का.आ. 3289(अ). केन्द्रीय सरकार ने , भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम , 1988 ( 1988 का 68 ) की धारा 11 के अधीन जारी भारत सरकार के तत्कालीन भूतल परिवहन मंत्रालय ( सड़क खंड ) की अधिसूचना संख्यांक का.आ. 1192 (अ ) , तारीख 3 दिसम्बर , 2001 , द्वारा राजस्थान राज्य में राष्ट्रीय राजमार्ग सं. 79 के 14.000 कि.मी. से 182.000 कि.मी. ( नसिराबाद से चित्तौड़गढ़ सेक्शन ) , और राष्ट्रीय राजमार्ग सं. 76 के 114.00 कि.मी. से 220.00 कि.मी. ( उदयपुर से चित्तौड़गढ़ सेक्शन ) , भूखंड का भारतीय राष्ट्रीय राजमार्ग प्राधिकरण ( जिसे इसमें इसके पश्चात् प्राधिकरण कहा गया है ) को सौंपा था ।
अतः , अब, केन्द्रीय सरकार, राष्ट्रीय राजमार्ग फीस ( दरों का अवधारण और संग्रहण ) नियम , 2008 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 ( 1956 का 48 ) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , कर्नाटक राज्य में राष्ट्रीय राजमार्ग सं. 79 के चित्तौड़गढ़ बाईपास सेक्शन 159.000 कि.मी. से 168.500 कि.मी. , जो कि राष्ट्रीय राजमार्ग सं. 79 के कि.मी. 168.500 से प्रारंभ होकर राष्ट्रीय राजमार्ग सं. 76 के 213.000 पर मिलता है ( कुल लम्बाई 29.60 किलोमीटर जिसमें बाईपास की लम्बाई 20.00 कि.मी. सम्मिलित है जिसकी अनुमानित लागत 177.15 करोड रुपए है ) , तक के चार लेन वाले सेक्शन के उपयोग के लिए नीचे की सारणी के स्तम्भ ( 2 ) में विनिर्दिष्ट यानों के प्रकार पर उसके स्तम्भ ( 3 ) , स्तम्भ ( 4 ) और स्तम्भ ( 5 ) में विनिर्दिष्ट दरों पर फीस उद्गृहीत करती है और प्राधिकरण को उक्त फीस का संग्रहण शाश्वत रूप में, अपने पदधारियों या ठेकेदार के माध्यम से करने के लिए प्राधिकृत करती है , अर्थात्:-

टिप्पण: वर्ष 2009-10 के लिए स्थानीय गैर- वाणिज्यिक यातायात के लिए मासिक पास की दर 165 रुपए ( एक सौ पैंसठ रुपए ) होगी ।

NOTIFICATION
New Delhi, the 24th December , 2009
S.O. 3289(E) .-Whereas, the Central Government, vide notification of the Government of India in the erstwhile Ministry of Surface Transport (Roads Wing) , number S.O. 1192 ( E) , dated the 3rd December, 2001 , issued under section 11 ofthe National Highways Authority of India Act , 1988 (68 of 1988 ) , entrusted the stretches from Km 14.000 - Km 182.000 (Nasirabad - Chittorgarh Section) ofNational Highway number 79 and from Km . 114.00 - Km 220.00 (Udaipur - Chittorgarh section) ofNational Highway number 76 in the State of Rajasthan to the National Highways Authority of India ( hereinafter referred to as the Authority) ;
Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956) , read with the National Highways Fee ( Determination of Rates and Collection ) Rules , 2008, the Central Government hereby levies the fee at the rates specified in columns ( 3 ) , ( 4) and ( 5 ) of the following Table , on the type of vehicles specified in column (2) thereof for the use of the four- lane Chittorgarh Bypass section from Km 159.000 Km 168.500, taking offat Km. 168.500 ofNational Highway No. 79 and merging at Km 213.00 of National Highway No. 76 (total length being 29.60 Km. , length of bypass 20.00 Kms with the approximate cost of Rs . 177.15 crores ) , in the State of Rajasthan and authorises the Authority to collect in perpetuity, either through its officials or through a contractor , the said fee , namely :--
