सं. भा.आ.प. - 211 (1 )/2009 ( नैतिकता )/ 55667.- भारतीय आयुर्विज्ञान परिषद् अधिनियम , 1956 ( 1956 का 102 ) की धारा 33 द्वारा प्रदत्त शक्तियों का इस्तेमाल करते हुए , " भारतीय आयुर्विज्ञान परिषद् ( व्यावसायिक आचरण , शिष्टाचार एवं नैतिकता) विनियमावली , 2002 में पुनः संशोधन करने हेतु भारतीय आयुर्विज्ञान परिषद्, भारत सरकार के पूर्व अनुमोदन से एतद्वारा निम्नलिखित विनियम बनाती है , नामतः:-
1. (i ) इन विनियमों को " भारतीय आयुर्विज्ञान परिषद् (व्यावसायिक आचरण , शिष्टाचार एवं नैतिकता ) (संशोधन ) विनियमावली, 2009 भाग I " कहा जाए ।
(ii) वे सरकारी राजपत्र में उनके प्रकाशन की तारीख से
प्रवृत्त होंगे ।
2. " भारतीय आयुर्विज्ञान परिषद् ( व्यावसायिक आचरण, शिष्टाचार एवं नैतिकता ) विनियमावली , 2002 " में निम्नलिखित परिवर्धन/संशोधन/ विलोप/प्रतिस्थापन दर्शाए जाएंगे :-
3. खण्ड 6.7 के पश्चात् निम्नलिखित खण्ड जोड़ा
जाएगा :-
"6.8 फार्मास्यूटीकल एवं संबद्ध स्वास्थ्य सेक्टर उद्योग के साथ अपने संबंधों में डॉक्टरों और डॉक्टरों के व्यावसायिक संघ के लिये आचरण संहिता ।

6.8.1 फार्मास्यूटीकल एवं संबद्ध स्वास्थ्य सेक्टर उद्योग के साथ कार्य व्यवहार में , कोई चिकित्सक नीचे दी गई प्रतिबंध शर्तों का पालन करेगा :
(क) उपहार: कोई चिकित्सक , किसी फार्मास्यूटीकल या संबद्ध स्वास्थ्य सुरक्षा उद्योग और उनके बिक्रीकर्ताओं या प्रतिनिधियों से कोई उपहार प्राप्त नहीं करेगा;
(ख) यात्रा सुविधाएं : कोई चिकित्सक, किसी प्रतिनिधि के रूप में किन्हीं सम्मेलनों, संगोष्ठियों, कार्यशालाओं , सी एम ई कार्यक्रमों आदि में भाग लेने हेतु या छुट्टियों में स्वयं अथवा अपने परिवार के सदस्यों के लिए किसी फार्मास्यूटीकल या संबद्ध स्वास्थ्य सुरक्षा उद्योग अथवा उनके प्रतिनिधियों से रेल , वायुयान , जलयान , परिभ्रमण टिकटों , भुगतान प्रदत्त छुट्टियों आदि सहित देश में या देश के बाहर कोई यात्रा सुविधा प्राप्त नहीं करेगा;
(ग) आतिथ्य : कोई चिकित्सक, किसी भी बहाने से स्वयं के लिए या अपने परिवार के सदस्यों के लिए व्यक्तिगत रूप से होटल आवास जैसा कोई आतिथ्य स्वीकार नहीं करेगा;
(घ) नकदी या आर्थिक अनुदान कोई चिकित्सक, किसी भी बहाने से व्यक्तिगत हैसियत से व्यक्तिगत उद्देश्य के लिए किसी फार्मास्यूटीकल एवं संबद्ध स्वास्थ्यसुरक्षा उद्योग से कोई नकदी या आर्थिक अनुदान प्राप्त नहीं करेगा । एक पारदर्शी तरीके से अनुमोदित संस्थानों द्वारा अपनाए गए , कानूर/नियमों/दिशानिर्देशों द्वारा निर्धारित की गई

परामर्शदाता के रूप में, अनुसंधाता के रूप में, उपचारी डाक्टर के रूप में कार्य कर सकता है । ऐसा करने में कोई चिकित्सक हमेशा :
रूपात्मकताओं के जरिए , अनुमोदित संस्थानों के माध्यम से चिकित्सा अनुसंधान , अध्ययन आदि के लिए धनराशि प्राप्त की जा सकती है । इसे हमेशा पूरी तरह व्यक्त किया जाएगा;
(i) यह सुनिश्चित करेगा कि उसकी व्यावसायिक निष्ठा और कायम रखी जाए;
(ii) यह सुनिश्चित करेगा कि मरीजों के हित के साथ किसी भी प्रकार से समझौता न किया जाए;
( iii) यह सुनिश्चित करेगा कि यह संबद्धता कानून के दायरे मेंहो;
(iv) यह सुनिश्चित करेगा कि ऐसी संबद्धता/नियोजन पूरी तरह पारदर्शी हों और उन्हें व्यक्त किया जाए ।
(ङ) चिकित्सा अनुसंधान कोई चिकित्सक, फार्मास्यूटीकल एवं संबद्ध स्वास्थ्य सुरक्षा उद्योगों द्वारा वित्तपोषित अनुसंधान परियोजनाएं चला सकता है , उनमें भाग ले सकता है, उनमें काम कर सकता है । किसी चिकित्सक के लिए यह जानना अनवार्य है कि उचित और नैतिक होने के लिए उद्योग द्वारा वित्तपोषित कोई अनुसंधान कार्य/परियोजना आरंभ करने हेतु निम्नलिखित ( i) से (vii ) मदों को पूरा करना अनिवार्य होगा । इस प्रकार ऐसा पद स्वीकार करने मेंकोई चिकित्सक:
(i) यह सुनिश्चित करेगा कि विशेष अनुसंधान प्रस्ताव ( वों ) के लिए संबंधित सक्षम प्राधिकारियों से उचित अनुमति प्राप्त है ;
(ज) पृष्ठांकन: कोई चिकित्सक, उद्योग की किसी औषधि या उत्पाद का पृष्ठांकन सार्वजनिक रूप से नहीं करेगा । ऐसे उत्पादों की प्रभावोत्पादकता या अन्यथा पर किया गया कोई अध्ययन , उपयुक्त वैज्ञानिक निकायों को और/या के माध्यम से प्रस्तुत किया जाएगा या एक उचित तरीके से उपयुक्त वैज्ञानिक जर्नल में प्रकाशित किया जाएगा । "
(ii) यह सुनिश्चित करेगा कि अनुसंधान प्रस्ताव( वों) के लिए राष्ट्रीय/ राज्य/संस्थागत नैतिकता समितियों/निकायों कीस्वीकृति प्राप्त है;

[विज्ञापन 111/4/100/09-असा. ) (iii) यह सुनिश्चित करेगा कि वह, चिकित्सा अनुसंधान के लिए निर्धारित सभी कानूनी शर्तों को पूरा करता हो;
(iv) यह सुनिश्चित करेगा कि वित्तपोषण का स्रोत और धनराशि आरंभ में ही सार्वजनिक रूप से व्यक्त की जाए;
पाद टिप्पणी : प्रधान विनियमावली नामतः " भारतीय आयुर्विज्ञान परिषद् ( व्यावसायिक आचरण , शिष्टाचार एवं नैतिकता) विनियमावली , 2000 " भारत के राजपत्र के भाग III , खण्ड 4 में दिनांक 6 अप्रैल , 2002 को प्रकाशित की गई थी और इसे भा.आ.प. के दिनांक 22-2-2003 और 26-5-2004 के अंतर्गत संशोधित किया गया था ।
(v) यह सुनिश्चित करेगा कि स्वैच्छिक कार्यकर्ताओं को उचित स्वास्थ्य सुरक्षा और सुविधा उपलब्ध कराई जाए , यदिवे अनुसंधान परियोजना( ओं ) के लिए आवश्यक हैं;

(vi ) यह सुनिश्चित करेगा कि पशुओं पर अनावश्यक प्रयोग न किया जाए और जब ऐसा करना आवश्यक हो तो ऐसे प्रयोग , वैज्ञानिक और मानवोचित तरीके से किए जाएं;
No. MCI- 211 ( 1 )/2009 ( Ethics ) /55667 .--In exercise of the powers conferred by Section 33 of the Indian Medical Council Act, 1956 ( 102 of 1956) , the Medical Council of India with the previous sanction of the Central Government, hereby makes the following Regulations to amend the. " Indian Medical Council ( Professional Conduct, Etiquette and Ethics) Regulations , 2002 : -..
(vii) यह सुनिश्चित करेगा कि कोई कार्य स्वीकार करते समय किसी चिकित्सक को यह स्वतंत्रता होगी कि वह किसी ऐसे कार्य के लिए समझौता ज्ञापन या किसी अन्य दस्तावेज/करार में एक खण्ड जोड़कर समाज के वृहत्तर हित में अनुसंधान के परिणाम प्रकाशित कर सके ।
1. ( i) These Regulations maybe called the " Indian Medical Council (Professional Conduct , Etiquette and Ethics) (Amendment) Regulations , 2009 Part 1 " .
(ii) They shall come into force from the date oftheir publication in the Official Gazette .
( च) व्यावसायिक स्वायत्ता बनाए रखना: फार्मास्यूटीकल एवं संबद्ध स्वास्थ्य सुरक्षा उद्योग के साथ कार्य व्यवहार करने में कोई चिकित्सक हमेशा यह सुनिश्चित करेगा कि या तो उसकी अपनी स्वायत्तता और/ या चिकित्सा संस्थान की स्वायत्तता और स्वतंत्रता के साथ कोई समझौता न किया जाए;
2. In the " Indian Medical Council ( Professional Conduct , Etiquette and Ethics ) Regulations , 2002 " , the following additions/ modifications/ deletions/ substitutions , shall be , as indicated therein :--
( छ) संबद्धता : कोई चिकित्सक , फार्मास्यूटीकल एवं संबद्ध स्वास्थ्यसुरक्षा उद्योगों के लिए , सलाहकार की हैसियत से , भारत का राजपत्र असाधारण

3. The following clause shall be added after clause
6.7
"6.8 Code of conduct for doctors and professional association of doctors in their relationship with pharma- ceutical and allied health sector industry.
6.8.1 In dealing with pharmaceutical and allied health sector industry, a medical practitioner shall follow and adhere to the stipulations given below :-
(a) Gifts : A medical practitioner shall not receive anygift from any pharmaceutical or allied health care industry and their sales people or represen- tatives.
(b) Travel facilities : A medical practitioner shall
not accept any travel facility inside the country or outside, including rail, air , ship , cruise tickets, paid vacations , etc. from any pharmaceutical or allied healthcare industry or their representatives for self and family members for vacation or for attending conferences , seminars , workshops , CME programme etc. as a delegate .
(c) Hospitality : A medical practitioner shall not accept individually any hospitality like hotel accommodation for self and family members under any pretext .
(d) Cash or monetary grants : A medical practi- tioner shall not receive any cash or monetary grants from any pharmaceutical and allied healthcare industry for individual purpose in individual capacity under any pretext. Funding for medical research , studyetc. can only be received through approved institutions by modalities laid down by law/ rules/guidelines adopted by such approved institutions , in a transparent manner . It shall always be fully disclosed .
(e) Medical Research : A medical practitioner may carryout , participate in , work in research projects funded by pharmaceutical and allied healthcare industries . A medical practitioner is obliged to know that the fulfillment of the following items ( i ) to (vii ) will be an imperative for undertaking any research assignment /project funded by industry for being proper and ethical . Thus , in accepting such a position a medical practitioner shall :-
(i) Ensure that the particular research proposal (s) has the due permission from the competent concerned authorities ;
(ii) Ensure that such a research project( s) has the clearance of national/ state/institutional ethics committee /bodies;
( iii) Ensure that it fulfils all the legal requirements prescribed for medical research ;

(iv) Ensure that the source and amount of funding ispublicly disclosed at the beginning itself;
(v) Ensure that proper care and facilities are provided to human volunteers , if they arc nceessary for the research project( s ) ;
(vi ) Ensure that undue animal experimentations arc not done and when these are necessary they are done in a scientific and a humane way;
(vii) Ensure that while accepting such an assign- ment a medical practitioner shall have the freedomto publish the results of the research in the greater interest of the society by inserting such a clause in the MoU or any other document/ agreement for any such assignment .
(f) Maintaining Professional Autonomy : In dealing with pharmaceutical and allied healthcare industry a medical practitioner shall always ensure that there shall never be any compromise either with his/her own professional autonomy and/or with the autonomy and freedom of the medical institution .
(g) Affiliation : A medical practitioner may work for pharmaceutical and allied healthcare industries in advisory capacities , as consultants , as researchers , as treating doctors or in any other professional capacity. In doing so , a medical practitioner shall always :
(i) Ensure that his professional integrity and free- dom are maintained;
(ii) Ensure that patients interest are not compro- mised in any way;
(iii) Ensure that such affiliations are within the law;
(iv) Ensure that such affiliations/employments are fully transparent and disclosed .
(h) Endorsement : A medical practitioner shall not endorse any drug or product of the industry publically. Any study conducted on the efficacy or otherwise of such products shall be presented to and/ or through appropriate scientific bodics or published in appropriate scientific journals in a proper way" .
