सं. 2/11 ( 2 )/07 - बीईई. कतिपय विनियमों का निम्नलिखित प्रारूप जिसे ब्यूरो , केन्द्रीय सरकार के पूर्व अनुमोदन से, ऊर्जा संरक्षण अधिनियम, 2001 ( 2001 का 52 ) की धारा 13 की उप- धौरा (2 ) के खंड (01 ) और ( त ) , धारा 58 की उप - धारा ( 2 ) के खंड ( ङ) और ( च ) तथा धारा 8 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , बनाने का प्रस्ताव करता है जिन्हें उक्त अधिनियम की धारा 58 की उप - धारा ( 1 ) के अपेक्षानुसार ऐसे सभी व्यक्तियों की जानकारी के लिए, जिसे उससे प्रभावित होने की संभावना है, प्रकाशित किया जाता है और सूचना दी जाती है कि उक्त प्रारूप विनियमों पर उस तारीख से जिसको उस राजपत्र की जिसमें यह अधिसूचना प्रकाशित की जाती है, पैंतालीस दिन की अवधि के अवसान के पश्चात् विचार किया जाएगा ।
आक्षेप या सुझाव जो उक्त प्रारूप विनियम के संबंध में किसी व्यक्ति से, पूर्वोक्त पैंतालीस दिन की अवधि के अवसान के पूर्व प्राप्त होंगे ब्यूरो द्वारा विचार किया जाएगा ।
आक्षेप या सुझाव , यदि कोई हों , उन्हें महानिदेशक , ऊर्जा दक्षता ब्यूरो , चौथा तल , सेषा भवन , आर. के. पुरम, सैक्टर 1 , नई दिल्ली-110066 को भेजे जा सकेंगे ।
प्रारूप विनियम
1. संक्षिप्त नाम और प्रारंभ.-( 1 ) इन विनियमों का संक्षिप्त नाम ऊर्जा दक्षता ब्यूरो ( प्रत्यायित ऊर्जा संपरीक्षाओं की अर्हताएं और उनकी सूची का अनुरक्षण ) विनियम, 2009 है ।
(2) यह राजपत्र में उनके अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. परिभाषाएं.-( 1 ) इन विनियमों में, तक कि संदर्भ से अन्यथा अपेक्षित न हो-

(क) "अधिनियम" से ऊर्जा संरक्षण अधिनियम, 2001 अभिप्रेत हैं,
(ख) "प्रत्यायन सलाहकार समिति " से विनियम 5 के अधीन ब्यूरो द्वारा गठित समिति अभिप्रेत है ;
(ग) "ऊर्जा संपरीक्षण " के अंतर्गत ऊर्जा दक्षता (ऊर्जा प्रबंधक के लिए प्रमाणन प्रक्रिया) विनियम, 2009 के विनियम 2 के उपविनियम (1 ) के खंड (घ) के अधीन यथा परिभाषित प्रमाणित ऊर्जा प्रबंधक सम्मिलित हैं ;
(घ) "ऊर्जा गहनता उद्योग " से अधिनियम की अनुसूची में विनिर्दिष्ट ऊर्जा गहनता उद्योग, अभिप्रेत हैं ;
(ङ) "प्ररूप" से उन विनियमों से उपाबद्ध प्ररूप अभिप्रेत हैं ;
(च) "अनुसूची " से इन विनियमों से उपाबद्ध अनुसूची अभिप्रेत है ।
(2) उन शब्दों और पदों के जो इनमें प्रयुक्त हैं और परिभाषित नहीं हैं किंतु अधिनियम में परिभाषित हैं, वही अर्थ हैं जो अधिनियम में हैं ।
3. प्रत्यायित ऊर्जा संपरीक्षक के लिए अर्हताएं.- ( 1 ) कोई ऊर्जा संपरीक्षक प्रत्यायित ऊर्जा संपरीक्षक होने के लिए अर्हित होगा यदि उसने--
(क)अनुसूची में विनिर्दिष्ट विषयों पर ब्यूरों द्वारा संचालित "उपस्कर और उपयोगिता प्रणालियों के लिए ऊर्जा निष्पादन निर्धारण " में परीक्षा उत्तीर्ण की हो ;
(ख ) ऊर्जा संपरीक्षा में पांच वर्ष का अनुभव हो जिनमें से कम से कम तीन का वर्ष किसी ऊर्जा गहनता उद्योग में अनुभव होना चाहिए ; और
(ग) विनियम 6 के अधीन ब्यूरो द्वारा प्रत्ययित का प्रमाण- पत्र मंजूर किया गया हो ।
4. प्रत्यायन के प्रमाण-पत्र की मंजूरी के लिए आवेदन (1 ) ब्यूरो विनियम 3 के खंड ( क) और खंड (ख) में विनिर्दिष्ट अर्हताएं रखने वाले ऊर्जा संपरीक्षकों के प्रत्यायन के प्रयोजन के लिए अर्हित व्यक्तियों से आवेदन मंगा सकेगा ।
(2) उपविनियम (1 ) में निर्दिष्ट आवेदन निम्नलिखित के साथ प्ररूप 1 में किया जाएगा--
(क) किसी व्यक्तिगत क्षमता या ऊर्जा संपरीक्षा दल के नेता या संहबद्ध या सक्रिय दल सदस्य के रूप में ऊर्जा संपरीक्षक द्वारा किए गए किसी ऊर्जा गहनता में पांच विस्तृत ऊर्जा संपरीक्षा ब्यौरे ।
(ख) ऊर्जा गहनता उद्योग से प्राप्त ऊर्जा संपरीक्षा पर फीडबैक ;
(ग) ऊर्जा दक्षता ब्यूरो , नई दिल्ली के पक्ष में आहरित मांग देय ड्राफ्ट द्वारा संदेय एक हजार रुपए की फीस का संदाय या कोई इलेक्ट्रानिक ढंग से संदाय ।
5. सलाहकार समिति का गठन ( 1 ) ब्यूरो , प्रत्यायन प्रमाणपत्र की मंजूरी के प्रयोजन के लिए प्रत्यायन सलाहकार समिति का गठन कर सकेगा । (2) सलाहकार समिति अध्यक्ष और ऊर्जा दक्षता ब्यूरो ( सलाहकार समिति) विनियम, 2008 के विनियम 3 के अधीन गठित सलाहकार समिति के सदस्यों में से ब्यूरो द्वारा नामनिर्दिष्ट किए जाने वाले तीन व्यक्तियों से अनधिक से मिलकर बनेगा ।

(3) प्रत्यायन सलाहकार समिति ऊर्जा संपरीक्षा अनुभव और उन ऊर्जा संपरीक्षा की सक्षमता का निर्धारण करेंगी जिन्होंने निम्नलिखित मानदंड पर मौखिक साक्षात्कार के आधार पर नियम 4 में अधीन प्रत्ययन के प्रमाणपत्र के लिए आवेदन किया है, अर्थात् :--
(क) आवेदन के साथ प्रस्तुत की गई पांच विस्तृत ऊर्जा संपरीक्षा रिपोर्ट का मूल्यांकन ;
(ख) ऊर्जा गहनता उद्योग की संख्या और प्रभार जिसमें विस्तृत ऊर्जा संपरीक्षा की गई है ;
(ग) आवेदक के संगम में विशेषज्ञों की संख्या और किस्म जिसके अंतर्गत जिनमें पूर्णकालिक ऊर्जा संपरीक्षक या तापीय या विद्युत उपयोगिता और प्रक्रिया में विशेषज्ञता और एक संगम की प्रकृति या अंशकालिक ऊर्जा संपरीक्षक है ;
(घ) कम से कम चार आधारिक उपकरण अर्थात् क्लिप ऑन टाइप विद्युत मापन उपकरण, फ्लू गैस, विश्लेशक, तापमान और लक्स मापक उपकरण रखता हो जो उर्जा से परीक्षा करने सम्यक रूप से परीक्षण और क्लिप अंशशोधन प्रयोगशालाओं के लिए राष्ट्रीय प्रत्यायन बोर्ड द्वारा प्रत्यायन प्रयोगशाला द्वारा अंशशोधित हो ;
(ङ) ऊर्जा संपरीक्षा में अनुसरित कार्य की रीति ;
(च) प्रशिक्षण अनुभव ;
(छ) क्षेत्र अध्ययन की क्वालिटी जिस के अंतर्गत संप्रेक्षण , निपुणता खोज, डाटा का संग्रहण और सृजन, गहन तकनीकी ज्ञान और विश्लेषण क्षमता भी हैं ;
(ज) ऊर्जा सक्षमता के सुधार या ऊर्जा संरक्षण के लिए सिफारिशों की क्वालिटी ;
(झ) ऊर्जा दक्षता सुधार या ऊर्जा संरक्षण के लिए की गई सिफारिश किए गए उपायों की लागत फायदा विश्लेषण करने की क्षमता और ऊर्जा खपत की कमी के लिए सिफारिशों के क्रियान्वयन के लिए कार्ययोजना की तैयार करना ; और
(ञ) ऊर्जा संपरीक्षा रिपोर्ट की क्वालिटी ।
(4) उपविनियम (3) के अधीन निर्धारण के आधार पर प्रत्यायन सलाहकर समिति, ऊर्जा संपरीक्षक के प्रत्ययन के लिए ब्यूरो को सिफारिश करेगी ।
6. प्रत्यायन का प्रमाणपत्र (1 ) यदि विनियम 5 के उपविनियम (4) के अधीन प्रत्यायन सलाहकार समिति द्वारा की गई सिफारिश ब्यूरो द्वारा स्वीकार की जाती है तो विनियम 7 के अधीन अनुरक्षित प्रत्यायन ऊर्जा संपरीक्षकों की सूची के रजिस्टर में अभ्यर्थी के नाम को प्रक्रिष्ट किया जाएगा और ऊर्जा दक्षता ब्यूरो नई दिल्ली के पक्ष में आहरित मांगदेय ड्राफ्ट द्वारा संदेय एक हजार रुपए की वार्षिक प्रत्यायन फीस के संदाय पर ऊर्जा संपरीक्षक को प्रत्यायन्च श्रमाम्मपत्र प्रस्रूप 2 में दिया जाएगा। (2) ब्यूरो , कारण जो लेखबद्ध किए जाएंगे , के लिए पर किसी ऊर्जा संपरीक्षक द्वारा किए गए प्रत्ययन के प्रमाणपत्र को अस्वीकार कर सकेमा और 'उसे एक मास की अवधि के भीतर संसूचित करेगा ।
(3) प्रत्यायन का प्रमाणपत्र जब तक विधिमान्य होगा जब तक विनियम 9 के अधीन उसे निरस्त नहीं कर दिया जाता है ।

(7) प्रत्यायित ऊर्जा संपरीक्षक, उनके कार्यालय और फर्मों की सूची का अनुरक्षण ( 1 ) ब्यूरो प्ररूप- 3 में प्रत्यायित ऊर्जा संपरीक्षकों की सूची रजिस्टर में अनुरक्षित करेगा ।
(2) प्रत्यायित ऊर्जा संपरीक्षक या ऐसी प्रत्यायित ऊर्जा संपरीक्षक की फर्म, व्यापार नाम या फर्म में नाम पर कार्यालय खोलने से पहले, व्यापार नाम या फर्म के नाम के उपयोग के लिए अनुमोदन के लिए ब्यूरों को आवेदन करेगा , ब्यूरो प्ररूप -5 में प्रत्यायित ऊर्जा संपरीक्षकों के कार्यालयों और फर्मों के रजिस्टर को अनुरक्षण करेगा ।
(3) ब्यूरो, प्रत्यायित ऊर्जा संपरीक्षकों की पहली सूची और प्रत्यायित ऊर्जा संपरीक्षक के कार्यालय और फर्मों की सूची जैसे ही अंतिम रूप दिया जाता है, को यथाशीघ्र उसे अंतिम रूप देगा और तत्पश्चात यथाशीघ्र इन सूचियों को अद्यतन किया जाएगा और उसको नियमित रूप से प्रकाशित किथा जाएगा और ब्यूरों की शासकीय वेबसाइट www.bee-india.nic.in और www.energymanagertraining.com पर अपलोड किया जाएगा ।
(4) प्रत्येक प्रत्यायिंत ऊर्जा संपरीक्षक सूची को अद्यतन के प्रयोजन के लिए प्रत्यायन के लिए आवेदन में की गई जानकारी में कोई परिवर्तन को ब्यूरो को प्रस्तुत करेंगे ।
(5) प्रत्यायित ऊर्जा संपरीक्षकों को अद्यतन अद्यतन सूची की प्रति राज्यों की अभिहित अभिकरणों और अभिहित उपभोक्ताओं को इलेक्ट्रानिक मेल के माध्यम से प्रत्येक वर्ष की पहली अप्रैल को भेजा जाएगा ।
8. प्रत्यायित ऊर्जा संपरीक्षक की सूची के रजिस्टर से नामों का हटाया जाना और उनका प्रत्यावर्तन- -न्यूरो, निम्नलिखित आधार पर ऊर्जा संपरीक्षकों की सूची के रजिस्टर से प्रत्यायित ऊर्जा संपरीक्षक के नाम को हटा सकेगा अर्थात् : --
(क) संबंधित व्यक्ति को सुने जाने का अवसर प्रदान करने के पश्चात् यदि ब्यूरो का यह समाधान हो जाता है कि प्रत्यायन का ऐसा प्रमाणपत्र गलत, भ्रामक और मिथ्या जानकारी के आधार पर अनुदत्त किया गया है ;
(ख ) ऊर्जा दक्षता ब्यूरो (ऊर्जा संपरीक्षा करने की रीति और समय अंतराल) विनियम, 2009 के अनुसार ऊर्जा गहनता उद्योग की ऊर्जा संपरीक्षा करने के लिए अपनी चूक पर ऊर्जा संपरीक्षक का बना रहना ;
(ग) यदि व्यक्ति वृत्तिक कदाचार या कपट का दोषी है ;
घ) यदि व्यक्ति वार्षिक प्रत्यायन फीस का संदाय करने में असफल रहता है ।
(2) जब प्रत्यायित ऊर्जा संपरीक्षक का नाम उप विनियम (1 ) के खंड (ख ) या खंड (घ) में विनिर्दिष्ट आधारों पर हटाया जाता हे वहां रजिस्टर में उसके नाम को, यथास्थिति, ऊर्जा के कार्य को पुनः आरंभ करने और वार्षिक प्रत्ययन फीस के संदाय पर उसके द्वारा आवेदन किए जाने पर प्रत्यावर्तित किया जाएगा ।
(3 ) जहां प्रत्यायित ऊर्जा संपरीक्षक के नाम को किसी अन्य आधार पर हटाया जाता है, ब्यूरो द्वारा रजिस्टर में नाम का कोई प्रत्यावर्तन नहीं किया जाएगा ।

(9) प्रत्यायन में प्रमाणपत्र का रद्द किया जाना (1 ) विनियम 8 के अधीन रजिस्टर से नाम को हटाए जाने पर, ब्यूरो विनियम 6 के अधीन अनुदत्त प्रत्यायन के प्रमाणपत्र को रद्द कर सकेगा ;
(2) प्रत्यायन में प्रमाणपत्र के आदेश को जारी करने से पूर्व, ब्यूरो ऐसे प्रमाणपत्र धारक ऊर्जा संपरीक्षक को सुने जाने का अवसर देगा ।
(3) जहां प्रत्यायन के प्रमाणपत्र को रद्द किया जाता है, वहां ब्यूरो ऐसे प्रमाणपत्र धारक को और संबंध अभिहित उपभोक्ता की ऐसे आदेश को संसूचित करेगा और उसे प्रकाशित करेगा तथा शासकीय वेबसाइट पर आवश्यक परिवर्तन अपलोड करेगा ।
(4) प्रत्यायन प्रमाणपत्र, प्रत्यायन के आदेश के प्रकाशन की तारीख से होगा ;
(5) प्रत्यायन के प्रमाणपत्र के रद्द होने पर ऐसे प्रमाणपत्र का धारक उसे पंद्रह दिन के भीतर ब्यूरो को अभ्यर्पित करेगा ;
10. दो प्रतियों में प्रमाणपत्र को जारी किया जाना (1 ) जहां कोई प्रत्यायित ऊर्जा संपरीक्षक प्रत्यायन प्रमाणपत्र को खो देता हे वहां ब्यूरो, जिसके साथ इस निमित्त किए गए आवेदन पर संबध पुलिस थाना में की गई प्रथम इत्तला रिपोर्ट दर्ज करने की प्रति के साथ , ऊर्जा दक्षता ब्यूरो नई दिल्ली, के पक्ष में आहरित पांच सौ रुपए की फीस के डिमांड ड्राफ्ट संदाय पर प्रमाणपत्र की दूसरी प्रति जारी करेगा ।
(2) जहां ब्यूरो द्वारा जारी किया गया प्रमाणपत्र क्षतिग्रस्त हो गया है वहां इस निमित्त आवेदन किए जाने पर और क्षतिग्रस्त प्रमाणपत्र के अभ्यर्पण पर, नई दिल्ली में संदेय ऊर्जा दक्षता ब्यूरो के पक्ष में आहरित पांच सौ रुपए की फीस के मांगदेय ड्राफ्ट या संदाय में किसी इलेक्ट्रानिक प्ररूप से प्राप्ति पर प्रमाणपत्र की दूसरी प्रति जारी करेगा ।
11. प्रत्यायित ऊर्जा संपरीक्षक से संबंधित जानकारी (1 ) ब्यूरो, प्रत्यायित ऊर्जा परीक्षा में से निम्नलिखित को प्रस्तुत करने के लिए मांग सकेगा--
(क) संचालित सेक्टरवार ऊर्जा संपरीक्षा के ब्यूरो से संबंधित जानकारी और पहचान तथा प्राप्त की गई ऊर्जा बचत संभावना : और
(ख) ऐसी अतिरिक्त जानकारी जो वह आवश्यक समझे ।
(2) ब्यूरो वेब साइट या अपने किसी प्रकाशन के माध्यम से साधारण जनता को उपनियम (1 ) में अधीन जानकारी उपलब्ध करा सकेगा ।

(घ) ऐसे ऊर्जा उद्योगो से प्राप्त (ग ) में निर्दिष्ट अध्ययन रिपोर्टों पर फीड बैंक

यह प्रमाणित किया जाता है कि श्री/ श्रीमती/मैसर्स .. कार्यालय. जिसका उनका रजिस्ट्रीकृत .स्थित है, प्रत्यायित ऊर्जा संपरीक्षक के रूप में प्रत्यायन दिया गया है ।
प्रमाणपत्र . .200 ........... से प्रभावी होगा ।
प्रमाणपत्र, ऊर्जा दक्षता (प्रत्यायित ऊर्जा संपरीक्षकों के लिए अर्हता और उनकी सूची का अनुरक्षण) विनियम, 2009 के उपबंधों के अध्यधीन होगा ।
यह प्रमाणपत्र तब तक विधिमान्य होगा जब तक कि ऊर्जा दक्षता (प्रत्यायित ऊर्जा संपरीक्षकों के लिए अर्हता और उनकी सूची का अनुरक्षण) विनियम , 2009 के विनियम 9 के अधीन रद्द नहीं कर दिया जाता है ।
रद्द हो जाने पर, प्रत्यायन का प्रमाणपत्र रद्दकरण के आदेश की प्राप्ति की तारीख से पंद्रह दिन के भीतर ब्यूरो अभ्यर्पित कर दिया जाएगा ।
प्रत्यायित ऊर्जा संपरीक्षकों की सूची में रजिस्टर के क्रम सं ०...... पर आपके नाम को दर्ज किया गया है । आपका नाम ऊर्जा दक्षता ( प्रत्यायित ऊर्जा संपरीक्षकों के लिए अर्हता और उनकी सूची का अनुरक्षण) विनियम, 2009 के विनियम 8 में विनिर्दिष्ट आधारों पर हटाने के लिए दायी होगा ।

NOTIFICATION
New Delhi , the 22nd December , 2009
No. 02/11 (2)/07-BEE.- The following draft of certain regulations, which the Bureau , with the previous approval of the Central Government proposes to make in exercise of the powers conferred by clauses (o) and (p ) of sub- section (2) of section 13, clauses (e) and ( f) of sub-section ( 2) of section 58 and section 8 of the Energy Conservation Act , 2001 (52 of 2001 ) , is hereby published as required by sub-section (1) of section 58 of the said Act for the information of all persons likely to be affected thereby, and notice is hereby given that the said draft regulations shall be taken into consideration on or after the expiry of a period of forty-five days from the date of publication of this notification in the Official Gazette .
Any objection or suggestion which may be received with respect to the said draft regulations before the expiry of the aforesaid period of forty five days shall be considered by the Bureau .
Objection or suggestion , if any, may be addressed to the Director General , Bureau of Energy Efficiency, 4th Floor , Sewa Bhavan , R. K. Puram , Sector - 1 , New Delhi 110 066.
DraftRegulations
1. Shorttitle and commencement . - ( 1 ) These regulations may be called the Bureau ofEnergy Efficiency (Qualifications for Accredited Energy Auditors and Maintenance of their List ) Regulations , 2009 .
(2) They shall come into force on the date of their final publication in the Official Gazette.
2. Definitions . - ( 1 ) In these regulations , unless the context otherwise requires: -
a) "Act " means the Energy Conservation Act , 2001 ;
b) "Accreditation Advisory Committee " means a committee constituted by the Bureau under regulation 5;
c) "energy auditor" includes a certified energy manager as defined in clause (d) of sub- regulation ( 1 ) of regulation 2 of the Bureau of Energy Efficiency (Certification Procedures for Energy Managers ) Regulations , 2009;

d) "Energy Intensive Industries " means the Energy Intensive Industries specified in the schedule to the Act;
e) "Form" means a form appended to these regulations;
1) "Schedule" means the Schedule appended to these regulations.
(2) Words and expressions used herein and not defined but defined in the Act shall have the meanirigs respectively assigned to them in the Act .
3. Qualifications for Accredited Energy Auditor.-( 1 )An energy auditor shall be qualified to become an accredited energy auditor if, he-
a) has passed the examination in " Energy Performance Assessment for Equipment and Utility Systems" conducted by the Bureau on the subjects specified in the Schedule;
b) has an experience of five years in energy audit out of which at least three years' shall be in any of the Energy Intensive Industries; and
c) has been granted a certificate of accreditation by the Bureau under regulation 6.
4. Application for grant of Certificate of Accreditation.- ( 1 ) The Bureau may, for the purpose of accreditation of energy auditors possessing qualifications specified in clauses (a) and (b) of regulation 3, call for applications from qualified persons .
(2) Theapplication referred to in sub -regulation (1 ) shall be made in Form 1 and be accompaniedby-
a) five detailed energy audit reports in any of the Energy Intensive Industries undertaken by the energy auditor in an individual capacity or as a leader or associate or active team member of the energy audit team;
b) feed back on energy audit received from Energy Intensive Industries;
c) fee of rupees one thousand payable by demand draft drawn in favour of the Bureau of Energy Efficiency, New Delhi - or any electronic mode of payment.
5. Constitution of Advisory Committee. ( 1 ) The Bureau may, for the purpose of grantof certificate of accreditation , constitute an Accreditation Advisory Committee.
(2) TheAdvisory Committee shall consist of a Chairperson and not more than three members to be nominated by the Bureau from amongst members of the Advisory 14

Committees constituted under regulation 3 of the Bureau of Energy Efficiency (Advisory Committees ) Regulations , 2008.
accreditation under regulation 4 on the basis of an oral interview on the following (3) The Accreditation Advisory Committee shall assess the energy audit experience and competence of the energy auditor who has applied for a certificate of criteria , namely: -
a) evaluation of five detailed energy audit reports submitted alongwith the application;
b) the number of and the kind of Energy Intensive Industries in which detailed energy audits have been made;
c ) association of applicant with number of and kind of experts including full time energy auditors or part time energy auditors or consultants with expertise in thermal , electrical utilities and processes and nature of such association;
d) possession of at least four up-to- date basic instruments namely , clip- on- type , power measuring instruments , flue gas analyzer , temperature and lux measuring instruments which are duly calibrated by a laboratory accredited by the National Accreditation Board for Testing and Calibration Laboratories and expertise in using such instruments for conduct of energyaudit;
e) manner of work followed in energy audit ;
f) training experience ;
g) quality of field studies including observations , probing skills , collection and generation of data , depth of technical knowledge and analytical abilities;
h) quality of recommendations for improving energy efficiency or for conserving energy;
i ) capacity to undertake cost benefit analysis of recommended measures for improving energy efficiency or for conserving energy and preparation of action plan for implementation of recommendations for reduction of energy consumption; and
j ) quality of energy audit reports.
(4) On the basis of assessment made under sub- regulation (3), the Accreditation Advisory Committee shall make recommendation to the Bureau for accreditation of energy auditor .

6. Certificate of Accreditation . (1) if the recommendation made by the Accreditation Advisory Committee under sub- regulation (4) of regulation 5 is accepted by the Bureau , the name of the applicant shall be entered in the register of List of Accredited Energy Auditors maintained under regulation 7 and a certificate of Accreditation in Form II shall be granted to the energy auditor on payment of annual Accreditation Fee of rupees one thousand payable by demand draft drawn in favour of the Bureau of Energy Efficiency, New Delhi or by any electronic mode of payment.
(2) The Bureau may, for reasons to be recorded in writing , reject the application for accreditation made by an energy auditor and intimate the same to him within a period of onemonth.
(3) The certificate of accreditation shall be valid until it is cancelled under regulation9.
7. Maintenance of List of Accredited Energy Auditors , their offices and firms.- (1 ) The Bureau shall maintain a register containing list of accredited energy auditors in Form III .
(2) The accredited energy auditor or a firm of such accredited energy auditor shall , before opening an office in the trade name or firm name , apply to the Bureau for approval to use the trade name or the firm name and on such approval , the Bureau shall maintain the register of offices and firms of accredited energy auditors in Form IV.
(3) The Bureau shall cause to be published the first list of accredited energy auditors and list of offices and firms of accredited energy auditor as soon as they are finalized and thereafter, these lists shall be updated and published regularly and uploaded on the Bureau's official web- site namely , www.bee-india.nic.in and energy professionals web site on www.energymanagertraining.com .
(4) Every accredited energy auditor shall submit to the Bureau any changes in the information given in the application for accreditation for the purpose of updating the list.
(5) Acopy of the updated list of Accredited Energy Auditors shall be sent to the designated agencies of the States and designated consumers on the first day of April every year through electronic mail .
8. Removal and restoration of names in the register of List of Accredited Energy Auditors. - The Bureau may remove the name of the accredited energy auditor from the register of list of Energy Auditor on the following grounds , namely: -
a) the Bureau , after giving an opportunity of hearing to the person concerned, is satisfied that such certificate of accreditation has been granted on the basis of incorrect , misleading or false information ;
b) on the person ceasing to be an energy auditor or on his failure to undertake energy audit of an Energy Intensive Industries in accordance with the Bureau of Energy Efficiency ( Manner and Interval of time for conduct of Energy Audit ) Regulation 2009;

c) if the person is guilty of professional misconduct or fraud ;
d) if the person has failed to pay annual accreditation fee.
(2) Where the name of the Accredited Energy Auditor is removed on the grounds specified in clause (b) or clause (d) of sub- regulation ( 1 ) , his name in the register shall be restored on an application made by him after restarting the work of energy audit or on payment of annual Accreditation fee , as the case may be.
(3) Where the name of the accredited energy auditor is removed on any other grounds , no restoration of name in the register shall be made by the Bureau
9. Cancellation of Certificate of Accreditation .- ( 1 ) On removal of the name from the register under regulation 8 , the Bureau may cancel the certificate of Accreditation granted under regulation 6;
(2) Before issuing an order of cancellation of accreditation , the Bureau shall givean opportunity of hearing to the energy auditor holding such certificate.
(3) Where the certificate of Accreditation is cancelled , the Bureau shall communicate its order to the holder of such certificate and the concerned designated. consumer and shall also publish the same and upload necessary changes on its official web site.
(4) The certificate of Accreditation shall stand cancelled with effect from the date of publication of the order of cancellation;
(5) Oncancellation of certificate of Accreditation , the holder of such certificate shall surrender the same to the Bureau within fifteen days .
10. Issue of duplicate certificates ( 1 ) Where an accredited energy auditor has lost the certificate of Accreditation , the Bureau may , on an application made in this behalf, duly accompanied by a copy of first information report lodged with the concerned police station, issue a duplicate certificate on payment of a fee of rupees five hundred by demand draft drawn in favour of the Bureau of Energy Efficiency , New Delhi .
(2) Where the certificate issued by the Bureau is damaged , the Bureau may on an application made in this behalf and on surrendering of the damaged certificate, issue a duplicate certificate on receipt of a fee of rupees five hundred by way of demand draft drawn in favour of Bureau of Energy Efficiency payable at New Delhi or by any electronic mode of payment
11. Information relating to accredited energy auditors .-( 1 ) The Bureau may call upon accredited energy auditors to furnish-
a) information relating to sector- wise details of energy audit conducted, and the energy saving potential identified and achieved; and
b) such additional information as it considers necessary.
(2) The Bureau may make available the information received by it under sub- regulation ( 1 ) to the general public through its web site or through any of its publication .
