सं. भा.आ.प. - 12 ( 2 )/2009-मेडि-विविध/56925.- भारतीय आयुर्विज्ञान परिषद् अधिनियम , 1956 (1956 का 102) की धारा 33 द्वारा प्रदत्त शक्तियों का इस्तेमाल करते हुए , 'चिकित्सा संस्थानों में शिक्षकों के लिए न्यूनतम शैक्षिक योग्यता विनियमावली, 1998 में पुनः संशोधन करने हेतु, भारतीय आयुर्विज्ञान परिषद्, केंद्रीय सरकार के पूर्व अनुमोदन से एतद्वारा निम्नलिखित विनियम बनाती है, नामतः-

1. (i ) इन विनियमों को " चिकित्सा संस्थानों में शिक्षकों के लिए न्यूनतम शैक्षिक योग्यता (संशोधन) विनियमावली, 2009 भाग- III" कहा जाए ।

(ii) वे सरकारी गजट में उनके प्रकाशन की तारीख से प्रवृत्त होंगे ।

2. "चिकित्सा संस्थानों में शिक्षकों के लिए न्यूनतम शैक्षिक योग्यता विनियमावली, 1998 " में निम्नलिखित परिवर्धन / संशोधन /विलोप/ प्रतिस्थापन दर्शाए जाएंगेः-

3 (क ) " चिकित्सा संस्थानों में शिक्षकों के लिए न्यूनतम शैक्षिक योग्यता (संशोधन) विनियमावली, 2009" के अंतर्गत यथासंशोधित विनियमावली को " प्रोफेसर" शीर्षक के अंतर्गत खंड 4(क) में, खंड 4 (क) (ii) में निम्नलिखित परंतुक जोड़कर संशोधित किया जाएः-

[PART III-SEC . 4] " बशर्ते कि संबंधित विशेषताओं वाली राष्ट्रीय एसोसिएशनों / सोसाइटियों द्वारा जर्नलों में प्रकाशित/ पहले लेखक के रूप में प्रकाशन हेतु ये अनुसंधान प्रकाशन , स्वीकृत किये गये हों । पुनः बशर्ते कि प्रोफेसर के पद पर पदोन्नति हेतु 4 अनुसंधान प्रकाशनों की शर्त संचयी आधार पर मानी जानी चाहिए । इसके साथ कम से कम दो अनुसंधान प्रकाशन एसोसिएट प्रोफेसर के कार्यकाल के दौरान प्रकाशित किए जाने चाहिए ।

पुनः बशर्ते कि 24 जुलाई, 2009 से चार वर्ष की पारगमन अवधि के लिए, प्रोफेसर के पद पर नियुक्ति / पदोन्नति , " चिकित्सा संस्थानों में शिक्षकों के लिए न्यूनतम शैक्षिक योग्यता (संशोधन) विनियमावली , 2009 " की अधिसूचना से पहले लागू " चिकित्सा संस्थानों में शिक्षकों के लिए न्यूनतम शैक्षिक योग्यता विनियमावली, 1998 " के अनसार संस्थानों द्वारा की जा सकती है । "

(ख) " चिकित्सा संस्थानों में शिक्षकों के लिए न्यूनतम शैक्षिक योग्यता (संशोधन ) विनियमावली, 2009 " के अंतर्गत यथासंशोधित विनियमावली को " एसोसिएट प्रोफेसर " शीर्षक के अंतर्गत खंड 4 (ख) में, खंड 4(ख) (ii ) में निम्नलिखित परंतुक जोड़कर संशोधित किया जाएः-

पुनः बशर्ते कि 24 जुलाई, 2009 से पांच वर्ष की पारगमन अवधि के लिए , एसोसिएट प्रोफेसर के पद पर नियुक्ति/ पदोन्नति, " चिकित्सा संस्थानों में शिक्षकों के लिए न्यूनतम शैक्षिक योग्यता (संशोधन) विनियमावली, 2009 " की अधिसूचना से पहले लागू "चिकित्सा संस्थानों में शिक्षकों के लिए न्यूनतम शैक्षिक योग्यता विनियमावली , 1998 " के अनसार संस्थानों द्वारा की जा सकती है । " भारत का राजपत्र असाधारण

4 (क) "चिकित्सा संस्थानों में शिक्षकों के लिए न्यूनतम शैक्षिक योग्यता ( संशोधन) विनियमावली, 2009" के अंतर्गत यथासंशोधित विनियमावली को 'प्रोफेसर " शीर्षक के अंतर्गत खंड 5(क) में, खंड 5(क) (ii) में निम्नलिखित परंतुक जोड़कर संशोधित किया जाए:-

5 (क) "अकादमिक शैक्षिक योग्यता, अध्यापन और अनुसंधान अनुभव की शर्त " शीर्षक के अंतर्गत सारणी -1 में " दंत चिकित्सा " विषय के बाद निम्नलिखित जोड़ा जाएगाः-

"(I) एम.डी. (आपातकालीन मेडिसिन)

एम.डी. (जनरल मेडिसिन ) 2 वर्ष के प्रशिक्षण सहित

(क) प्रोफेसर

एम.एस. (जनरल सर्जरी )

टिप्पणीः ऊपर दर्शाई गई अकादमिक शैक्षिक योग्यता को अधिसूचना की तारीख से दस वर्ष की अवधि के लिए अध्यापन संकाय के पद हेतु आवश्यक अकादमिक शैक्षिक योग्यता माना जाएगा । इस बात को दोहराया जाता है कि केवल एम.डी. (आपातकालीन मेडिसिन ) की अकादमिक शैक्षिक योग्यता, अधिसूचना की तारीख से 10 वर्ष की अवधि समाप्त हो जाने के पश्चात अध्यापन संकाय के पद के लिए नियुक्ति हेतु आवश्यक अकादमिक शैक्षिक योग्यता होगी । "

MEDICAL COUNCIL OF INDIA

NOTIFICATION

New Delhi , the 15th December , 2009

No. MCI - 12 (2 )/2009-Med.Misc./56925.- In exercise of the powers conferred by Section 33 of the Indian Medical Council Act , 1956 ( 102 of 1956) , the Medical Council of India with the previous sanction of the Central Government , hereby makes the following Regulations to further amend the " Minimum Qualifications for Teachers in Medical Institutions Regulations 1998 " , namely: -

1. (i) These Regulations may be called the " Minimum Qualifications for Teachers in Medical Institutions (Amendment) Regulations , 2009 Part- III" .

( ii) They shall come into force from the date of their publication in the Official Gazette.

2. In the "Minimum Qualification for Teachers in Medical Institutions Regulations , 1998 " , the following additions/ modifications /deletions / substitutions , shall be , as indicated therein: -

3 (a). In Clause 4(A) under the heading " Professor" as amended vide " Minimum Qualification for Teachers in Medical Institutions ( Amendment ) Regulations , 2009" , be further amended by inserting the following proviso in 4(A) ( ii ) : -

"Provided that these research publications are published/ accepted for publication in the Journals by the National Associations /Societies of the respective specialities as the First Author. Further provided that the requirement of 4 research publications for promotion to the post of Professor should be taken on cumulative basis with minimum of 2 research publications must be published during the tenure of the Associate Professor .

Further provided that for the transitory period of 4 years w.e.f. 24th July , 2009 , the appointment/promotion to the post of Professor can be made by the institutes in accordance with the " Minimum Qualifications for Teachers in Medical Institutions Regulations , 1998 " as prevailing before notification of " Minimum Qualifications for Teachers in Medical Institutions (Amendment ) Regulations , 2009".

(b). In Clause 4 (B ) under the heading " Associate Professor " as amended vide "Minimum Qualification for Teachers in Medical Institutions ( Amendment) Regulations , 2009 " , be further amended by inserting the following proviso in 4(B)( ii) : -

"Provided that these research publications are published/ accepted for publication in the Journals by the National Associations/ Societies of the respective specialities as the First Author. Further provided that the requirement of 2 research publications for promotion to the post of Associate Professor should be fulfilled with 2 research publications must be published during the tenure of the Assistant Professor .

Further provided that for the transitory period of 5 years w.e.f. 24th July , 2009, the appointment/promotion to the post of Associate Professor can be made by the institutes in accordance with the " Minimum Qualifications for Teachers in Medical Institutions Regulations , 1998 " as prevailing before notification of "Minimum Qualifications for Teachers in Medical Institutions (Amendment) Regulations , 2009".

Further provided that the requirement of 2 research publications for promotion to the post of Associate Professor should be fulfilled with 2 research publications must be published during the tenure of the Assistant Professor .

Further provided that for the transitory period of 2 years w.e.f. 24th July, 2009, the appointment/promotion to the post of Associate Professor can be made by the institutes in accordance with the " Minimum Qualifications for Teachers in Medical Institutions Regulations , 1998 " as prevailing before notification of "Minimum Qualifications for Teachers in Medical Institutions (Amendment) Regulations , 2009" .
