का.आ. 3247(अ). केन्द्रीय सरकार , केन्द्रीय रिजर्व पुलिस बल अधिनियम , 1949 ( 1949 का 66 ) की धारा 16 की उप-धारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और केन्द्रीय सरकार के गृह मंत्रालय की अधिसूचना संख्या सा. का. नि. 43 ( अ ) तारीख 25 जनवरी , 1978 जो भारत के राजपत्र , असाधारण , भाग II , खण्ड 3 , उप-खण्ड ( ii ) में उसी तारीख को प्रकाशित की गई थी , का उन बातों के सिवाय अधिक्रांत करते हुए जो ऐसे अधिक्रमण से पहले की गई है या किए जाने का लोप किया गया है , केन्द्रीय सरकार तत्काल प्रभाव से उस उप धारा में विनिर्दिष्ट अपराधों का अन्वेषण करने या उनका विचारण करने के प्रयोजन के लिए ऐसे उपराधों के आनुषंगी जांच करने या विचारण करने के लिए ऐसे प्रत्येक अधिकारी जो तत्समय निम्नलिखित रैंक के हैं, में निहित करती है
( क ) कमाण्डेण्ट और द्वितीय कमान अफसर ( जिसके अंतर्गत समान रैंक के डयूटी आफिसर जो फोर्स में स्थायी नियुक्त हैं और अपने -अपने कार्यालयों में प्रमुख के रूप में घोषित हैं और उक्त स्थापनों/कार्यालयों में नियुक्त कार्मिकों पर पर्यवेक्षण करता है और प्रशासनिक नियंत्रण रखता है ) जो-
(i ) किसी महानगर क्षेत्र के संबंध में कोई महानगर मजिस्ट्रेट; और
( ii ) दंड प्रक्रिया संहिता , 1973 ( 1974 का 2 ) ( जिसें इसमें इसके पश्चात् उक्त संहिता कहा गया है ) के अधीन महानगर क्षेत्र से बाहर के किसी क्षेत्र के संबंध में प्रथम श्रेणी न्यायिक मजिस्ट्रेट है:
परन्तु तत्समय के लिए द्वितीय कमान अफसर का रैंक धारण करने वाला अधिकारी एक वर्ष से अधिक अवधि के लिए कारावास का दंडादेश या जुर्माने से जो 1000 रुपये से अनधिक या दोनों पारित नहीं कर सकेगा जब कि कोई अभियुक्त व्यक्ति किसी विचारण दोषसिद्धि ठहराने वाला और दंडादिष्ट करने वाला हो;
(ख) कमांडेंट ( जिसके अंतर्गत बलों में अन्य स्थायी स्थापनों/कार्यालयों में तैनात साधारण डयूटी आफिसर और अपने-अपने स्थापन /कार्यालय में तैनात कार्मिकों पर पर्यवेक्षण करता है और प्रशासनिक नियंत्रण भी रखता है ) मुख्य महानगर मजिस्ट्रेट या मुख्य न्यायिक मजिस्ट्रेट की शक्तियों का प्रयोग उक्त संहिता के अधीन , उपाबद्ध अनुसूची में विनिर्दिष्ट मामलों के संबंध में करेगा ।

NOTIFICATION
New Delhi , the 18th December , 2009
S.O. 3247 ( E) .-In exercise of the powers conferred by sub - section ( 2 ) of section 16 of the Central Reserve Police Force Act , 1949 (66 of 1949 ) and in supersession of the notification of the Government of India in the Ministry of Hone Affairs , number G.S.R 43 ( E ) , dated the 25th January , 1978 , published in the Gazette of India, Extraordinary, Part . II , Section 3 , Sub - section ( ii ) of the same date , except as regards things done or omitted to be done before such supersession , the Central Government hereby invests , with immediate effect for the purpose of inquiring into or trying offence specified in that sub - section and in respect of all matters , incidental to such inquiry or trial of such offences , every officer holding, for the time being the rank of ----
( a) The Commandant and a Second- in- Command , in a Unit ( including General Duty Officers of equal ranks posted in static establishments in the Force and declared as " Head " of respective office and exercising supervision and administrative control over personnel posted in the said establishment/office ) with all powers of...
(i) a Metropolitan Magistrate , in relation to a Metropolitan area; and
( ii) a Judicial Magistrate of the First Class , in relation to any area out side the Metropolitan arca under the Code of Criminal Procedure , 1973 ( 2 of 1974 ) ( hereinafter referred to as the said code) :
Provided that an officer holding, for the time being the rank of Second- in- Command, shall not pass a sentence of imprisonment for a term exceeding one year , or the fine exceeding one thousand rupees or the both , while convicting and sentencing an accused person in any trial ;
(b ) The Commandant ( including General Duty Officers posted in other static establishments /offices in the Force and declared as "Head" of respective establishment/ office and exercising supervision and administrative control over personnel posted in the said establishment /office with the powers of Chief Metropolitan Magistrate or a Chief Judicial Magistrate , as the case may be , under the said Code , with respect to the matters specified in the Schedule annexed hereto .
