का.आ. 3237(अ). वायुयान अधिनियम, 1934 ( 1934 का 22 ) के खण्ड १ ए के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्र सरकार, मतानुसार कि विमान प्रचालनों की सुरक्षा के लिए ऐसा करना आवश्यक तथा समीचीन है , एतद्वारा दिनांक 30 जून, 2008 के का.आ. 1589 ( अ ) के तहत भारत के राजपत्र , असाधारण के भाग II , खण्ड 3 , उप- खण्ड ( ii ) में प्रकाशित नागर विमानन मंत्रालय से संबंधित भारत सरकार की अधिसूचना में निम्नलिखित संशोधन करती है , यथा:-
उक्त अधिसूचना में;
(i ) पैरा 1 के स्थान पर निम्नलिखित पैरा को प्रतिस्थापित किया जाएगा यथा: -
" 1. मौजूदा सिविल तथा मिलिट्री एयरड्रमों या उनके लिए जिनके लिए इस अधिसूचना के अनुबंध 7 में यथा सूचीबद्ध सरकार द्वारा ' सैद्धातिक स्वीकृति' प्रदान की गई है , के संबंध में इस अधिसूचना के अनुबंध में विनिर्दिष्ट सीमाओं के भीतर किसी भी भवन का निर्माण या ढ़ांचा नहीं खड़ा किया जाएगा , या किसी भूमि पर कोई पेड़ नहीं लगाया जाएगा , ऐसे स्थान पर एयरड्रमों का निर्माण या विकास किया जाना है तथा सक्षम प्राधिकरण द्वारा भविष्य में अधिसूचित किया जाना , जहां ऐसी भूमि पर कोई भवन, ढ़ांचा या पेड़ है , तो ऐसे भवन , ढ़ांचे या पेड़ का स्वामी या नियंत्रण रखने वाला व्यक्ति तत्काल किन्तु सरकारी राजपत्र में इस अधिसूचना के प्रकाशन की तारीख से एक महीने की अवधि के भीतर- भीतर ऐसे भवन या ढ़ांचे जैसा भी मामला हो , को गिरायेगा या, ऐसे पेड़ को काटेगा; "
(ii) अनुबंध VII में, ' अनुबंध VII के भाग V ' और तत्संबंधी प्रतिष्टियां के पश्चात , निम्नलिखित प्रविष्टि को शामिल किया जाएगा है यथाः
" अनुबंध VII का भाग VI"
उन एयरड्रमों की सूची जिनके बारे में सरकार ने एयरड्रमों को स्थापित करने के लिए "सैद्धांतिक रूप से " स्वीकृति प्रदान की है

MINISTRY OF CIVIL AVIATION
NOTIFICATION
New Delhi , the 16th December , 2009
S.O. 3237 ( E) . In exercise of the powers conferred hy Section 9A of the Aircraft Act, 1934 (22 of 1934 ), the Central Government, being of the opinion that it is necessary and expedient so to do for the safety of aircraft operations , hereby makes the following amendments in the notification of the Government of India in the Ministry of Civil Aviation, published in the Gazette of India , Extraordinary, Part II , Section 3 , Sub- section ( ii) , vide number S.O. 1589 (E ) , dated the 30th June , 2008 , namely :-
In the said notification;
(i ) for para 1, the following para shall be substituted , namely: ---
"1. No building or structure shall be constructed or erected , or no tree shall be planted on any land within the limits specified in Annexure 1 to this notification in respect of Civil and Military Aerodromes existing or for which ' in- principle ' approval has been accorded by the Government as listed in Annexure VII to this notification , aerodromes to be constructed or developed and notified by the Competent Authority in the future where there is any building, structure or tree on such land , the owner or the person having control of such building , structure or tree shall demolish such building or structure or , as the case may be , cut such tree, forthwith but not later than a period of one month from the date of publication of this notification in the Official Gazette ." ;
(ii) In Annexure VII , after " part V of Annexure VII " and the entries relating thereto , the following shall be inserted namely:
