विषय: चावल का निर्यात एम ई पी और शर्तों से संबंधित का. आ. 3204(अ) विदेश व्यापार नीति , 2009-2014 के पैरा 1.3 और पैरा 2.1 के साथ पठित विदेश व्यापार ( विकास और विनियमन ) अधिनियम , 1992 ( 1992 की संख्या 22 ) की धारा 3 ( 2) के साथ पठित धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्र सरकार समय - समय पर यथासंशोधित अधिसूचना सं . 93 ( आर ई-2007)/2004-2009 दिनांक 1 अप्रैल , 2008 , अधिसूचना सं.. 83 ( आर ई-2008 )/2004-2009 दिनांक 27 जनवरी , 2009 और अधिसूचना सं. 5/2009-2014 दिनांक 7 सितम्बर , 2009 के साथ पठित अधिसूचना सं. 38 ( आर ई -2007 )/2004-2009 दिनांक 15 अक्तूबर , 2007 में तत्काल प्रभाव से , एतदद्वारा निम्नलिखित संशोधन करती है : -
2. एम ई पी की संगणना के लिए विदेशी कमीशन से संबंधित शर्त के बारे में संबंधित अधिसूचना सं. 5/2009-2014 दिनांक 7 सितम्बर , 2009 के पैरा 3 को वापस लेते हुए निम्नानुसार प्रतिस्थापित किया जाता है : -
" यदि निर्यात के समय या उसके बाद कोई विदेशी कमीशन अदा की जाती है , तो एम ई पी अदा की गई/देय विदेशी कमीशन की सीमा तक, 900 अमरीकी डॉलर प्रति टन से अधिक होगी , तथा विदेशी कमीशन के अलावा 900 अमरीकी डॉलर प्रति टन की एम ई पी को सुनिश्चित किया जाएगा । " 3. इसे लोकहित में जारी किया जाता है ।

Subject: Export of Rice- MEP and conditions regarding S.O.3204 (E ) . In exercise of the powers conferred by Section 5 read with Section 3(2) of the Foreign Trade (Development and Regulation) Act , 1992 (No. 22 of 1992) and also read with Para 1.3 and Para 2.1 of the Foreign Trade Policy , 2009-2014 , the Central Government hereby makes with immediate effect, the following amendment to Notification No. 38 ( RE - 2007 )/ 2004-2009 , dated 15thOctober, 2007 read with Notification No. 93 (RF -2007)/ 2004-2009dated 1st April , 2008 Notification No. 83 (RF - 2008) / 2004-2009 dated 27th January , 2009 , and Notification No. 5/2009-2014 dated 7th September , 2009 , as amended from time to time.
2. Para 3 of Notification No. 5/2009-2014 dated 7thSeptember, 2009 relating to condition regarding foreign commission for computation of MEP shall stand withdrawn and substituted as under :
"In case any foreign commission is paid at the time of exports or subsequently then MEP shall be higher than US $ 900 per ton , to the extent of foreign commission paid/payable and MEP of US $ 900 per ton shall be maintained, exclusive of the foreign commission."
3. This issues in public interest . "
