सं. टीएएमपी/6/ 2009- एमबीपीटी. महापत्तन न्यास अधिनियम, 1963 ( 1963 का 38 वां ) की धारा 48 , 49 और 50 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए महापत्तन प्रशुल्क प्राधिकरण एतदद्वारा अपने दरमान की संशोधन करने/समीक्षा करने हेतु मुम्बई पत्तन न्यास से प्राप्त प्रस्ताव को संलग्न आदेशानुसार निपटाता है ।

यह मामला अपने दरमान में संशोधन करने समीक्षा करने के लिए मुम्बई पत्तन न्यास से प्राप्त प्रस्ताव से संबंधित है ।
2.1 इस प्राधिकरण में दिनांक 28 सितम्बर , 2006 के अपने आदेश के द्वारा मुम्बई पत्तन न्यास ( एमबीपीटी ) के दरमान को दिनांक 31 मार्च , 2009 तक की वैधता वाली अवधि के साथ अधिसूचित किया था।
2.2 एमबीपीटी ने 1 अप्रैल , 2009 से प्रभावी अपने दरमान के सामान्य संशोधन के लिए दिनांक 30 जनवरी , 2009 के अपने पत्र के द्वारा प्रस्ताव दाखिल किया। इस प्रस्ताव को संबंधितउपभोक्ताओं ।

उपभोक्ताओं के संगठनों के साथ विचार- विमर्श के लिए रखा गया। प्राधिकरण के दिनांक 27 मार्च , 2009 , 28 जुलाई , 2009 और 23 अक्तूबर , 2009 के आदेशों के द्वारा प्रचलित दरमान की बैधता को भी 31 मार्च , 2010 तक विस्तारित किया था।
2.3 दिनांक 31 मार्च , 2009 के अपने पत्र द्वारा एमबीपीटी ने विभिन्न कारणों से , अपने वर्तमान दरमान को 31 दिसम्बर , 2009 तक जारी रखने और दिनांक 30 जनवरी , 2009 का अपना प्रस्ताव वापिस लेने की अनुमति मांगी थी ।
2.4 चूंकि एमबीपीटी की दरमान की समीक्षा पहले से ही अपेक्षित है और औपचारिक कार्यवाही की प्रक्रिया प्रारंभ की जा चुकी है , इस प्राधिकरण ने विचार किया है कि संबंधित पक्षकारों की बहस/दलीलें सुनने के बाद ही औपचारिक कार्यवाही की प्रक्रिया को खत्म करना उचित होगा। तद्नुसार, एमबीपीटी को सूचित किया गया एवं सलाह दी गई कि यदि आवश्यक समझे तो अपने पस्ताव को अद्यतन कर सकते हैं।
3.1 एमबीपीटी दिनांक 30 अक्तूबर , 2009 और 31 अक्तूबर, 2009 के अपने पत्रों के द्वारा अपने दरमांन के सामान्य संशोधन के लिए संशोधित प्रस्ताव प्रस्तुत कर चुका है । इसके बाद , पत्तन ने दिनांक 9 नवम्बर , 2009 के अपने पत्र के द्वारा प्राधिकरण से अनुरोध किया है कि प्राधिकरण दिनांक 30 अक्तूबर, 2009 के उसके प्रस्ताव को नवीन प्रस्ताव समझें ।
3.2 यह उल्लेखनीय है कि एमबीपीटी के न्यासी मंडल . ने दिनांक 24 मार्च , 2009 के संकल्प संख्या 34 के द्वारा , 30 जनवरी , 2009 के दाखिल प्रस्ताव को वापस लेने का निर्णय लिया है।

3.3 चूंकि पत्तन ने एक नवीन प्रस्ताव दाखिल किया है , यह जरूरी है कि परामर्शी प्रक्रिया नए सिरे से आरंभ की जाए । नवीन प्रस्ताव को पिछली कार्यवाही की प्रक्रिया का हिस्सा समझने से कोई लाभ नहीं होगा ।
4. परिणामस्वरूप , उपरोक्त दिए गए कारणों से और समग्र विचार विमर्श के आधार पर यह प्राधिकरण दिनांक 30 जनवरी, 2009 को एमबीपीटी के द्वारा दाखिल प्रस्ताव वापस ले लिया गया है , ऐसे समझते हुए प्रस्ताव से संबंधित कार्यवाही की प्रक्रिया को बंद करती है।

TARIFF AUTHORITY FOR MAJOR PORTS NOTIFICATION
Mumbai , the 15th December , 2009
No. TAMP/6/2009 - MBPT . In exercise of the powers conferred under Sections 48 , 49 and 50 of the Major Port Trust Act , 1963 ( 38 of 1963 ) , the Tariff Authority for Major Ports hereby disposes of the proposal from the Mumbai Port Trust for revision/review of its Scale of Rates as in the Order appended hereto .

This case relates to the proposal from the Mumbai Port Trust ( MBPT) for revision/ review of its Scale ofRates .
2.1 This Authority vide Order dated 28th September , 2006 had notified the Scale of Rates of Mumbai Port Trust (MBPT) with a validity period till 31st March, 2009.

2.2 By letter dated 30th January , 2009 MBPT filed its proposal for general revision of its Scale of Rates effective from 1st April , 2009. This proposal was taken on consulta- tion with the relevant users/ user organizations . The valid- ity of the existing Scale of Rates was also extended till 31stMarch , 2010 vide this Authority's Orders dated 27th March, 2009, 28th July, 2009 and 23rd October, 2009.
2.3 MBPT vide letter dated 31st March , 2009 sought permission for continuation of the existing SOR till 31st December , 2009 and to withdraw its proposal dated 30th January 2009 for various reasons .
2.4 Since the review of MBPT's Scale of Rates is already due and formal proceedings have already been initiated, this Authority took the view that it would be appropriate to conclude the proceedings only after hear- ing the concerned parties . MBPT was informed accord- ingly and advised to update its proposal , if considered necessary .
3.1 MBPT under letters dated 30th October , 2009 and 31st October , 2009 has submitted a revised proposal for general revision of its Scale of Rates . This was followed by the Port's letter dated 9th November , 2009 , wherein it has requested this Authorityto treat its proposal dated 30thOctober , 2009 as a fresh proposal .
3.2 It is noteworthy that the Board of Trustees of MBPT vide its Resolution No. 34, dated 24th March , 2009 has resolved to withdraw its proposal dated 30 January , 2009.

3.3 Since the Port has filed a new proposal , it is necessary to initiate fresh consultation proceedings . No useful purpose would be served by treating the new proposal as part of the earlier proceedings .
4. In the result , and for the reasons given above and based on a collective application of mind , this Authority closes the proceedings relating to the proposal dated 30th January , 2009 filed by MBPT treating it as withdrawn .
