सा.का.नि. 901(अ). केन्द्रीय सरकार, पौधा किस्म और कृषक अधिकार संरक्षण अधिनियम, 2001 ( 2001 का 53 ) की धारा 96 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, पौधा किस्म और कृषक अधिकार संरक्षण नियम , 2003 का संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:-
1. ( 1 ) इन नियमों का संक्षिप्त नाम पौधा किस्म और कृषक अधिकार संरक्षण ( तीसरा संशोधन ) नियम, 2009 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. पौधा किस्म और कृषक अधिकार संरक्षण नियम, 2003
में,
( क) दूसरी अनुसूची के स्तंभ (3 ) में,-
(i) क्रम सं. 4 के सामने , प्रविष्टियों के स्थान पर , निम्नलिखित प्रविष्टियां रखी जाएंगी , अर्थात्:-
"व्यष्टि-5,000 रु.
शैक्षणिक-7,000 रु.
वाणिज्यिक 10,000 रु. " ;
(ii ) क्रम सं. 5 के सामने , प्रविष्टियों के स्थान पर , निम्नलिखित प्रविष्टियां रखी जाएंगी , अर्थात्:-
" व्यष्टि-5,000 रु .
शैक्षणिक-- 7,000 रु.
वाणिज्यिक 10,000 रु.
प्रतिवर्ष";

(1) (iii) क्रम सं. 8 के सामने , प्रविष्टियों के स्थान पर , निम्नलिखित प्रविष्टियां रखी जाएंगी, अर्थात्:
"व्यष्टि-3,000 रु.
शैक्षणिक-5,000 रु.
वाणिज्यिक 7,000 रु.";
(ख) चौथी अनुसूची में, -
(i ) क्रम सं. 2 के सामने स्तंभ ( 4) में विधि सलाहकार के पद से संबंधित विद्यमान प्रविष्टि के स्थान पर , निम्नलिखित प्रविष्टि रखी जाएगी, अर्थात्:-
" अवरसचिव" ;
(ii) क्रम सं. 4 में प्रविष्टि , लेखा अधिकारी के पद का लोप किया जाएगा ।
(iii ) क्रम सं. 5 के सामने स्तंभ ( 3 ) में तकनीकी सहायक के पद से संबंधित, विद्यमान प्रविष्टि के स्थान पर, निम्नलिखित प्रविष्टि रखी जाएगी , अर्थात्:-
" 1 ";
(iv) क्रम सं. 6 के सामने स्तंभ ( 3 ) में कंप्यूटर सहायक के पद से संबंधित , विद्यमान प्रविष्टि के स्थान पर , निम्नलिखित प्रविष्टि रखी जाएगी , अर्थात्:-

NOTIFICATION
New Delhi , the 17th December , 2009
(i) against serial number 2, relating to the post of LegalAdviser, in column (4) , for the existing entry, the following entry shall be substituted, namely,
"Under Secretary" ;
(ii) the entry at serial numher 4, relating to the postofAccounts Officer shall be omitted;
G.S.R. 901 ( E). In exercise of the powers conferred by Section 96 of the Protection of Plant Varieties and Farmers' Rights Act, 2001 (53 of 2001 ) , the Central Government hereby makes the following rules to amend the Protection of Plant Varieties and Farmers ' Rights Rules , 2003 , namely:
1. ( 1 ) These rules may be called the Protection of PlantVarieties and Farmers ' Rights (Third Amendment) Rules , 2009 .
(iii) against serial number 5, relating to the post of Technical Assistant, in column ( 3 ), for the existing entry, the following entry shall be substituted , namely,--
" I";
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Protection of Plant Varieties and Farmers ' Rights Rules , 2003,-
(a) in the Second Schedule , in column (3 ), --
(iv) against serial number 6 , relating to the post of Computer Assistant in column (3 ) , for the existing entry, the following entry shall be substituted, namely,-- "6".
[ F. No. 1-7/2009 - SD. V] (i ) against serial number 4 , for the entries , the following entries shall be substituted , namely,-

(ii) against serial number 5 , for the entries , the following entries shall be substituted , namely,

Note : The principal rules were published in the Gazette ofIndia, vide number G.S.R. 738 (E ), dated the 12th September, 2003 and subscquently amended vide G.S.R. 843 (E ), dated the 30th December , 2004 , G.S.R. 731 ( E ) , dated the 14th October , 2008 , G.S.R. 319(E ) , dated the 11th May, 2009 and G.S.R. 783 (E) , dated the 27th October, 2009 .
