सा.का.नि. 935(अ).-केन्द्रीय सरकार , सशस्त्र सीमा बल अधिनियम , 2007 ( 2007 का 53 ) की धारा 155 की उप- धारा ( 2 ) के खंड ( क) और खंड ( ग ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, गृह मंत्रालय के अधीन सशस्त्र सीमा बल योधक निरीक्षक ( साधारण ड्यूटी ) सेवा में समूह ' ख ' अराजपत्रित पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:-
1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम सशस्त्र सीमा बल योधक, निरीक्षक ( साधारण ड्यूटी ) समूह ' ख' अराजपत्रित पद भर्ती नियम , 2009 है ।
(2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
लागू होना : ये नियम , इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 1 ) में विनिर्दिष्ट पदों को लागू होंगे ।
2. पद संख्या , वर्गीकरण और वेतनमान, उक्त पदों की संख्या , उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।
3. भर्ती की पद्धति, आयु सीमा , अर्हता आदि.-उक्त पदों पर भर्ती की पद्धति , आयु- सीमा , अर्हताएं और उससे संबंधित अन्य बाते वे होंगी जो पूर्वोक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।
4. प्रारम्भिक गठन. ( 1 ) इससे उपाबद्ध अनुसूची में विनिर्दिष्ट ऐसे कार्मिक जो इन नियमों के प्रारंभ की तारीख से ठीक पहले नियमित आधार पर पद धारण किए हुए हैं, इन नियमों के उपबंधों के अनुसार नियुक्त किए गए समझे जाएंगे ।
(2) इन नियमों के प्रारम्भ से ठीक पहले उप- नियम ( 1 ) में विनिर्दिष्ट कार्मिक की नियमित निरन्तर सेवा की संगणना - अपनी श्रेणियों में परिवीक्षा अवधि, प्रोन्नति , पुष्टि के लिए अर्हक सेवा और सेवा में पेंशन के प्रयोजन के लिए की जाएगी ।

5. अनुरक्षण. ऐसा प्रत्येक पद जो इन नियमों के प्रारम्भ की तारीख को रिक्त रहता है और ऐसी प्रत्येक रिक्ति जो उसके पश्चात् उत्पन्नहोती है इन नियमों से उपाबद्ध अनुसूची में और प्रक्रिया में जो केन्द्रीय सरकार द्वारा समय - समय पर विहित की जाए यथा अंतर्विष्ट उपबंधों के अनुसार भरी जाएगी ।
6. प्रोन्नति पूर्व पाठ्यक्रम.-पोषक पंक्तिमें व्यक्तियों को, उनकी अपनी ज्येष्ठता के क्रम में अगली उच्चतर पंक्ति में प्रोन्नति के लिए, सेवा पात्रता अवधि पूरा करने से पूर्व, अर्हक पाठ्यक्रमों को पूरा करने के लिए भेजा जाएगा और बल के ऐसे प्रत्येक सदस्य से किसी प्रोन्नति से पूर्व, इससे उपाबद्ध अनुसूची में विनिर्दिष्ट प्रोन्नति पूर्व पाठ्यक्रमों को उत्तीर्ण करने की उपेक्षा की होगी ।

परन्तु यदि महानिदेशक, सशस्त्र सीमा बल का यह समाधान हो जाता है कि सेवा की अत्यावश्यकताओं या अन्य कारणों से ऐसा कोई सदस्य प्रोन्नति पूर्व पाठ्यक्रम उत्तीर्ण करने में समर्थ नहीं है तो वह बल के सदस्य को ऐसे सदस्य द्वारा प्रोन्नति की तारीख से दो वर्ष के भीतर प्रोन्नति पूर्व पाठ्यक्रम उत्तीर्ण करने के अध्यधीन रहते हुए प्रोन्नत कर सकता है, जिनके न हो सकने पर उसे प्रतिवर्तित किया जा सकेगा।
7. ज्येष्ठता : काडर के विभिन्न प्रवर्गों/श्रेणियों के पदों पर नियुक्त अधिकारियों की परस्पर ज्येष्ठता , इस विषय में केन्द्रीय सरकार द्वारा समय - समय पर जारी किए गए साधारण आदेशों के अनुसार परिभाषित की जाएंगी ।
8. निरर्हता : वह व्यक्ति, -
(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है , या
(ख) जिसने, अपने पति या अपनी पत्नी के जीवित रहते हुए , किसी व्यक्ति से विवाह किया है , उक्त पद पर नियुक्ति का पात्र नहीं होगाः
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।
9. चिकित्सक दृष्टया योग्यता : इन नियमों में किसी बात के होते हुए भी , केवल वे व्यक्ति जो चिकित्सा प्रवर्ग शेप -1 में हैं , इन नियमों के उपबंधों के अधीन नियुक्ति के लिए पात्र होंगे ।
स्पष्टीकरणः इस नियम के प्रयोजन के लिए " शेप 1 " से निम्नलिखित परिभाषित चिकित्सा प्रवर्ग अभिप्रेत है:-
(i) कोड अक्षर शेप (एस.एच.ए.पी.ई) , जो निम्नलिखित कृत्यों को व्यपदिष्ट करते हैं, द्वारा उपदर्शित विद्यमान घटकों के अधीन अधिकारी की उपयुक्तता निर्धारित करने के पश्चात् चिकित्सा अधिकारी द्वारा किया गया चिकित्सा वर्गीकरणः -
एस - मनोवैज्ञानिक
एच - श्रवण शक्ति
ए उपांग (अपैन्डेजेस)
पी- शारीरिक क्षमता
ई - दृष्टि शक्ति
(ii ) प्रत्येक घटक के अधीन किसी अधिकारी की कार्यक्षमता प्रत्येक कोड अक्षर के सामने अंक 1 से 5 की कार्यक्षमता उपदर्शित करते हुए दर्शाई जाएगी और कोड अक्षर के पश्चात् अंक लिखे जाएंगे सिवाय उसके जहां कोई अधिकारी सभी घटकों में श्रेणी-1 में हैं वहां उसका प्रवर्ग एस 1 एच 1 ए 1 पी 1 ई 1 लिखने के बजाय शेष-1 लिखकर दर्शाया जा सकेगा। इन अंकों का साधारण मूल्यांकन निम्नानुसार है: -
(क) कहीं भी सभी कर्तव्यों के लिए योग्य।

(ख) कहीं भी सभी कर्तव्यों के लिए योग्य किन्तु क्या कर्तव्यों में तीव्र कठिनाई या दोनों कानों या आँखों को श्रवण शक्ति/दृष्टि की तीक्ष्णता की मांग अन्तर्ग्रस्त है या नहीं , पर निर्भर करते हुए कर्तव्यों के प्रकार और नियोजन योग्यता क्षेत्रों के अनुसार परिसीमाएं हो सकती हैं ।
(ग) " एस" घटक को छोड़कर नेमी या निष्क्रिय कर्तव्यों के लिए योग्य किन्तु उच्च स्थान (2700 मीटर से अधिक) अत्यधिक ठंडे क्षेत्रों या पहाड़ी भूखंडों पर और लंबे कर्तव्य भारों के लिए नियोजन योग्यता की परिसीमाएं होसकती है ।
(घ) अस्पताल में भर्ती या बीमारी की छुट्टी के कारण कर्तव्यों के लिए अस्थायी रुप से अयोग्य ।
( ङ) कर्तव्यों के लिए स्थायी रुप से अयोग्य ।
10. अन्यदेशीय अपात्रता : कोई व्यक्ति , जो भारत का नागरिक नहीं है , लिखित में केन्द्रीय सरकार की पूर्व अनुमतिके सिवाय , इन नियमों के अधीन नियुक्त नहीं किया जाएगा।
11. अधिवर्षिता : ( 1 ) इन नियमों के उपबंधों के अधीन नियुक्त किया गया कोई व्यक्ति उस मास के, जिसमें वह सत्तावन वर्ष की आयु प्राप्त कर सकता है अंतिम दिन के अपराहृन में सेवानिवृत्त होगाः
परंतु यह है कि वह व्यक्ति जिसके जन्म की तारीख किसी मास की पहली तारीख होगी सत्तावन वर्ष की आयु प्राप्त करने के पूर्ववर्ती मास के अंतिम दिन के अपराहृन में सेवानिवृत्त होगा।
12. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है वहां वह उसके लिए जो कारण हैं, उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बावत, आदेश द्वारा शिथिल कर सकेगी । किसी पात्रता मापदण्ड को शिथिल करने कै शक्ति महानिदेशक, सशस्त्र सीमा बल में होगी ।
13. व्यावृत्ति: इन नियमों की कोई बात, ऐसे आरक्षण आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों , अन्य पिछड़ें वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।
14. सेवा का दायित्व : इन नियमों के अधीन उक्त पद पर नियुक्त कोई व्यक्ति भारत या विदेश में कहीं भी सेवा करने का दायी होगा ।
15. निर्वचन : यदि इन नियमों के निर्वचन कि बावत कोई प्रश्न उठता है तो उसका विनिश्चिय केन्द्रीय सरकार द्वारा किया जाएगा ।

NOTIFICATION
New Delhi , the 31st December , 2009
G.S.R. 935( E) . In exercise of the powers conferred by clauses ( a ) and (c) of sub - section 2 of section 155 of the Sashastra Seema Bal Act , 2007 ( 53 of 2007 ) . the Central Government hereby makes the following rules to regulate the method of recruitment to the Group B Non- Gazetted posts in the Sashastra Seema Bal Combatised Inspector ( General Duty ) Service under the Ministry of Home Affairs . namely : -
1. Short title and Commencement . ( 1 ) These rules may be called the Sashastra Seema Bal Combatised Inspector ( General Duty ) Group B Non- Gazetted posts . Recruitment Rules , 2009 .
( 2) They shall come into force on the date of their publication in the Official Gazette .
Application.- These rules shall apply to the posts specified in Column- ( 1 ) of the Schedule annexed to these rules .
2. Number of posts , Classification and Scale of pay . The number of posts . their classification and the scale of pay attached thereto shall be as specified in Column ( 2 ) to (4 ) of the said Schedule annexed to these rules .
3. Method of recruitment , age limit , qualification etc. The method of recruitment of said posts . age limit , qualifications and other matters relating thereto shall be as specified in Column ( 5 ) to ( 14 ) of the aforesaid Schedule .
4. Initial constitution.- ( 1 ) Personnel holding the posts specified in the schedule annexed herein , immediately before commencement of these rules on the regular basis shall be deemed to have been appointed in accordance with the provisions of these rules .
(2) The regular continuous service of personnel referred in sub rule ( 1 ) in the respective grades immediately before commencement of these rules shall count for the purpose of probation period . qualifying service for promotion , confirmation and pension in the service .

5. Maintenance . Every post remains unfilled on the date of commencement of these rules and every vacancy that may arise there after shall be filled in accordance with the provisions as contained in the Schedule and the procedure as may be prescribed by the Central Government from time to time .
Pre - promotional courses . The persons in the feeder rank shall be detailed 6. to undergo qualifying courses before completing service eligibility period for promotion to the next higher rank in order of their seniority . Every such member of the Force shall . before any promotion , be required to pass pre- promotional courses referred to in the Schedule annexed herein:
Provided that if the Director General , Sashastra Seema Bal is satisfied that due to exigencies of service or other reasons , any such member is not able to pass the pre - promotional course, he may promote such member of the Force subject to passing pre -promotional course by such member within two years from the date of promotion failing which he shall be reverted.
7. Seniority. The inter - se- seniority of officers appointed to posts in different categories / grades of the cadre shall be defined in accordance with the general orders issued on the subject by the Central Government from time to time .
8. Disqualification . . - No person .
a) Who has entered into or contracted a marriage with a person having a spouse living ; or
b) Who , having a spouse living , has entered into or contracted a marriage with any person .
shall be eligible for appointment to the said post:
Provided that the Central Government may , if satisfied that such a marriage is permissible under the personal law applicable to such a person and to other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .
9. Medical Fitness.- Notwithstanding any thing contained in these rules , only those persons who are in medical category SHAPE- I , shall be eligible for appointment under the provisions of these rules .

Explanation.- For the purpose of this rule , " SHAPE - I " means Medical category defined as under : -
(i) Medical classification done by Medical Officer after assessing fitness of the officer under given factors indicated by the code letters SHAPE , which represent the following function: -

( ii ) Functional capacity of an officer under each factor will be denoted by numeral 1 to 5 against each code letter. indicating declining functional efficiency and the numerals will be written next to the code letter . except that where an officer is in Grade - l in all factors , his category may be denoted by writing SHAPE - I instead of writing SIHIAIPIE1 . General evaluation of these numerals is as under : -
(a) Fit for all duties any where.
(b) Fit for all duties but may have limitations as to type of duties and area of employability depending on whether the duties involve severe stress or demand acuity of hearing/ vision of both ears or eyes .

11. Superannuation . A person appointed under these rules shall retire from service on the afternoon of the last day of the month in which he attains the age of fifty - seven years .
Provided that a person whose date of birth is the first day of a month shall retire from service on the afternoon of the last day of the preceding month on attaining the age of fifty seven years ..
12. Power to relax. Where the Central Government is of the opinion that it is
necessary or expedient so to do , it may, by order , for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons . Further powers to relax in any of the eligible criteria are rest with the Director General , SSB ,
13. Saving . Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes . Scheduled Tribes , other Backward classes , Ex- Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
14. Liability of service. Any person appointed to the said posts under these rules shall be liable to serve anywhere in India or abroad .
15. Interpretation . - If any question relating to the interpretation of these rules arises , it shall be decided by the Central Government .
