सं. भा.आ.प. - 18(1 ) /2009-मेडि/60585.- भारतीय आयुर्विज्ञान परिषद् अधिनियम, 1956 ( 1956 का 102 ) की धारा 33 द्वारा प्रदत्त शक्तियों का इस्तेमाल करते हुए , " अध्ययन या प्रशिक्षण का कोई नया या उच्चतर पाठ्यक्रम ( अध्ययन या प्रशिक्षण के स्नातकोत्तर पाठ्यक्रम सहित ) खोलना और अध्ययन या प्रशिक्षण के किसी पाठ्यक्रम ( अध्ययन या प्रशिक्षण के स्नातकोत्तर पाठ्यक्रम सहित ) में प्रवेश क्षमता बढ़ाना विनियमावली 2000 " में पुनः संशोधन करने हेतु, भारतीय आयुर्विज्ञान परिषद्, केंद्रीय सरकार के पूर्व अनुमोदन से एतद्वारा निम्नलिखित विनियम बनाती है , नामतः:-
1. (i) इन विनियमों को " अध्ययन या प्रशिक्षण का कोई नया या उच्चतर पाठ्यक्रम ( अध्ययन या प्रशिक्षण के स्नातकोत्तर पाठ्यक्रम सहित ) खोलना और अध्ययन या प्रशिक्षण के किसी पाठ्यक्रम ( अध्ययन या प्रशिक्षण के स्नातकोत्तर पाठ्यक्रम सहित ) में प्रवेश क्षमता बढ़ाना (संशोधन ) , विनियमावली , 2009 ( भाग-V ) " कहा जाए ।
(ii) वे सरकारी राजपत्र में उनके प्रकाशन की तारीख से प्रवृत्त होंगे ।
2. " अध्ययन या प्रशिक्षण का कोई नया या उच्चतर पाठ्यक्रम ( अध्ययन या प्रशिक्षण के स्नातकोत्तर

(1) पाठ्यक्रम सहित ) खोलना और अध्ययन या प्रशिक्षण केकिसी पाठ्यक्रम ( अध्ययन या प्रशिक्षण के स्नातकोत्तर पाठ्यक्रम सहित ) में प्रवेश क्षमता बढ़ाना विनियमावली, 2000" में " (क) भाग I किसी मेडिकल कॉलेज या संस्थान में अध्ययन या प्रशिक्षण का कोई नया या उच्चतर पाठ्यक्रम ( अध्ययन या प्रशिक्षण के स्नातकोत्तर पाठ्यक्रम सहित ) खोलने के लिये केन्द्रीय सरकार की अनुमति की योजना के अर्हक मापदण्ड के बिन्दु सं. 3.2 और 3.3 को निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा :-
" 3.2 कि मेडिकल कालेज/संस्थान में अध्ययन या प्रशिक्षण का कोई नया या उच्चतर पाठ्यक्रम (अध्ययन या प्रशिक्षण के स्नातकोत्तर पाठ्यक्रम सहित ) खोलने और अध्ययन या प्रशिक्षण के किसी पाठ्यक्रम ( अध्ययन या प्रशिक्षण के स्नातकोत्तर पाठ्यक्रम सहित) में प्रवेश क्षमता बढ़ाने के लिए राज्य सरकार संघ शासित प्रशासन कीअनापत्ति के संबंध में निर्धारित प्रपत्र पर अनिवार्यता प्रमाण-पत्र और परिषद् के विनियमों के अनुसार पर्याप्त नैदानिक सामग्रियों की उपलब्धता का प्रमाण- पत्र संबंधित राज्य सरकार/संघ शासित प्रशासन , जैसा भी मामला हो, से आवेदक द्वारा प्राप्त कर लिया है ।
3.3 कि अध्ययन या प्रशिक्षण का कोई नया या उच्चतर पाठ्यक्रम (अध्ययन या प्रशिक्षण के स्नातकोत्तर पाठ्यक्रम सहित ) खोलने और अध्ययन या प्रशिक्षण केकिसी पाठ्यक्रम ( अध्ययन या प्रशिक्षण के स्नातकोत्तर 2

पाठ्यक्रम सहित ) में प्रवेश क्षमता बढ़ाने के संबंध में निर्धारित प्रपत्र पर संबद्धता की सहमति , मेडिकल कालेज/संस्थान द्वारा उस विश्वविद्यालय से प्राप्त कर ली गई है जिससे यह संबद्ध है । "
3. " (ख ) भाग- II : मौजूदा मेडिकल कालेजों/संस्थानों में अध्ययन या प्रशिक्षण के किसी पाठ्यक्रम ( अध्ययन या प्रशिक्षण के स्नातकोत्तर पाठ्यक्रम सहित ) में प्रवेश क्षमता बढ़ाने के लिए केन्द्रीय सरकार की अनुमति की योजना " के बिन्दू संख्या 3.1 ( 1 ) , 3.2 और 3.3 को निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा ।
3.1 ( 1) मेडिकल कालेज/संस्थान , एम. बी. बी. एस. स्नातकोत्तर पाठ्यक्रम चलाने के लिए भारतीय आयुर्विज्ञान परिषद् द्वारा मान्यताप्राप्त होना चाहिए, तथापि जिस मेडिकल कालेज/संस्थान को एम.बी.बी.एस. की डिग्री प्रदान के लिए भारतीय आयुर्विज्ञान परिषद् द्वारा अभी तक मान्यता प्रदान नहीं की गई है , वे चौथे नवीकरण के समय अर्थात् एम.बी.बी.एस. पाठ्यक्रम के 5वें बैच के दाखिले के साथ शरीर रचना-विज्ञान , शरीर-क्रिया-विज्ञान , जीव- रसायन विज्ञान , औषध-विज्ञान , रोग-विज्ञान, सूक्ष्म जीव-विज्ञान , फोरेंसिक मेडिसिन एवं कम्युनिटी मेडिसिन के प्री-नैदानिक और पारा-नैदानिक विषयों में स्नातकोत्तर पाठ्यक्रमों में प्रवेश क्षमता बढ़ाने हेतु आवेदन कर सकते हैं ।
3.2 कि मेडिकल कालेज/संस्थान में अध्ययन या प्रशिक्षण का कोई नया या उच्चतर पाठ्यक्रम ( अध्ययन या प्रशिक्षण के स्नातकोत्तर पाठ्यक्रम सहित ) खोलने और अध्ययन या प्रशिक्षण के किसी पाठ्यक्रम ( अध्ययन या प्रशिक्षण के स्नातकोत्तर पाठ्यक्रम सहित ) में प्रवेश क्षमता बढ़ाने के लिए राज्य सरकार/संघ शासित प्रशासन की अनापत्ति के संबंध में निर्धारित प्रपत्र पर अनिवार्यता प्रमाण-पत्र और परिषद्के विनियमों के अनुसार पर्याप्त नैदानिक सामग्रियों की उपलब्धता का प्रमाण-पत्र संबंधित राज्य सरकार/ संघ शासित प्रशासन , जैसा भी मामला हो, से आवेदक द्वारा प्राप्त कर लिया है ।

A पाठ्यक्रम सहित ) खोलना और अध्ययन या प्रशिक्षण केकिसी पाठ्यक्रम (अध्ययन या प्रशिक्षण के स्नातकोत्तर पाठ्यक्रम सहित ) में प्रवेश क्षमता बढ़ाना विनियमावली, 2000" में पैराग्राफ 6 में दूसरा पैराग्राफ अर्थात्" भारतीय आयुर्विज्ञान परिषद् द्वारा मूल्यांकन " अर्थात्" आवेदन -पत्र का मूल्यांकन करते समय , परिषद्, मेडिकल ' कालेज/संस्थान से ऐसी अतिरिक्त सूचना , स्पष्टीकरण या अतिरिक्त प्रलेख मांग सकती है जो वह आवश्यक समझे और मेडिकल कालेज/संस्थान द्वारा उपलब्ध कराई गई सूचना , स्पष्टीकरण या अतिरिक्त प्रलेखों का सत्यापन करने हेतु वास्तविक निरीक्षण करेगी । आवेदन -पत्र प्राप्त करने और प्रोसेसिंग की तारीखें इस विनियमावली, 1999की अनुसूची में दी गई हैं " को निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा :
" आवेदन - पत्र का मूल्यांकन करते समय , परिषद् आवेदक से ऐसी अतिरिक्त सूचना , स्पष्टीकरण या अतिरिक्त प्रलेख मांग सकती है जो वह आवश्यक समझे और 50/100/150 दाखिलों हेतु मेडिकल कालेज के लिए न्यूनतम मानक शर्तें विनियमावली , 1999 के अनुसार एम.बी.बी.एस. डिग्री प्रदान करने के लिए , छात्रों की उस संख्या के लिए, जिसके लिए कालेज मान्यताप्राप्त है, न्यूनतम मानक शर्तों की तुलना में अध्यापन संकाय , रेजीडेंट्स, नैदानिक सामग्री , छात्रावास तथा अन्य संरचनात्मक सुविधाओं का पता लगाने और उनका मूल्याकंन करने हेतु निरीक्षण कर सकती है ।
परिषद्, स्नातकोत्तर पाठ्यक्रम आरंभ करने या स्नातकोत्तर पांठ्यक्रम वार्षिक प्रवेश क्षमता बढ़ाने के लिए प्राप्त आवेदन -पत्र पर केवल उसी स्थिति में कार्रवाई करेगी , यदि कॉलेज एम.बी.बी.एस. की डिग्री प्रदान करने के लिए , छात्रों की संख्या , जिसके लिए कॉलेज मान्यताप्राप्त है, के लिए नियमावली के अन्तर्गत यथा अपेक्षित अध्यापन सुविधा , रेजीडेंट्स , नैदानिक सामग्री , छात्रावास तथा अन्य संरचनात्मक सुविधाओं संबंधी शर्तें पूरी करता है और इसके पश्चात् परिषद्, उस संबंधित विभाग , जिसमें स्नाकोत्तर पाठ्यक्रम आरंभ किए जाने का प्रस्ताव है या संबंधित स्नातकोत्तर पाठ्यक्रम जिसमें सीटें बढ़ाने का प्रस्ताव है , के संबंध में मेडिकल कालेज दूतावास उपलब्ध करवाई गई सूचना , स्पष्टीकरण , अतिरिक्त प्रलेखों, अध्यापन संकाय , रेजीडेंट्स नैदानिक सामग्री तथा दस्तावेज और अन्य संरचनात्मक सुविधाओं का सत्यापन करने हेतु वास्तविक निरीक्षण करेगी ।
3.3 कि अध्ययन या प्रशिक्षण का कोई नया या उच्चतर पाठ्यक्रम ( अध्ययन या प्रशिक्षण के स्नातकोत्तर पाठ्यक्रम सहित ) खोलने और अध्ययन या प्रशिक्षण के किसी पाठ्यक्रम ( अध्ययन या प्रशिक्षण के स्नातकोत्तर पाठ्यक्रम सहित ) में प्रवेश क्षमता बढ़ाने के संबंध में निर्धारित प्रपत्र पर संबद्धता की सहमति, मेडिकल कालेज/संस्थान द्वारा उस विश्वविद्यालय से प्राप्त कर ली गई है जिससे यह संबद्ध है । " स्नातकोत्तर पाठ्यक्रमों में प्रवेश क्षमता में वृद्धि करने हेतु आवेदन - पत्र प्राप्त करने की तारीखें और प्रोसेसिंग की तारीखें अनुसूची में दे दी गई हैं । एम.बी.बी.एस. पाठ्यक्रम में सीटों की संख्या में वृद्धि करने के संबंध में आवेदन- पत्र की प्राप्ति और प्रोसेसिंग की तारीखें मेडिकल कालेज की स्थापना विनियमावली , 1999 में शामिल की गई अनुसूची के अनुसार होगी । "

Training (Including Post Graduate Course of Study orTraining) and Increase of Admission Capacity in any Course of Study or Training (Including a Post Graduate Course of Study or Training) in the medical college/institution and availability of the adequate clinical material as per the Council Regulations have been obtained by the applicant from the concerned State Govt./Union Territory administration, as the case may be .
: प्रधान विनियमावली नामतः " अध्ययन या प्रशिक्षण का कोई नया या उच्चतर पाठ्यक्रम ( अध्ययन या प्रशिक्षण के स्नातकोत्तर पाठ्यक्रम सहित ) खोलना और अध्ययन या प्रशिक्षण के किसी पाठ्यक्रम (अध्ययन या प्रशिक्षण के स्नातकोत्तर पाठ्यक्रम सहित) में प्रवेश क्षमता बढ़ाना विनियमावली , 2000 " को भारत के राजपत्र के भाग III, धारा ( 4 ) में भारतीय आयुर्विज्ञान परिषद् की दिनांक 14 अगस्त, 2000 की अधिसूचना संख्या 34(41 )/2000/मेडि. के अंतर्गत दिनांक 7 अक्तूबर , 2000 को प्रकाशित किया गया था और इसे भारतीय आयुर्विज्ञान परिषद् की दिनांक 22 मार्च , 2005, 29 जुलाई , 2008 , 23 सितम्बर , 2009 और 9 दिसम्बर , 2009 की अधिसूचना के अंतर्गत संशोधित किया गया था ।
3.3 That Consent of Affiliation in the prescribed format with respect to opening of New or Higher Course ofStudy or Training ( including Post Graduate Course of Study or Training) and Increase of Admission Capacity in any Course of Study or Training (Including a Post Graduate Course of Study or Training) has been obtained by the medical college/ institution from the University to which it is affiliated."

3. The Point No.3.1 ( 1 ), 3.2 & 3.3 of " (B) Part II : Scheme for permission of the Central Government to increase the admission capacity in any course of study or training (Including Post Graduate Course of Study or Traning) in the existing medical colleges/ institutions " shall be substituted as under :-
No. MCI. 18(1)/2009-Med./60585.-In exercise of the powers conferred by Section 33 of the Indian Medical Council Act, 1956 ( 102 of 1956) , the Medical Council of India with the previous sanction of the Central Government hereby makes the following regulations to further amend "The Opening of a New or Higher Course of Study or Training (Including Post Graduate Course of Study or Training) and Increase of Admission Capacity in any Course of Study or Training ( Including a Post Graduate Course ofStudy or Training) , Regulations, 2000 " namely:-
1. ( i) These regulations may be called " The Opening of a New or Higher Course of Study or Training (Including PostGraduate Course of Study or Training) and Increase of Admission Capacity in any Course of Study or Training ( Including a Post Graduate Course of Study or Training) (Amendment), Regulations , 2009 (Part -V) " .
"3.1 (1 ) : The medical college/institution must be recognized by the Medical Council of India for running Bachelor of Medicine and Bachelor of Surgery/Post Graduate Course ; however, the medical college/institute which is not yet recognized by the Medical Council of India for the award of MBBS degree may apply for increase of intake in Post Graduate Courses in pre -clinical and para -clinical subjects of Anatomy, Physiology, Biochemistry, Pharmacology, Pathology, Microbiology , Forensic Medicine & Community Medicine at the time of 4th renewal i.e. along with the admission of 5th Batch for the MBBS course .
(ii) They shall come into force from the date oftheir publication in the Official Gazette .
2. In " The Opening of a New or Higher Course of Study or Training (Including Post Graduate Course ofStudy or Training) and Increase of Admission Capacity in any Course of Study or Training ( Including a Post Graduate Course ofStudy or Training) , Regulations, 2000", the Point No. 3.2 & 3.3 of the Qualifying Criteria of " (A) Part I : Scheme for permission of the Central Government for opening of a new or Higher course of study or training ( including a Post Graduate Course of Study or Training) in a Medical College or Institution " shall be substituted with the following:
3.2 : That Essentiality Certificate in the prescribed format regarding no objection of the State Government/Union Territory administration for opening ofNew or Higher Course ofStudy or Training (Including Post Graduate Course of Study or Training) and Increase ofAdmission Capacity in any Course of Study or Training ( including a Post Graduate Course of Study or Training) in the medical college/ institution and availability of the adequate clinical material as per the Council Regulations have been obtained by the applicant from the concerned State Govt./Union Territory administration, as the casemaybe .
"3.2 That Essentiality Certificate in the prescribed format regarding no objection of the State Government /Union Territory administration for opening of New or Higher Course of Study or
3.3 : That Consent of Affiliation in the prescribed format with respect to opening of New or Higher Course ofStudy or Training (Including Post Graduate Course of Study or Training) and Increase of [PART III-SEC. 4]

Admission Capacity in any Course of Study or Training (Including a Post Graduate Course of Study orTraining) has been obtained by the medical college/ institution from the University to which it is affiliated."
4. In the opening of a New or Higher Course of Study or Training (Including Post Graduate Course of Study or Training) and Increase of Admission Capacity in any Course of Study or Training (Including a Post Graduate Course of Study or Training ) Regulations , 2000 , the 2nd paragraph in paragraph 6, viz . , "Evaluation by Medical Council of India " i.e. " While evaluating the application , the Council may seek further information , clarification or additional documents from the medical college/ institution as considered necessary and shall carry out a physical inspection to verify the information ; clarification or additional documents supplied by the medical colleges / institutions . The dates for receipt of application and processing dates are given in the Schedule to these Regulations , 1999 " , shall be substituted with the following:-
"While evaluating the application, the Council may seek further information , clarification or additional documentsfrom the applicant as considered necessary and shall carry out an inspection to ascertain and assess the facilities of teaching faculty, residents , clinical material , hostels and other infrastructure facilities etc. vis - a - vis the minimum standard requirements for the number of students for which the college is recognized for the award of MBBS degree as per the Minimum Standard Requirements for the Medical College for 50/100/150 Regulations, 1999.
The Council shall process the application for starting ofa Post Graduate Course or for increase of annual intake of Post Graduate courses only in case the college meet with the facilities for teaching faculty, residents , clinical material , hostels and other infrastructure facilities as required under the Ragulations for the respective number of students for which the college is recognized for the award of MBBS degree and then shall carry out the physical inspection to verify the information , clarification , additional documents supplied by the medical college . teaching faculty, residents , clinical material and instrumentation and other infrastructure facilities in the concerned department in which the Post Graduate Course is proposed to be established or increase of seats in the concerned Post Graduate Course is proposed.
The dates of receipt of application for increase in admission capacity in Post Graduate Courses and processing dates are given in the schedule . The dates of receipt of application and processing of applications in respect of increase of seats in MBBS course shall be as per the Schedule included in the Establishment ofMedical College Regulations , 1999" .
