पर्यावरण और वन मंत्रालय आदेश

का.आ. 3250(अ). भारत सरकार के पर्यावरण और वन मंत्रालय की अधिसूचना सं. 155( अ ) , तरीख 3 फरवरी , 2005 के आदेश द्वारा केन्द्रीय सरकार ने दमण एवं दीव तटीय जोन प्राधि करण का गठन राजपत्र में आदेश के प्रकाशन की तारीख से 31 मार्च , 2005 तक की अवधि के लिए किया था ;
और भारत सरकार के पर्यावरण और वन मंत्रालय के आदेश सं. का.आ. 471 तारीख 31 मार्च , 2005 द्वारा केन्द्रीय सरकार ने दमण एवं दीव तटीय जोन प्राधिकरण के पुनर्गठन की अवधि राजपत्र में उक्त आदेश के प्रकाशन की तारीख से तीन वर्षों के लिए विस्तारित कर दिया था;
और केन्द्रीय सरकार का यह मत है कि उक्त प्राधिकरण की अवधि की समाप्ति पर और अवधि के लिए ऐसे प्राधिकरण का पुनर्गठन किया जाना चाहिए ;
अतः , अब , केन्द्रीय सरकार पर्यावरण ( संरक्षण ) अधिनियम , 1986 ( 1986 का 29 ) ( जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है ) की धारा 3 की उप - धारा ( 1 ) और उप- धारा ( 3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए दमण और दीव तटीय जोन प्राधिकरण का पुनर्गठन राजपत्र में उक्तं आदेश के प्रकाशन की तारीख से तीन वर्षों के लिए करती है जिसमें निम्नलिखित व्यक्ति होंगे , अर्थात्:-
-अध्यक्ष 1. सचिव , ( पर्यावरण और वन ) , दमण और दीव तथा दादरा और नागर हवेली ।

II. प्राधिकरण को, तटीय पर्यावरण कीक्वालिटी के संरक्षण
और उसमें सुधार करने तथा दमण और दीव संघ राज्यक्षेत्र के तटीय क्षेत्रों में पर्यावणीय प्रदूषण के निवारण , उपशमन और नियंत्रण के लिए निम्नलिखित उपाय करने की शक्ति होगी , अर्थात्:-
(i ) तटीय विनियमन जोन क्षेत्रों और केरल राज्य सरकार से प्राप्त तटीय क्षेत्र प्रबंध योजना ( सीजेडएमपी ) में वर्गीकरण के परिवर्तन के उपान्तरणों के प्रस्तावों की परीक्षा करना और उनके लिए राष्ट्रीय तटीय क्षेत्र प्रबंध प्राधिकरण को विनिर्दिष्ट सिफारिशें करना । "

कम से कम एक बार राष्ट्रीय तटीय जोन प्रबंध प्राधिकरण को प्रस्तुत करेगा।
X. प्राधिकरण , यह सुनिश्चित करेगा कि प्राधिकरण की बैठकों के दौरान प्राधिकरण के कम से कम दो तिहाई सदस्य उपस्थित रहते हैं।
XI. प्राधिकरण की पूर्वगामी शक्तियां और कृत्य केन्द्रीय सरकार के पर्यवेक्षण और नियंत्रण के अधीन होंगे ।
(ii ) ( क) उक्त अधिनियम या उसके अधीन बनाए गए नियमों तथा उक्त अधिनियम के उद्देश्यों से संबंधित किसी अन्य विधि के अधीन उपबंधों के कथित उल्लंघन के मामलों की जांच करना और यदि किसी विनिर्दिष्ट मामले में आवश्यक प्रतीत हो तो उक्त अधिनियम की धारा 5 के अधीन निदेश जारी करना , जहां तक कि ऐसे निदेश राष्ट्रीय तटीय जोन प्रबंध प्राधिकरण द्वारा या केन्द्रीय सरकार द्वारा उस विशिष्ट मामले में जारी किए गए किसी निदेश से असंगत न हो ।
XII . प्नाधिकरण का मुख्यालय मोती दमण में स्थित होगा ।
XIII . इस प्रकार गठित प्राधिकरण के विस्तार और अधिकारिता के भीतर विनिर्दिष्टतः न आने वाला कोई विषय संबंधित कानूनी प्राधिकारियों द्वारा द्वारा निपटाया जाएगा।
(ख) उक्त अधिनियम और तद्धीन बनाए गए नियमों या किसी अन्य विधि के अधीन जो उक्त अधिनियम के उद्देश्यों से संबंधित हो , उपबंधों के उल्लंघन करने वाले मामलों का पुनर्विलोकन करना और यदि आवश्यक हो तो ऐसे मामलों को टिप्पणियों के साथ पुनर्विलोकन के लिए राष्ट्रीय तटीय जोन प्रबंध प्राधिकरण को निर्देशित करना :
टिप्पण: - दमण और दीव तटीय जोन प्रबंधन प्राधिकरण का गठन का मूल आदेश सं. का.आ. 17 ( अ) , तारीख 4 जनवरी , 2002 द्वारा किया गया था और अंतिम पुनर्गठन का.आ 155 ( अ ) , तारीख 3 फरवरी , 2005 द्वारा भारत के राजपत्र असाधारण में प्रकाशन द्वारा किया गया।
परन्तु इस उप- पैरा के उप- खण्ड ( क) और ( ख ) के अधीन मामले स्वयं या किसी व्यक्ति या किसी प्रतिनिधि निकाय या किसी संगठन द्वारा की गई शिकायत के आधार पर लिए जा सकेंगे।

(iii) इस पैरा के उप- पैरा ( ii ) के उप- खण्ड ( क ) के अधीन उसके द्वारा जारी किए गए निदेशों के अननुपालन के मामलों में उक्त अधिनियम की धारा 19 के अधीन शिकायतें फाइल करना ।

(iv ) इस आदेश के पैरा 11 के उप- पैरा (i ) और ( ii ) से उत्पन्न हाने वाले विवादों से संबंधित तथ्यों के सत्यापन के लिए उक्त अधिनियम की धारा 10 के अधीन कार्रवाई करना ।
S.O. 3250 (E ) .- Whereas by an Order of the Government of India in the Ministry of Environment and Forests , Number S.O. 155 ( E) , dated the 3rd February, 2005 the Central Government constituted the Daman and Diu Coastal Zone Management Authority from the date of publication of the Order in the Official Gazette up to 31st March , 2005.
III . प्राधिकरण , तटीय विनियमन जोन से संबंधित ऐसे पर्यावरणीय विवादों के संबंध में कार्रवाई करेगा जो उसे , दमण और दीव संघ राज्य क्षेत्र सरकार , राष्ट्रीय तटीय जोन प्रबंध प्राधिकरण या केन्द्रीय सरकार द्वारा विनिर्दिष्ट किए जाएं।
IV. प्राधिकरण , तटीय विनियमन जोन में पारिस्थिति की संवेदनशील क्षेत्रों की पहचान करेगा और ऐसे पहचान किए गए क्षेत्रों के लिए क्षेत्र विनिर्दिष्ट प्रबंध योजनाओं की विरचना करेगा ।
And, whereas , by an Order of the Government of India in the Ministry of Environment and Forests , Number S.O. 471 (E) , dated the 31st March , 2005 the Central Government has extended the period of reconstitution of the Daman and Diu Coastal Zone Management Authority for a period of three years with effect from the date of publications ofthe said order in the Official Gazette;
V. प्राधिकरण , ऐसे तटीय क्षेत्रों की पहचान करेगा जो अपरदन या अपक्षय के लिए अतिसमेद्य क्षेत्र हैं और ऐसे पहचान किए गए क्षेत्रों के लिए क्षेत्र विनिर्दिष्ट प्रबंध योजनाओं की विरचना करेगा ।
Andwhereas , the Central Government is of the view that such an Authority mustbe reconstituted as the term of the said Authority has been expired;
VI . प्राधिकरण , तटीय विनियमन जोन में आर्थिक रूप से महत्वपूर्ण खंडों की पहचान करेगा और उनके लिए एकीकृत तटीय जोन प्रबंध योजनाएं तैयार करेगा।
VII . प्राधिकरण , ऊपर पैरा IV, V और VI के अधीन तैयार की गई योजनाएं और उनके उपान्तरण , परीक्षा और उसके अनुमोदन के लिए राष्ट्रीय , तटीय जोन प्रबंध प्राधिकरण को प्रस्तुत करेगा ।
Now therefore , in exereise of the powers conferred by sub-sections ( 1) and (3 ) of Section 3 of the Environment (Protection) Act, 1986 (29 of 1986 ) ( hereinafter referred to as the said Act) , the Central Government hereby reconstitutes the Daman and Diu Coastal Zone Management Authority (hereinafter referred to as the Authority) for a period of three years with effect from the date of publication of this Order in the Official Gazette , consisting of the following persons , namely : -- VIII . प्राधिकरण , उन सभी विनिर्दिष्ट शर्तों का अनुपालन सुनिश्चित करेगा , जो दमन और दीव के अनुमोदित तटीय जोन प्रबंध योजना में अनुबद्ध और अधिकथित की जाती हैं।
1. Secretary, (Environment and Forests ) ,-Chairman Daman and Diu and Dadra and Nagar Haveli

(iii) filing complaints under section 19 of the said Act, in cases of non -compliance ofthe directions issued by itunder sub - paragraphs ( i ) and ( ii) of this paragraph;
3. Conservator of Forests , Daman and Diu , Dadra and NagarHaveli
(iv) to take action under section 10 of the said Act to verify the facts concerning the issues arising from sub - paragraphs (i) and (ii ) of this paragraph.

III . The Authority shall deal with environmental issues relating to Coastal Regulation Zone , which may be referred to it by the State Government of Daman and Diu , the National Coastal Zone Management Authority or the Central Government .

IV.The Authority shall identify ecologically sensitive areas in the Coastal Regulation Zone and formulate area- specific management plans for such identified areas .

V. The Authority shall identify coastal areas highly vulnerable to erosion or degradation and formulate area- specific management plans for such identified areas .
8. Deputy Conservator of Forests , Daman and Diu
VL. The Authority shall identify economically important stretches in the Coastal Regulation Zone and prepare integrated Coastal Zone Management Plans for the same.
II. The Authority shall have the power to take the following measures for protecting and improving the quality of the coastal environment and preventing , abating and controlling environmental pollution in areas of the State of Daman and Diu, namely :--
VII. The Authority shall submit the plans prepared byitunder paragraphs IV, V and VI above and modifications thereof to the National Coastal Zone Management Authority for examination and its approval .
VIII . The Authority shall ensure compliance of all specific conditions that are laid down in the approved Coastal Zone Management Plan of Daman and Diu .
(i) examination of proposals for changes or modifications in classification of Coastal Regulation Zone areas and in the Coastal Zone Management Plan ( CZMP ) received from the Daman and Diu State Government and making specific recommendations to the National Coastal Zone Management Authority therefore;
IX. The Authority shall furnish report of its activities at least once in six months to the National Coastal Zone Management Authority .
X. The Authority shall ensure that at least two third members of the Authority are present during the meetings. XI . The foregoing powers and functions of the
Authority shall be subject to the supervision and control
ofthe Central Government .
XII . The Authority shall have its headquarters at Moti Daman.
(ii) (a) inquiry into cases of alleged violation of the provisions of the said Act or the rules made thereunder or any other law which is relatable to the objects ofthe said Act and, if found necessary in a specific case , issuing directions under section 5 of the said Act , insofar as such directions are not inconsistent with any direction issued in that specific case by the National Coastal Zone Management Authority or by the Central Government;
XIII . Any matter specifically not falling within the scope and jurisdiction of the Authority shall dealt with by the statutory authorities concerned .
(b) review of cases involving violations of the provisions of the said Act and the rules made thereunder or under any other law which is relatable to the objects of the said Act, and if found necessary, referring such cases , with comments, for review to the National Coastal Zone Management Authority:
Note:-The principal order constituting the Daman and Diu Coastal Zone Management Authority was published in the Gazette of India , Extraordinary, vide number S.O. 17(E) dated the 4th January, 2002 and last reconstituted vide S.O 155 ( E) dated the 3rd February, 2005.
