण्ड से प्रतिस्थापित किया जाएगा , अर्थात्
(ख) " मूल्यांकन समिति " से अभिप्रेत है विनियम 9 के उप- नियम ( 1 ) के खण्ड ( i ) के अधीन महानिदेशक द्वारा नियुक्त मूल्यांकन समिति;
(2) खण्ड ( ज ) और ( झ ) हटा दिया जाएगा;
3. मूल विनियम के विनियम , 6 के,-
(i ) दोनों स्थानों पर आने वाले शब्दों एवं अक्षर ' चयन समिति-ए' की जगह ' मूल्यांकन ' समिति प्रतिस्थापित
किया जाएगा;

(ii) उप-विनियम (4 ) में, संख्या " 1988 " को संख्या " 2007 " से प्रतिस्थापित किया जाएगा ।
4. मूल विनियमों के विनियम 7 के उप- विनियम ( 7 ) में संख्या " 1988 " को संख्या " 2007 " से प्रतिस्थापित किया जाएगा ।
5. मूल विनियमों के विनियम 8 के ' स्थायी समिति' में शब्द हटा दिए जाएंगे ।
6. मूल विनियमों के विनियम 8 के बाद निम्नलिखित विनियम सम्मिलित किये जाएंगे , अर्थात्: -
"8क. नियुक्ति प्राधिकारी, नियुक्ति प्राधिकारी द्वारा सभी पदों पर नियुक्तियां निम्न की अनुशंसाओं के आधार पर की जाएंगी :-
(क ) वैज्ञानिक- एफ एवं वैज्ञानिक जी के पदों की नियुक्त की स्थिति में, विभागीय समकक्ष समीक्षा समिति द्वारा ;
(ख ) वैज्ञानिक- बी से वैज्ञानिक - ई तक के पदों की नियुक्ति की स्थिति में मूल्यांकन समिति द्वारा :
बशर्ते कि वैज्ञानिक- एफ एवं वैज्ञानिक जी के पदों पर नियुक्तियां केन्द्र सरकार के पूर्व अनुमोदन के बिना नहीं होंगी ।
बशर्ते यह भी कि स्थानापन्न नियुक्तियां उपयुक्त चयन समिति की अनुशंसाओं के बिना नियुक्ति प्राधिकारी द्वारा इस शर्त पर की जा सकेंगी कि ऐसी नियुक्तियां छः माह से अधिक की अवधि की होने पर केन्द्र सरकार का अनुमोदन लेना होगा । "

टिप्पण: मूल विनियम , दिनांक 3 मई, 2002 को भारत के राजपत्र सं. सा.का.नि. 326 ( अ ) , में प्रकाशित किए गए और इसे बाद में दिनांक 12 अगस्त, 2004 को राजपत्र सं. 522 ( अ ) औरसा.का.नि. 718 ( अ ) , 15 नवम्बर , 2007 द्वारा संशोधित किया गया ।

BUREAU OF INDIAN STANDARDS NOTIFICATION
New Delhi , the 8th December , 2009
G.S.R. 869( E) . In exercise of the powers conferred by Section 38 of the Bureau of Indian Standards Act , 1986 (63 of 1986) , the Executive Committee of the Bureau of Indian Standards, with the previous approval of the Central Government, hereby makes the following regulations further to amend the Bureau of Indian Standards ( Recruitment to Scientific Cadre ) Regulations , 2002, namely :---
1. ( 1 ) These Regulations may be called the Bureau of Indian Standards ( Recruitment to Scientific Cadre ) Amendment Regulations , 2009 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Bureau of Indian Standards ( Recruitment to Scientific Cadre) Regulations , 2002 ( hereinafter referred to asthe principal regulations ) , in regulation 2,-
( i) for clause ( b ) , the following clause shall be sub- stituted, namely:-
' (b ) " Assessment Committee " means the Assessment Committee appointed by the Director General under clause ( i) of sub- regulation ( 1 ) of regulation 9;
(ii) clauses (h ) and ( i) shall be omitted .
3. In the principal regulations , in regulation 6 , ----
(i) for the words and letter " Selection Committee- A" at both places they occur , the words 'Assessment Committee " shall be substituted;
(ii) in sub - regulation (4) , for the figures " 1988 " , the figures " 2007 " shall be substituted.

4. Inthe Principal regulations , in regulation 7 , in sub- regulation (7 ) , for the figures " 1988 " , the figures "2007 " shall be substituted .
5. In the Principal regulations , in regulation 8, the words' on the Standing Staff Committee ' shall be omitted.
6. In the Principal regulations , after regulation 8, the following regulations shall be inserted , namely :--
"8A. Appointing Authority. Appointments to all posts shall be made by the appointing authority on the recommendations of, :-
(a) in the case of appointment to the posts of Scientist - F and Scientist-G,by the Departmental Peer Review Committee;
(b) in the case of appointment to the posts of Scientist-B to Scientist - E, by the Assessment Committee:
Provided that no appointments to the posts of Scientist-F and Scientist -G shall be made without the prior approval ofthe Central Government .
Provided further that the officiating appointments may be made by the appointing authority without recom- mendations of the appropriate Selection Committee sub- ject to the condition that in case such appointments are for a period exceeding six months , approval of the Central Governmentshall be obtained . "
