सा.का.नि. 920(अ). महापत्तन न्यास अधिनियम, 1963 (1963 का 38 ) की धारा 132 की उप- धारा ( 1 ) के साथ पठित धारा 124 की उप - धारा ( 1 ) द्वारा प्रदत्त अधिकार प्रयुक्त करके , केन्द्रीय सरकार इस अधिसूचना के साथ लगाई जा रही अनुसूची में यथा निर्धारित विशाखापटट्णम पत्तन न्यास के न्यासी बोर्ड द्वारा बनाए गए विशाखापटट्णम- पत्तन- न्यास कर्मचारी ( सेवानिवृत्ति) संशोधन विनियम , 2009 में, एतद्वारा , संशोधन किया जाना अनुमोदित करती है ।
2. उपर्युक्त संशोधित विनियम , 30 सितम्बर , 2007 से लागू किया जाना होगा ।

अनुसूची
महापत्तन न्यास अधिनियम , 1963 ( 1963 का 38 ) की धारा 28 के तहत प्रदत्त अधिकारों का प्रयोग करते हुए उक्त अधिनियम की धारा 124 के अंतर्गत केन्द्र सरकार के अनुमोदन की शर्त पर विशाखापटणम पोर्ट ट्रस्ट का न्यासी मंडल विशाखापट्टणम पोर्ट ट्रस्ट कर्मचारी ( सेवानिवृत्ति ) विनियम , 1989 में निम्नलिखित और संशोधन करता है :
1. लघु शीर्ष और प्रारंभ:
(i ) इन विनियमों को विशाखापट्टणम पोर्ट ट्रस्ट कर्मचारी (सेवानिवृत्ति) संशोधित विनियम , 2009 कहा जाएगा ।

. (ii ) ये विनियम 30-9-2007 से लागू होंगे।
2. विनियम 3 ( 1 ) में शब्द " अट्ठावनं " को शब्द " साठ " के साथ प्रतिस्थापित किया जाए।
3. विनियम 3 ( 2) में शब्द " अट्ठावन " को शब्द " साठ " के साथ प्रतिस्थापित किया जाए।
4. विनियम 4( ख) में शब्द " अट्ठावन " को शब्द " साठ " के साथ प्रतिस्थापित किया जाए ।
5. विनियम 6( 7 ) नोट 4 में शब्द " अट्ठावन " , टर्म 58 वर्ष हटाया जाए ।
6. विनियम 6 (7 ) नोट 4 में शब्द " मामले के अनुसार " हटाया जाए ।
7. विनियम 6 ( 7 ) नोट 5 में शब्द " अट्ठावन " वर्ष और शब्द " मामले के अनुसार " हटाया जाए ।

NOTIFICATION
New Delhi, the 23rd December, 2009
G.S.R. 920 (E) .- In exercise ofthe powers conferred by sub - section ( 1 ) of section 124, read with sub-section ( 1 ) of section 132 of the Major Port Trusts Act, 1963 (38 of 1963 ) , the Central Government hereby approves the Visakhapatnam Port Trust Employees (Retirement ) Amendment Regulations , 2009 made by the Board of Trustees for the Port of Visakhapatnam and set out in the Schedule annexed to this Notification.
2. The said Amendment Regulations shall be deeined to have come into force on the 30th September , 2007.
VISAKHAPATNAM PORT TRUST
SCHEDULE
In exercise of the powers conferred by Section 28 of the Major Port Trust Act, 1963 ( Act 38 of 1963 ) the Board ofTrustees ofPort of Visakhapatnam hereby makes subject to the approval of Central Government under Section 124 ofthe said Act , the following Regulations further to amend the VPE (Retirement ) Regulations , 1989 , viz .:
1. Short Title and Commencement :
(1) These Regulations shall be called the Visakhapatnam Port Employees (Retirement) Amendment Regulations , 2009 .
(ii ) These Regulations shall come into force from 30-09-2007 .

2. In Regulation 3 ( 1 ) the words " Fifty Eight " may be substituted with the word " Sixty " ."
3. In Regulation 3 (2 ) the words " Fifty Eight " may be substituted with word " Sixty" .
4. In Regulation 4 ( b) , the words " Fifty Eight" may be substituted with word " Sixty" .
5. In Regulation 6 (7) note 4, the words " Fifty Eight", the term 58 years may be deleted .
6. In Regulation 6 (7) note 4, the words" as the case máy be" deleted.
7. In Regulation 6 (7) Note 5, the words "Fifty Eight " years and the words " as the case may be " may be deleted

Foot Note:-Principle Regulations of Visakhapatnam Port Employees (Retirement ) Regulations , 1989 have been approved by the Ministry of Surface Transport (PortsWing) vide their letter No. PR. 12012/ 11-1-89 - PE - 1 dated 19-12-1989 vide No. G.S.R. 1057 (E) and subsequently amended by viz .:
