सा.का.नि. 887(अ).- केन्द्रीय सरकार सीमाशुल्क अधिनियम 1962 (1962 का 52) की धारा 25 की उपधारा (1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , यह समाधान हो जाने पर कि लोकहित में ऐसा करना आवश्यक है , भारत सरकार के वित्त मंत्रालय ( राजस्व विभाग) की अधिसूचना सं0 21 / 2002 - सीमाशुल्क, तारीख 1 मार्च, 2002 , सा0 का0नि0 118 (अ) , तारीख 1 मार्च , 2002 में निम्नलिखित और संशोधन करती है अर्थातः-
उक्त अधिसूचना में,
(i) क्रम सं0 400 के सामने , स्तंभ ( 3) की प्रविष्टि में, प्रविष्टि निम्नलिखित प्रविष्टियां प्रतिस्थापित की जायेगी; " भारत सरकार के विद्युत मंत्रालय में संयुक्त सचिव या उनसे उच्च अधिकारी द्वारा प्रमाणित मेघा पॉवर प्रोजेक्ट के लिए माल-
(क) जम्मू और कश्मीर , सिक्किम , अरूणाचल प्रदेश, असम, मेघालय , मनीपुर, मिजोरम, नागालैंड और त्रिपुरा में स्थित थर्मल पॉवर प्रोजेक्ट जिसकी क्षमता 700 मेगावाट या उससे अधिक हो ; या
(ख) खंड (क) में विनिर्दिष्ट राज्यों को छोड़कर किसी भी राज्य में स्थित थर्मल पॉवर प्रोजेक्ट जिसकी क्षमता 1000 मेगावाट या उससे अधिक हो; या
(ग) जम्मू और कश्मीर , सिक्किम , अरूणाचल प्रदेश , असम , मेघालय , मनीपुर, मिजोरम, नागालैंड और त्रिपुरा में स्थित हाइडेल पॉवर प्रोजेक्ट जिसकी क्षमता 350 मेगावाट या उससे अधिक हो; या
(घ) खंड ( ग) में विनिर्दिष्ट राज्यों को छोड़कर किसी भी राज्य में स्थित हाइडेल पॉवर प्रोजेक्ट जिसकी क्षमता 500 मेगावाट या उससे अधिक हो;";

स्पष्टीकरणः यह छूट प्रयोजन के लिए, मेघा पॉवर प्रोजेक्ट का मतलब उपरोक्त क्रम सं० 400
ख . उपाबंध में, शर्त सं 0 86 में , खंड ( क ) के उप-खंड ( ii ) के स्थान पर निम्नलिखित प्रतिस्थापित किये जायेंगे , अर्थातः- "विद्युत मंत्रालय द्वारा क्रम शक्ति द्वारा राज्यों में सुधार करना शुरू करेगा "

G.S.R. 887 (E ). In exercise of the powers conferred by sub - section ( 1 ) of section 25 of the Customs Act, 1962 (52 of 1962) , the Central Government , on being satisfied that it is necessary in the public interest so to do , hereby makes the following further amendments in the notification of the Government of India in the Ministry of Finance ( Department of Revenue) No. 21 /2002- Customs , dated the 1st March . 2002 . which was published in the Gazette of India , Extraordinary vide number G.S.R. 118 ( E) . dated the 1 March , 2002 , namely: -
In the said notification , -
A. in the Table ,
(i) against S.No.400 , for the entry in column (3 ) , the following entry shall be substituted , namely : -
"Goods required for setting up of any Mega Power Project . so certified by an officer not below the rank of a Joint Secretary to the Government of India in the Ministry of Power , that is to say-
( a) a thermal power plant of a capacity of 700MW or more , located in the States of Jammu and Kashmir, Sikkim , Arunachal Pradesh , Assam , Meghalaya , Manipur , Mizoram , Nagaland and Tripura; or
(b ) a thermal power plant of a capacity of 1000MW or more , located in States other than those specified in clause ( a ) above ; or [ भाग II- खण्ड 3(i ) ]

Explanation: For the purposes of this exernption , Mega Power project means a project as defined in S. No. 400 above .
B. in the Annexure , in Condition No. 86 , for sub - clause ( ii ) of clause ( a) , the following shall be substituted, namely: -
"( ii ) the power purchasing states shall undertake to carry out distribution reforms as laid down by Ministry of Power. ".

सा.का.नि. 888(अ ).- केन्द्रीय सरकार सीमाशुल्क अधिनियम 1962 (1962 का 52) की धारा 25 की उपधारा ( 1 ) के साथ पठित वित्त सं० (2) अधिनियम 2004 (2004 का 23) की धारा 91 तथा 94 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , यह समाधान हो जाने पर कि लोकहित में ऐसा करना आवश्यक है, भारत सरकार के वित्त मंत्रालय (राजस्व विभाग) की अधिसूचना सं0 69/2004- सीमाशुल्क, तारीख 9 जुलाई, 2004 जो भारत के राजपत्र , असाधारण सा० का०नि० 411 (1 ) , तारीख 9 जुलाई , 2004 द्वारा प्रकाशित की गई थी , में निम्नलिखित और संशोधन करती है अर्थात
उक्त अधिसूचना में,
(क) प्रस्तावना में, परंतुक में , सं० और शब्द अर्थात, " 5 से 12" के स्थान पर सं० और शब्द " 5 से 12 और 55" प्रतिस्थापित किया जायेगा;

In exercise of the powers conferred by sub - section ( 1 ) of section 25 of the Customs Act, 1962 (52 of 1962 ) , read with section 91 and section 94 of the Finance (No.2 ) Act . 2004 (23 of 2004 ) . the Central Government, on being satisfied that it is necessary in the public interest so to do . hereby makes the following further amendments in the notification of the Government of India in the Ministry of Finance (Departinent of Revenue) , No.69/2004- Customs , dated the 9th July , 2004 which was published in the Gazette of India, Extraordinary , vide number G.S.R. 411 (E) , dated the 9th July 2004 , namely: -
In the said notification.
(A) in the preamble , in the proviso , for the figures and words namely, " 5 to 12 " , figures and words .. " 5 to 12 and 55 " . shall be substituted:
(B) in the Table , after S. No. 54 and the entries relating thereto , the following S. No. and entries shall be inserted, namely: -
(1) (2) "55. All goods falling under heading 9801 covered under S. No. 400A of the Table annexed to the notification No. 21 / 2002- Customs , dated 1st March , 2002 , published in the Gazette of India vide number G.S.R. 118 (E ) dated 1st March , 2002 " .
